Abstract

Pembangunan wilayah pesisir dalam rangka memanfaatkan potensi di wilayah tersebut sering tumpang tindih, sehingga tidak jarang aktivitas tersebut menimbulkan masalah bagi upaya pelestarian sumber daya alam pesisir. Penelitian ini bertujuan untuk menemukan Model Pengelolaan Terpadu Pembangunan Wilayah Pesisir, yang integratif, koordinasi dan konsistensi program antara pemerintah kabupaten/kota dengan masyarakat dalam pemanfaatan sumberdaya pesisir yang berorientasi pada Peningkatan PendapatanAsli Daerah Masalah yang diketengahkan adalah pengelolaan dan pemanfaatan sumberdaya wilayah pesisir secara optimal, kebijakan Pemerintah Kabupaten / Kota melalui kelembagaannya mengelola pembangunan wilayah pesisir, dan model pengelolaan terpadu pembangunan wilayah pesisir berbasis masyarakat yang sesuai kebutuhan Pemerintah Kabupaten / Kota. Penelitian ini menggunakan metode pendekatan normatif-empiris, sumber data yang dipakai data primer dan sekunder. Data primer diambil 6 daerah pantura di Jawa Tengah ( Brebes, Tegal, Pekalongan, Semarang, Demak dan Pati) dengan mengambil responden sebanyak 320, analisis yang digunakan secara kualitatifkuantitatif. Prinsip-prinsip pengelolaan belum tertata dengan baik (perencanaan, pelaksanaan, monitoring dan evaluasi serta pemantauan, masyarakat memanfaatkan potensi sumberdaya pesisir dari sisi ekonomis dan kurang peduli akan pelestarian lingkungan pesisir (83%). Melalui Peraturan Daerah (Perda) tentang pengelolaan wilayah pesisir, maka akan dicapai keterpaduan pengelolaan wilayah pesisir ( / ICZPM ) yang integratif, koordinasi dan konsistensi program antara Pemerintah Daerah Kabupaten / Kota dengan masyarakat dan instansi terkait maupun Integrated Coastal Zone Management Stakeholder.

Abstract

Narcotics and psychotropic actually only use for the treatment and the development of science, however, lately often misused is not used as intended. Law enforcement again t drug abuse by law enforcement officers are police officers as the spearhead of the criminal justice system, attorney, and court. Law enforcement against drug abuse is done by a variety of efforts such as : pre emtif efforts, preventive efforts, the efforts made by check urine and rasia-rasia, and efforts refresif. That is done the againts drug abuse experiencing barriers are :lack of budget from the Government to conduct operations in the control and prevention of drug abuse, lact of infrastructure, the limited number of vehicles that can be used for operational, weak human resources owned by Police, both in terms of number, of psychic ability, lack of coordination and integration between the agencies involved in drug law enforcement process. As well as criminal chargers and the verdict is too light.

Abstract

The polygamy attacks the life of Indonesian civil servants. This phenomenon, probably, has been taken place by the remuneration. Mostly, the polygamy is committed without any permission of wife, official marriage, and marriage according to the religious or underhand marriage. We justify all of this by speaking of such civil servants as having broken the law or having failed to meet their obligation This violation brings some legal consequences such as disciplinary sanctions according to article 7 of Government Regulation of No. 53 of 2010 on Discipline Civil Servants. By virtue of the criminal law, he who hides the origin of his marriage can be subject to criminal sanctions as stipulated in the chapter XIII of the Indonesian Criminal Code, mainly articles 277-280. This research based on the sociological perspective analyzes two legal issues, i.e. what are the factor hampering the implementation and how to optimize of Government Regulation No. 45 of 1990.

A valid evidence means Cerificate of Ownership can be abtained by registering the right in land. The function of the Certificate of Ownership for ensure the owner in land other parties.

Abstract

Indonesian workers are one of the most influential components of the economic, political and social fields in the country. The government needs to find a  breakthrough and a brief way to improve the skills and competence of work for Human Resources Indonesia in accordance with the needs of the MEA market and not just a breakthrough that is normative through legislation. The  overnment needs to establish policies to curb foreign workers with visas and work permits and refer to the ASEAN Labor Ministers' Work Program (ALMWP) which regulates labor usage standards, to which Indonesia can also keep illegal workers from entering the Indonesian state . The Government fixes the quality and quantity of labor inspectors to supervise the implementation of Law Number 13 Year 2003 regarding Manpower. The Law on Manpower is expected to be perfected immediately to meet them requirements of juridical, philosophical and sociological enactment

Sense of justice is awareness of the every man whereof the law or does ought to punish that, a certain category from psychological life of we are by which we differentiate between laws and doesn't punish, between properly are done and not properly is done. Effective action or way to increase public sense of justice is in the form of drastic a keepment for example memperberat law threat or with interest tightens settlement of adherence of citizen to code/law. Research Method is bibliography study, the result in forming of sense justice democratic country plays a part to form an state order is cleanness, and orders made by power can be implemented by public, without existence of element of constraint from others, and sense of justice is materialization a state, what can bring the citizen toward democratic country.

Abstract

Children are the future generation so to note what became of his rights in the protection and maintenance and always puts the best interests of each child, so the child can grow over time and evolve. This is done in line with children as victims or perpetrators, where given a specificity or differences with penalties against adults so as not to affect the psychological and psychiatric the children. Formulation of the problem is the system of punishment How children and child rights protection According to Law no. 11 in 2012. The method of research is the study of literature, by examining the existing literature related to Child Punishment. Abstract

Human organ transplantation is one alternative therapies that has been growing fastly. Imbalance between organ requirement and availability cause organ shortage organ, that can be solved by using cadaveric donor. The problem formulations are “How is the medico legal implementation of organ transplantation from cadaveric donor to increase the public health?” and “What are the obstacles and solutions for the medico legal implementation of organ transplantation from cadaveric donor to increase the public health?”. The research method are normative juridical and empiric approach by means of thinking deductive and specification of the descriptive analytical research, qualitative normative and empiric as analysis method towards primary and secondary data. Research reveals that medico legal implementation of organ transplantation from cadaver organ in Indonesia is very poor, limited only to cornea; obstacles arise from medic aspect where hospital facing shortage of competent human resources and facilities, less socialization from doctors, public unawareness about advantages and social paradigm where a dead body should be buried whole; law aspect where the law is still unclear. Therefore doctors should be trained, facilities supply for hospitals and wide socialization. Public also has to change their mind set. Transplantation regulation should be replaced in accordance with the new ratified Health Law.

Abstract

In the independence era, especially in the reformation era that highly appreciates Human Rights, the presence of slavery or servitude issue is no longer tolerated. From the legal point of view, Indonesia has stated that slavery or servitude is a crime against a person's freedom that shall be punished by an imprisonment that ranges between five to fifteen years (Article 324-337 of the Penal Code). However, advancement in information technology, communication, and transportation that has accelerated globalization, is also abused by criminals to disguise the slavery and servitude into their new form: human trafficking; they operate secretly and move outside the law.Traffickers – who quickly have grown into transnational syndicates – are very subtle in trapping their preys, but very cruel in exploiting their preys in various ways so victims are powerless to free themselves. Reinforcement of the commitment made by the Government of the Republic of Indonesia (RI) for the elimination of human trafficking is reflected in Presidential Decree No. 88Year 2002 on the National Plan of Action for the Elimination of Trafficking of Women and Children (RAN P3A) and the Bill on Elimination of the Crime of Human Trafficking (UU PTPPO) in order to be passed as a law. In the 2005-2009 National Legislation Program, the Bill on the Crime of Human Trafficking was ranked number 22, out of 55 priority bills to be deliberated in 2005.Prosecution against traffickers has been intensified by building the capacity of law enforcers and greater cooperation with other stakeholders and law enforcers from friendly countries, so the National Police of the Republic of Indonesia has processed 23 of verdicts from the Court: some were found not guilty, others were sentenced for between 6 months to 13 years in prison; the average punishments were 3 years and 3 months. Information dissemination and advocacy by various parties to law enforcers has led to serious penalties being inflicted upon the traffickers. Indonesia has made progress in the elimination of human trafficking especially in women and children, but it is still far from reaching the goal of National Plan of Actions of Elimination of Trafficking of Women and Children, that is: ”To eliminate all type of trafficking of women and children in Indonesia”. Thus, attempts in strengthening the network should be intensified so that the cruelty against Indonesian women and children can be immediately eliminated.

Abstract

Legal protection of the customers of Bank Syariah Law refers to the Banking Law No. 7 of 1992 concerning Banking as amended by Act No. 10 of 1998, Act namely Syariah Banking Act No. 21 of 2008 concerning Islamic Banking, and Bank Indonesia Regulation (PBI) PBI is 7/7 / PBI / 2005 concerning the settlement of customer complaints and PBI No. 8/5 / PBI / 2006 regarding Banking Mediation. The method used is a normative legal research. The results showed that: (1) To provide legal protection, especially for customers, Act No. 10 of 1998 mandated the establishment of the Deposit Insurance Agency (LPS) and requires each bank to ensure public funds are deposited in the bank in question, (2) Protection law for customers of Bank Syariah as consumer banking services in the event of a dispute, the settlement can be made through arbitration, and (3) Model legal protection of customers divided into three groups: the first group, protecting the interests of the Islamic banks and debtors the second group, the unilateral interests of protecting the interests of Islamic banks, as well as a third group, protecting the interests of debtor unilaterally.
