Abstract

The study of prophetic tradition which focuses on socio-historical perspectives must be conducted to explore a new perspectives of prophetic tradition studies. The science of Contradictive prophetic tradition which established by al-Syafii is a part of prophetic tradition sciences which can be analyzed with socio-historical perspectives. This article used a sociology of knowledge dialectic approach to find a socio-historical background of establishment of the Science of Contradictive prophetic tradition. This approach conclude that the framework of al-Syafii's Science of Contradictive prophetic tradition influenced by many thought on prophetic tradition which arose in al-Syafii's life especially the destructive one to the position of prophetic tradition in Islam. According to sociology of knowledge perspective, al-Syafii's science of Contradictive prophetic tradition must be open to receive a new contribution of methodology of prophetic tradition understanding.

Abstract

The purpose of this study is to find out the concept of blessing in giving zakat according to Islamic teaching and to deepen its indicators felt by muzaki. Research method used in this study is qualitative approach. Technique of collecting data is documentation, observation and interview. The interview was conducted twice. The first step was done to 396 respondents, and then it’s continued to the second step with 20 different respondents. Sampling technique used in this study is purposive random sampling. Research findings showed that 98% of muzaki stated that they felt the existence of blessing in giving zakat, and according to them the highest blessing is inner peace; however when high percentage is correlated to the tendency of giving zakat to zakat institution, the result is not correlated. In addition to those mentioned, muzaki felt religious experiences related to blessing after they paid zakat. The highest blessings they felt most are: inner peace, easy of business, calm feeling, effective property, and far from harmful things.

Abstract

Wakaf is one of the main religious service which contains productive economic values but in reality thevalues haven’t fully been implemented. The most important factor of this is the lack of socialization and the minimum role of the government (Badan Wakaf Indonesia). The enactment of the new wakaf bill (UU No. 41/2004) which followed by Peraturan Pemerintah Nomor 42 Tahun 2006 has not effective yet. How to maximize waqf advantages for society empowerment? This is the focus of study. The result of study shows that wakaf is very important to be the source of capital for empowering umat’s economy. The way to understand (fiqh) wakaf must be reformulated. The maximization of productive wakaf needs proper public understanding and good management. That is why that the nadhir must fulfill moral, managerial, and entrepreneur qualifications. The writer conclude that only trough revitalizing the role of BWI and the public awareness, the new paradigm of waqf can be realized in Indonesia.

Abstract

Dalam hukum positif Indonesia, autopsi forensik diatur dalam Kitab Undang-Undang Hukum Pidana, Undang-Undang No. 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana dan Undang-Undang Nomor 36 Tahun 2009 Tentang Kesehatan. Ketiga undang-undang tersebut membenarkan melakukan tindakan autopsi dengan tujuan untuk menegakkan keamanan, dan keadilan bagi masyarakat. Hasil pemeriksaan autopsi forensik akan tertuang dalam sebuah laporan tertulis dalam bentuk visum e repertum dapat digunkan sebaga alat bukti di pengadilan. Dalam hukum islam, autopsi forensik dilarang karena dapat merusak mayat dan melanggar kehormatan mayat. Namun, ada beberapa ulama membenarkan autopsi forensik dengan alasan untuk mewujudkan kemaslahatan ummat (mashalih mursalah) baik di bidang keamanan, keadilan, dan kesehatan. Berdasarkan Fatwa Majelis Ulama Indonesia Nomor 6 Tahun 2009 tentang Autopsi Jenazah menyebutkan bahwa pada dasarnya autopsi dilarang atau haram, namun dalam keadaan Darurat atau mendesak maka diperbolehkan. In Indonesia positive law, a autopsy is regulated in the Criminal Code, Law No. 8 of 1981 concerning the Criminal Procedure Code and Law Number 36 of 2009 concerning Health. The three laws justify carrying out autopsy actions with the aim of enforcing security, and justice for the community. The results of a forensic autopsy examination will be contained in a written report in the form of a post mortem report that can be used as evidence in court. In Islamic law, forensic autopsies are prohibited because they could damage a corpse and violate the honor of a corpse. However, there are some scholars who justify the forensic autopsy on the grounds of realizing the benefit of the ummah (mashalih mursalah) in the fields of security, justice and health. Based on the Fatwa of the Indonesian Ulema Council Number 6 of 2009 concerning the Body Autopsy states that basically autopsies are prohibited or haram, but in an emergency or urgent condition it is permissible.

Abstract

Observing the development and growth of modern markets that is not comparable to traditionalmarkets and folk market, has described the tendency of secondary needs (psychological) which aredominant, and has been proven by Consumption Patterns Survey Central Bureau of Statistics (1991-2012). The survey shows that spending to meet the secondary needs amounted to 62.56% while for theprimary requirement of 37.44%. The order to meet the secondary needs and primary needs exist in theQur’an, but all of them in order to improve the achievement of the religious (pious charity) is not tosatisfaction solely. Based on a survey of consumption patterns and theories about the need for secondaryand work performance, attractive to the research, is there a need for Secondary Effect on Achievementof the Religious? From the loading factor corfirmatory mu’amallat with second order factor Analysis isas follows: secondary needs loading factor = 1.00 (significant). This figure shows that the needs of mostlarge secondary needs described by the variation of mu’amallat motivation. In other words secondaryrequirement is the most powerful indicator (dominant) of mu’amallat motivation (work and production,needs secondary, needs primary, work performance of religious).

Abstract

This study aims to explore the contribution of the concept of adultery jarimah to the renewal of the Indonesian criminal law. The method used is the approach of the legislation. Data are taken from the interpretation of Qur’an, hadith ahkam, fikih jinayah, Draft of Criminal Code and the Criminal Code. This study shows that the definition of adultery and sanctions under Article 284 of the Criminal Code are contrary to Islamic values and indigenous national culture based on Pancasila. Therefore, it needs to be updated to include the Islamic values and indigenous national culture based on Pancasila.

Abstract

This paper focus on a manuscript entitled Serat Waosan Puji. This manuscript is saved at Widya Budaya library of Yogyakarta kingdom. Data is analyzed using reception theory and sociology of letter. Finding of this research shows that physically this manuscript is in a good condition and readable. This manuscript consists of several texts which tell about do’a (prayer), pillar of faith, pillar of Islam, theology, name of verses in the Quran, Ki Purwadaksina’s teaching, Serat Niti Sruti, and Serat Nitipraja. Meanwhile, the teaching of harmony is stated in three pupuh (chapter) namely pupuh dhandhanggula consisting of Ki Purwadaksina’s teaching, pupuh dhandhanggula consisting of Serat Nitisruti, pupuh dhandhanggula consisting of serat Nitipraja. Among all of those harmonius teaching are (1) philosophy of life comprising pandhita lami, pandhita boja karana, and pandhita umarshandu or pandhita gunung, (2) things which should be avoided namely pandhita sipat, limpad, prakken sang hyang, nggenthong umos and tawang brana. (3) lesson of life interaction such as empathy, respecting others, humble and others, (4) asthabrata, (5) principle of king.

Abstract

Al-na’im has reconstructed the old legal theory – the theory of nasakh – with a new theory, namely the reverse nasakh or the theory of Islamic legislation evolution in order to revive the eliminated verses caused by the traditional nasakh. When there is verse contradicts to the benefit humankind this nash should be ignored and finds another nash which is more relevant. Thus, the public law of Sharia is in function to meet the demand of needs and course of development.

Abstract

There are so many problems that can be found in Islamic Family Law viewed from modernapproach especially gender equality. Starting from the rule of marriage guardian that controlled bymen, inheritance dominated by men, and also all the provisions concerning the witnesses whichweakens the existence of women. In Indonesia context it, is important to analyze the problem ofguardian and witness of marriage through the maqashid asy-syari’ah and will find the solution wherethe guardian of marriage is the primary element in order to guard of honor and about witness ofmarriage as a secondary element that has the function as the main purpose of marriage. Based onthat classification, it was found that the primary element about the guardian and the secondaryelement about witness of marriage, it led significant difference between the Arab and Indonesiacontext. Therefore, reforms are needed in the Islamic Family Law through the cultural approachso it can be responsive in Indonesia. In the Arab culture is patriarchal (patrilineal) master, while inIndonesia there are multi kinships complex such as patrilineal, matrilineal and bilateral, it impliesthe need reformations that bring the solution accordance with the local wisdom of Indonesia forthe instance the implementation of gender equality openly.

Abstract

The purpose of this study was to determine the effect of the characteristics on the performance ofIslamic mutual funds in Indonesia. By analyzing data from 27 Islamic mutual funds traded on theIndonesia Stock Exchange during the 48 months (January 2010-December 2013), and using panel dataas a technical analysis, the study came to the conclusion that the characteristics of Islamic mutual funds,represented by the turnover ratio, expenses ratio, fund size, fund age, and fund selection influence theperformance of Islamic mutual funds in Indonesia. Turnover ratio, fund size, fund age, and fundselection have positive effect to the performance of Islamic mutual fund.
