Abstract

The issue of capital punishment in Indonesia provided for in Article 10 of the Criminal Code, where there is a difference of opinionbetween the pro and con, because it is contrary to religion and human rights. The purpose of this paper is to discuss whether the deathpenalty still exists in the legislation to be maintained. The method used the research literature study. It can be concluded that the deathpenalty can be accepted by Indonesian society and still exist to be retained by the decision of the Constitutional Court (MK).

Abstract

Recognition and protection of children's rights is fully a shared responsibility of both the parents, the government and the wider community that guarantees its survival and development and the growth of children in a strong, healthy and intelligent state. The main role in the development of children in addition to nutrition and vitamin intake or fulfillment of clothing, food and shelter, is also needed attention to the development of children in the future which is the right of the child to get education and teaching so that the aspirations can be achieved and succeed as he wants. But with the changing times it turns out that the rights of children are neglected in the sense that they are not fulfilled as expected, because they are triggered by economic factors so that children cannot attend school or continue their education due to marriage at a young age or so-called early marriage. With the occurrence of marriage at a young age for children is a violation of the rights of children, and children experience the destruction of their future because they are not ready and mature thinking and psychology because basically children should be protected from any threat or anyone. Protection of children's rights is absolutely granted, and has been regulated in the child protection law and marriage law regarding the age limit of children, the fact that there is still a high level of child marriage. The research method that is used or used in this writing uses literature studies based on the literature of journals, books, magazines and even from legislation relating to child protection and child marriage. The results showed that economic factors are the dominant occurrence of early marriage and lack of awareness of parents and community members on the protection and prevention of child marriages, on the other hand there is the assumption that by marrying their children, the obligations of parents are completed and by carrying out the marriage live independently without depending on their parents. The involvement and participation of the government can also prevent early marriage, especially in the application of sanctions in the rules that have been set, because if you want to protect children's rights, one of them is to prevent early marriage, or in other words stop child marriage.

Abstract

State confiscated storage house (rupbasan) in the provisions of the Criminal Procedure Code (Criminal Procedure Code) is a place of storage of confiscated objects or the proceeds of state booty in the form of movable and immovable goods to be stored after receiving a permanent decision from the court must incorporated into rupbasan, in carrying out its duties, Rupbasan still experiencing obstacles both internally or externally to be addressed properly, so that Rupbasan as a place to keep confiscated objects remain existence and competence according to its function. Internal obstacles are lack of human resources (HR), limited facilities / infrastructure, lack of regulation about Rupbasan, unknown level of examination case of goods deposited, no time limit of goods custody, External obstacles of assumption law enforcement officers that rupbasan has not been able to manage / storing confiscated objects of state, and there is no similar perception of society related to rupbasan, especially related institutions.

Abstract

Penelitian ini bertujuan untuk mengetahui bahwa wujud nyata dari implementasi pendidikan pancasila dan nila-nilai dari setiap sila-sila didalamnya dapat disosialisasikan dengan mengikutsertakan dan melibatkan mahasiswa dalam keikutsertaan tri dharma perguruan tinggi dalam mengembangkan wawasan, pengetahuan bahkan juga keahlian yang sudah didapatkan atau diperoleh selama berada di bangku perkuliahan serta mempraktekkan keahliannya dalam kehidupan ataupun juga terjuan dan ikut serta dala masyarakat, yang sesuai dengan nila-nilai kehidupan dan juga kemanusiaan juga moral dan norma dalam pancasila. Relevansinya dalam mengimplemantasikan  khususnya dalam bidan pennelitian dan juga pengabdian masyarakat, Dengan mendapatkan dan juga memperoleh  ilmu di universitas maka mahasiswa tersebut dapat juga mengamalkan dan mengabdikan dalam di lingkungan tempat tinggalnya, sesuai dengan bidang keahliannya. Metode yang digunakan dalam penelitian ini adalah penelitian pustaka dengan mengkaji buku-buku dan literatur-literatur. Hasilnya adalah Pengamalan Pancasila yang didapatkan atau diterima mahasiswa di perguruan tinggi dapat diterapkan bukan hanya sebatas dilingkungan tempat, tinggalnya saja tetapi juga kepada implementasi Tri Dharma Perguruan Tinggi itu sendiri, dan hal ini akan berdampak luas kepada mahasiswa itu sendiri dalam lingkungan kerjanya nanti yang akan terlihat jika mahasiswa tersebut sudah lulus dan mendapatkan pekerjaannya, sesuai dengan bidang skili dan pengalamannya selama terjun dan mengabdikan dirinya dalam rangka mengimplementasikan Tri Dharma dari Perguruan Tinggi tersebut.

Abstract

Early marriages are increasingly prevalent and the causes are diverse, due to economic problems, promiscuity, and unpreparedness the couple take responsibility for supporting families, the impact on domestic violence, where can include due to physical violence causing injuries body, bruising or serious injury, psychic can be interpreted as cussing, glaring at causing self-esteem and mental decline, sexually interpreted to have sexual relations or rape marriage, and neglect the household and not provide for than five to ten years in a row -According and leave without breaking news. The purpose this research find the polemic of early marriage to domestic violence based on impact and consequences, the research method used is normative jurisdiction where this method refers to literature, namely by examining the literature or legislation relating to the problem under study. The results this study indicate that early marriage causes domestic violence because is triggered the impact high emotional, mental, psychological, causing violence in the domestic sphere, not only to women but also children who should receive protection and affection from parents but become victims, and Another impact is child traumatized and difficult to forget the dark events his life, because the child feels he become a victim his family.

Abstract

The aim of this research is to find out rehabilitation both in the form of medical and social assistance given to minors as addicts to narcotics, which can endanger lives and bodies, so that by carrying out rehabilitation gradually the child can return to the original condition with the recovery he has obtained. Besides giving in rehabilitation is a form of recognition and appreciation for the constitutional rights of citizens, where these rights are constitutional rights that have been contained in the 1945 constitution and those rights are rights protected by the government, and the state is also law, rights that are constitutional here in relation to is the right to health and the right to adequate housing, and the existence of integrated recovery both physically, mentally and socially so that children as addicts of narcotics can be accepted again in society, bearing in mind that children are the buds of the nation which will carry forward the ideals and struggle of the nation, so that it must be restored to the condition of the psyche and his health, because by restoring his condition will return to carry out activities or activities in gaining knowledge by learning, getting education and playing with his friends as usual, it can be said that the child as an addict from narcotics has returned to his normal environment and made a process of interaction in general . The formulation of the problem to be examined is whether the provision of rehabilitation of children as addicts of narcotics is part of the realization and recognition of constitutional rights in accordance with the constitution of the constitution by 1945. The method in this study uses juridical and normative that is using literature related to the problem to be investigated and can answer existing problems, where the results are that medical and social rehabilitation given to children as addicts of narcotics can provide recovery and return it to the psychological condition in a psychological way. integrated through physical, psychological and social health, and this is also a guarantee and protection from the government in fulfilling its constitutional rights as citizens, because by fulfilling the guarantee and recognition including the protection of children's rights, protection of the rights the most essential is the protection of the rights in his life to obtain opportunities in education and also health and play.keywords ; rehabilitation, children, narcotics, constitutional rights

Abstract

Inheritance is an object that has been given by an heir in the form of a moving or immovable object. Distribution of inheritance often causes inheritance disputes between parties who receive an inheritance. The assets and inheritance that are disputed sometimes give harm to parties outside the heirs. The system and rules governing inheritance are very necessary for a country known for its diverse customs, one of which is Indonesia. This study aims to investigate the principle of justice in distributing inheritance based on the compilation of Islamic law (KHI). The method used in this study is library research using various literature and legislation. The results of the study show that the distribution of inheritance among the parties has not referred to the national legal system but is still based on a legal system agreed upon by the parties. They have the right and can use and choose which law to use for their inheritance. Existing laws will always provide and accommodate various forms of taste and justice created in the lives of the general public and in that case, are the same age as an inheritance under various systems and laws and that are truly trusted by the heirs.

Abstract

Pernikahan dapat diartikan ikatan sosial atau ikatan akan perjanjian secara hukum dan antar pribadi yang dalam membentuk adanya hubungan secara kekerabatan dan juga merupakan suatu akan pranata dalam budaya daerah yang setempat dengan meresmikan hubungan secara pribadi, yang mendasarkan kepada keluarga yang bahagia dan kekal yang berdasarkan kepada Ketuhanan Yang Maha Esa. Tujuan dari Penelitian ini untuk mengetahui bahwa Pelaksanaan akan sertifikasi dari pranikah yang akan dilakukan oleh pasangan muda-mudi yang akan melangsungkan pernikahan dapat mempertahankan rumah tangganya dengan mengurangi terjadinya kekerasan yang merupakan suatu tindak pidana dan juga sebagai bentuk dari perlindungan terhadap perempuan dan juga anak, yang sangatlah rentan dengan berbagai kekerasan. Metode penelitian yang digunakan adalah penelitian kepustakaan yaitu dengan mengkaji literatur dan peraturan perundangan yang berkaitan dengan masalah yang diteliti. Hasilnya adalah bahwa dengan aktualisasi penerapan dari sertifikasi pranikah tersebut setidaknya dapat mengurangi angka kekerasan dalam rumah tangga serta dapat membentuk keluarga yang harmonis dan sejahtera.

Abstract

Domestic violence is an increasingly widespread problem, and is often triggered or caused by a variety of things, but the most prominent is economic problems or primary needs. Perpetrators as people who commit violence can be reviewed why to do it, due to several factors in him, such as the environment, heredity, psychiatric disturbed so that in solving household problems is often done with high emotions and full of inappropriate words spoken to the interlocutor. While the victim as the party suffering due to the treatment given by the perpetrator must also be seen, the perception of the victim as a weak party, the victims here based on the type there are victims who really want themselves to be victims, there are victims who are truly themselves victims, exploited by the perpetrators, where violence there are various forms of physical, psychological, sexual violence and neglect of the household, this is seen when viewed from the perception of criminology and victimization. The research method used is normative juridical that is by tracing the literature and legislation relating to the problem under study. The result is that the perpetrators of domestic violence are seen from the aspect of the perpetrators' responsibilities regarding their age to be able to punish and sanction, the victims see their role when the crime is related to the loss suffered, and the settlement of the household according to the law on the elimination of violence in the household namely number 23 of 2004, namely by preventing the occurrence of criminal acts, protecting victims, providing emergency assistance, assisting the process of determining the application for protection.

Abstract

Tindak pidana mengalami perkembangan yang sangat kompleks. Awalnya bersifat konvensional, kini tindak pidana berkembang sesuai dengan kondisi zaman dan mengalami perkembangan modus yang beraneka ragam. Perkembangan tindak pidana yang terjadi saat ini memiliki motif ekonomi yang terus berkembang saat menjalankan kejahatannya. Salah satu tindak pidana dengan motif ekonomi adalah tindak pidana perdagangan orang. Secara konvensional, tindak pidana perdagangan orang dilakukan dengan mengajak seseorang dengan iming-iming mendapatkan pekerjaan dengan hasil yang besar. Saat ini, perekrutan dilakukan secara online dengan cakupan yang sangat luas. Masalah utama dari tindak pidana perdagangan orang tersebut adalah korban tidak mudah untuk mendapatkan restitusi atas tindak pidana yang terjadi pada dirinya. Pelaku tindak pidana perdagangan orang seringkali menghindar untuk memberikan restitusi, bahkan bersikap seolah-olah tidak memiliki harta apapun yang diperoleh dari bisnis perdagangan orang tersebut. Untuk menghindari penolakan pembayaran restitusi kepada korban perdagangan orang, perlu dilakukan mediasi sejak proses penyidikan. Upaya mendapatkan ganti rugi tersebut dilakukan melalui mediasi penal. Upaya perdamaian melalui mediasi penal tidak akan menghapus tuntutan atas tindak pidana yang terjadi, namun hanya mempermudah penyitaan harta kekayaan yang diperoleh dari hasil dari tindak pidana perdagangan orang.
