Abstract

The system of patriarchy has a minor view on women who are considered as subordinated to men due to their lack of intelligence. Religious texts interpreted from androcentric point of view, local culture of Arabian society of the middle age, and the influence of social system of Persians and romans are responsible in perpetuating the system patriarchy. By emphasizing universal concept of the Quran on justice, equality and harmony, this article aims to repudiate the argument of patriarchy which permeates traditional Muslim social system. This article also critically examines misogynic hadith on fitna, absolute surrender and lack of intelligence of women of wife, upon which patriarchal authority and women subordination is based.

Abstract

The problem that frequently appears in Islamic economic contract is the debate on its normative legaland philosophical basis. This article will explain that many contracts in Islamic economic law are basedon the philosophy of law. The philosophy of Islamic economic law is based on triangle concept, i.e.philosophy of God, human being, and nature. It is characterized by God-oriented (rabbani) and humanity-oriented (insani) economy. Its God-oriented character preceives Allah (God) as the center ofhuman awareness in performing economic activities and it reflects in economic behavior considering thenature of human being and promoting the values of goodness, justice, and mutual relationship.

Abstract

Shariah stocks is one of the financial sectors that experienced with most significant growth in recentyears. the most important issue in Shariah stock is Stock screening mechanism. The aim of this study isto examine the screening models of Shariah stocks in ASEAN countries. This study is very crucialespecially in the era of ASEAN economic community (AEC). In addition, this study aims to examinesome of the factors that contribute to the differences in screening models applied in five ASEANcountries. By using descriptive method and literature studies approach, this study found a few things.Firstly, there are various models of Shariah stock screening in Indonesia, Malaysia, Singapore, Thailandand Philippines. In this context, the model screening in ASEAN countries have two tendencies, namely;for the country in the majority of the population is Muslim whereby there are many Sharia expert, thenthey will use the specific screening model and applied only in the country, while for the country that themajority is not Muslim, then they will tend to use models of screening that has been used globally forexample DJIM, FTSE, etc. This second pattern has been applied by Singapore, Thailand and Philippines.Secondly, differences in shariah screening models influenced by several factors, namely; differencesin social structure of a country where the Islamic stock market is located; the difference in the financialindustry that exist in the country will affect on the difference of screening models; and differences sectembraced by most scholars in a country is one of the fundamental factors in determining stock screeningmodel of sharia in 5 ASEAN Countries.

Abstract

Tulisan ini mengangkat Apakah Negara Madinah itu sebuah doktrin teologis yang bersifat finalistis ataukah eksperimentasi sejarah yang bersifat kondisional? Buku Chiefdom Madinah ini ditulis dengan riset amat serius. Pendekatan dan metode yang dipakai dalam buku ini interpretasi sosio-historis. Dengan metode book review peneliti memperlihatkan kepada pembaca ternyata bagi penulis buku Chiefdom Madinah: Salah Paham Negara Islam bahwa Islam dan tradisi Arab jahiliah sama-sama memberi andil bagi kemunculan “Chiefdom Madinah”, yakni sebentuk pranata kekuasaan terpusat pra-negara (pre-state) yang jadi sumbu tata kelola masyarakat Muslim Arab di Madinah dan wilayah taklukannya di masa Rasulullah SAW dan keempat khalifah penggantinya. Praktik pengorganisasian kekuasaan pada waktu itu memang menyerap banyak elemen sosial-budaya setempat, bersifat sementara, ad hoc, dan belum menampakkan bentuknya yang matang. Hingga kini, belum ada kesepakatan mengenai konsep politik dalam Islam, seperti konsep sebuah negara Islam. Negara Islam yang didirikan Rasulullah dipandang sebagai bentuk paling ideal. Tapi, masih terbatas pada ajaran yang ideal, belum sampai pada model baku dan terperinci yang dibutuhkan dalam pendirian sebuah negara modern. Buku ini hadir di tengah banyaknya tuntutan sekolompok orang yang ingin memperjuangkan syariat Islam dalam bernegara karena dianggap pilihan ideal untuk menjawab segala persoalan dan problem kemanusiaan dan keumatan. Sementara, perjuangan menegakkan syariat dikhawatirkan justru akan menjadikan agama sebagai alat legitimasi politik belaka. Setidaknya, dengan membaca buku ini kita tidak lagi terjebak pada perdebatan-perdebatan sempit yang mengarah pada hal-hal yang sifatnya distorsif. Buku ini merupakan hasil kajian yang sangat penting bagi khazanah politik Islam, khususnya dalam konteks Indonesia yang terkadang masih berlangsung tarik menarik antara Negara agama dan Negara sekuler.

Abstract

Riset ini bertujuan untuk mengeksplorasi bagaimana peran pemerintah terhadap peredaran produk pangan halal terutam yang beredara di Kota Kuala Tungkal dan Kota Jambi. Kota Kuala Tungkal adalah salah satu pintu masuknya peredaran barang impor yang terletak di wilayah Singapura, Johor, Riau (SIJORI). Makanan impor yang beredar pada umumnya sudah memiliki nomor register BPPOM, namun tidak memiliki label halal. Padahal undang-undang jaminanan produk halal sudah disahkan sejak 2014 oleh pemerintah.  Pendekatan yang dipakai dalam riset ini adalah pendekatan fiqh. Metode pengumpulan data dilakukan dengan cara observasi, wawancara mendalam, dan dokumentasi. Teknik purposive sampling dipilih untuk menentukan kriteria para informan yang akan diwawancarai yakni Ketua MUI dan kepala BPPOM Propinsi Jambi. Adapun hasil penelitian menunjukkan bahwa regulasi jaminan pangan halal sudah diatur sejak lama di Indonesia, namun belum dapat diaplikasikan dengan baik. Hambatan dan tantangan implementasi jaminan produk halal muncul di lapangan terkait dengan tiga faktor yakni keterbatasan kewenangan stake holder di daerah, kurangnya anggaran, sumber daya manusia, dan infrastruktur yang kurang memadai.

Abstract

The article  traces to find the significance of maslahah to solve Islamic economics problems in the ageof globalization. The age of globalization supported by information technologies revolution makes allaspects of human life changes rapidly especially in economic activities. Islamic economic developmentrequired ijtihad with respect to the reality. In the context of ijtihad, Islamic economic require to be wokeup in the frame of maqasid shari‘ah. Maslahah, as important part of maqasid, need to be placed proportion-ally. Benefit, maslahah, and benediction (falah) will be reached only if Islamic values and principles areimplemented in the economic behavior. Neglecting to one of them will make it cripple. Applycation ofeconomic principles without Islamic values will only give material benefit, while principal execution andvalue will bear benediction and benefit or maslahah eternity world. Therefore consumer whose applyingsufficiency principle in buying goods, will buy goods so that minimum requirement of him fufilled. Hewill sought to fulfill the requirement without require to look into the availibility of goods to others. Onthe contrary if only executed principle, hence it will yield earthly benefit.

Abstract

The starting point of use between sadd and fatḥ is al-dzarī‘ah. In Madhab Mālik and Ḥanbālī, al-dzarī‘ah is prohibited and recommended. Al-Qarafī of Madhab Mālik and Ibn al-Qayyim of Madhab Hanbalī mention al-dzarī‘ah sometimes forbidden (called sadd al-dzarī‘ah) and are sometimes told (called fatḥ al-dzarī‘ah). In the study of fiqh jināyah (Islamic criminal law), the theory of sadd al-dzarī'ah and fatḥ al-dzarī'ahis still open to its development space, given the many ways in which criminal acts are carried out, such as corruption in Indonesia which has been rooted among officials. While the eradication is not maximal and requires a comprehensive set of regulations, so that various gaps in corruption in Indonesia can be indicated and all forms of disobedience to the state and people's welfare can be overcome because they contain greater values of maslahah. The two theories of Islamic criminal law, especially regarding sanctions for corruption, can be made possible in the law of eradicating corruption in Indonesia, thus creating anti-corruption laws in a stronger law enforcement process.

Abstract

Procedural legal issues of religion in resolving divorce cases still using prosedural of civil law (H.I.R andR.B.Bg). Size of formal mechanistic truths, so the more important aspects of the divorce prosess legalcertainty and axpediancy, however, rule out the maslahat aspect, in accordance with the value of Islamiclaw. The research objective is to examine the application of civil law in the process of divorce in westernreligious courts that have shifted, so the procedural law can not be used to answer problems in areas offamily law. Research methodology using normative judicial approach to secondary data laws and judicialdecisions of religion. Procedural law religious marriage in Islamic can not be measurred by mere formalproof, but there are aspects of the sacred reality can not be measured from a mere formal proof.Enforcement of civil law aspect “mutatis mutandis”, it did not touch the substantial aspects the“mashlahat” aspect. Implications of the case, that the rule of law in judicial process likely to lead todesecularization religious law of Islamic, not the desration of Islamic law.

Abstract

This study aims to examine the scientific trend of approach and theme of lecturer’s works of STAIN Bengkulu in the field of Islamic law (fiqh) and the scientific position of lecturer’s works of STAIN Bengkulu as Muslim intellectuals. This article is using two approaches, namely the conceptual approach and historical approaches, whereas measures of research was conducted by reviewing documentation as primer data and interviewing as sekunder data. The results showed that the scientific trend of approach and theme of lecturer’s works of STAIN Bengkulu was consists of three kinds: First, the normative trend of scientific approach and theme in Islamic law. This trend was categorized as “exclusive Muslim intellectualism”. Second, this trend began to expand the discourse of study on fikih, but it was not to integrate with Western scientific approach. This trend was categorized as “inclusive Muslim intellectualism”. Third, this study was more empirical and historical-sociological approach and theme in Islamic law (fikih) so that the discourse was more be able to answer the situation and condition of the people. This trend was categorized as “pluralist Muslim intellectualism”.

Abstract

Sepeninggal Rasulullah Saw. perdebatan seputar keabsahan hadis sebagai sumber hukum Islam tampaknya tidak akan menemukan akhir. Bahkan, kecenderungan dalam hal ini mengarah kepada semakin tingginya intensitas perdebatan seputar keabsahan dan keotentikan hadis. Ini tidak hanya terjadi di kalangan ulama hadis yang muslim, tetapi juga di kalangan orientalis Barat non muslim yang menaruh perhatian kepada studi hadis.
