Abstract

As the source of Islamic teaching, hadith must be apprehended according to the intent of the prophet. If done otherwise, the understanding of prophet's intention as the explanation of Quranic teaching can be misunderstood. The chance becomes even more likely as hadith has its own problems, especially in the context of its comprehension. These problems will create conclusions that at times influence ones' understanding. Among the problems are the complete narration of the hadith, riwayat bi al-ma'na, and conciseness of the hadith. One's understanding of a hadith whose information is complete would be different from the one that is not. Thus, the understanding of hadith problems is very crucial to comprehensively understand hadith.

Abstract

This study surveys the role of women in the development of shari`ah from the introduction of Islam to Aceh in the 12th centurydown to the modern erawith the formal adoption of Islamic law by an Indonesian parliamentary Bill on Aceh’s Special Status in 1999. After briefly exploring this history, we examine contemporary debates on the current implementation of Islamic law by means of five women of differing backgrounds in this Indonesian province. We review historical documents and existing literature as well as qanuns of Aceh (local regulations) which stipulate shari`ah requirements. We also interview the five women, including one whose husband and another who herself were subjected to shari`ah punishment. The results are complex reflecting the intricacy of contemporary understandings of the shari`ah and the issues surrounding rights of women in Islamic law. One voice represents her agreement to the shari`ah punishment of her husband on account of its positive outcome for her family. The other four are critical of the current implementation of the shari`ah in Aceh, yet are not opposed to it; these ladies argue for women friendly shari`ah.

Abstract

Qarinah as evidence leading to a conviction has been used by judges as the consideration basis in resolving a case. Its uses as evidence is still controversial especially in Fiqh. This is not the case in positive law as positive laws are regulated by a nation. The most important part of qarinah as evidence is how the results of technological advancements such as DNA could be used as qarinah. Positive law seems to have adopted DNA as qarinah so as to use it in imposing a legal decision. In reference to the Islamic law, can a DNA technology be used as qarinah? Apparently further research regarding this topic is required. This article discusses fundamental arguments for possible adoption of DNA as qarinah evidence.

Abstract

During the Abbasid period, Muslim culture and civilization was at its zenith. It was a period of economic prosperity and of great intellectual awakening. The Abbasid Caliphate provided the most congenial atmosphere for the advancement of learning and education. In fact, the reign of Mamun-ar-Rashid who has deservedly been called the 'Augustus of Arabs' formed the culmination of the intellectual achievements of the Muslims. He was followed by a brilliant succession of Caliphs who continued his work. Muslims gained access to the Greek medical knowledge of Hippocrates, Discords, and Galen through the translations of their works in the seventh and eighth centuries. These initiatives by Muslims could be seen in the different aspects of the healing arts that were developed. The translation movement of the twelfth century in Latin Europe affected every known field of science, none more so than medicine. The present paper is an attempt to give a detailed contribution of Muslims to science with special reference to medicine. It is in this context the present paper has been analyzed.

This research is expected to find the development pattern in accordance with the challenging tasks for the National Military (TNI) ahead. Despite the fact that soldiers' religious knowledge is still very low, while the faith is generally used as the symbolic emphasis that is less discussed. As a result, it is feared that mentality weakness when facing a tough task, both faced with the sophistication of tools, strategies and mental demands in modern warfare in the future.
