Abstract

ABSTRAKDalam hal ada permintaan penyitaan harta kekayaan nasabah bank oleh pihak Pengadilan dalam perkara perdata, maka bank harus memenuhi permintaan tersebut tanpa perlu melanggar ketentuan tentang rahasia bank. Jadi singkatnya adalah sebagai berikut: Pejabat yang melakukan penyitaan atas simpanan dana maupun barang simpanan nasabah harus menyerahkan surat perintah; penyitaan yang ditanda tangani oleh Pejabat Instansi bersangkutan yang berwenang; Penyitaan untuk kepentingan perkara pidana disamping harus menyerahkan surat perintah penyitaan, juga pejabat yang bersangkutan harus mnyerahkan surat izin dari Ketua Pengadilan Negeri setempat, kecuali dalam keadaan yang sangat perlu dan mendesak maka tanpa disertai surat izin dari Ketua Pengadilan negeri setempat; Penyitaan untuk kepentingan perkara perdata disamping harus menyerahkan surat perintah penyitaan, juga pejabat yang bersangkutan harus menyerahkan tindasan Surat Penetapan Hakim Pengadilan setempat; Apabila pejabat yang melakukan penyitaan simpanan dana nasabah ingin mengetahui data keuangan nasabah yang disita, maka pejabat yang bersangkutan terlebih dahulu harus mendapat izin tertulis dari Pimpinan Bank Indonesia.Tukar menukar informasi berdasarkan ketentuan dalam Surat Keputusan Direksi Bank Indonesia, tidaklah menutup kemungkinan adanya pihak yang dirugikan yang dalam hal ini adalah debitur yang dapat menjadi korban kerugian dari tukar menukar informasi tersebut. Karena hal tersebut bisa terjadi apabila adanya rekayasa informasi dari oknum petugas bank pemberi informasi yang kebetulan sedang mempunyai masalah pribadi dengan debitur yang diminta informasi tentang keadaan selama menjadi debitur bank tersebut. Untuk itu seyogyanya, informasi antar bank harus melibatkan pejabat Bank Indonesia secara langsung untuk mengetahui kebenaran dari informasi yang diberikan oleh bank pemberi informasi, sehingga rekayasa informasi tidak akan terjadi.

Abstract

ABSTRACT This study has three objectives, first explaining the condition of the application of material criminal law to Broadcasting Institution showing the violence in television impressions. Secondly to know the role and responsibility of Television Broadcasting Institution showing the impressions containing elements of Violence. The third explains the obstacles to the implementation of Law No. 32 of 2002 on broadcasting is still not effective in preventing the exposure of violent content on television.Furthermore, this research was conducted in Samarinda city of East Kalimantan, with research location at office, Regional Indonesian Broadcasting Commission (KPID), and by collecting data from various literatures and internet sites. The research used is interview, library research (library research). The results of the data analysis are presented descriptively, ie describe, describe, and explain the issues relevant to this research in clear and detailed.  Data analysis technique used is qualitative analysis, that is by analyzing secondary data obtained according to formulation of problem which have been determined. The results showed that television broadcasters and perpetrators in the display of impressions using elements of violence including irregularities to Law No. 32 of 2002 on Broadcasting, but in fact not applied. The obstacle faced is the first, Business Competition. Now the news on television more and more and growing so that the television stations are competing to present exclusive and exclusive news packaging for the public interest.  Television broadcasts are only concerned with the rating, regardless of the impact of broadcast aired for the wider community. Second, Press Freedom. Freedom of the press and freedom of expression are the "powerful stunts" that continue to be used in today's democratic era. There is nothing wrong with both, even we need to appreciate and fight for it. The problem is, we often forget that freedom must be interpreted as a whole. Moreover, freedom must also be implemented with full wisdom and responsibility. Without it, freedom will certainly be problematic and will certainly cause problems. Freedom with intact meaning assumes freedom with limits.

Abstract

ABSTRACSBased on Article 61 paragraph 3 of Government Regulation Number 24 of 1997 statedthat: If a person who has right stoland has passed away then the right as an heir is obliged to register his right with in 6 (six) months since the death of that person, shall not be charged Registration.From the provisions of the above article that with the existence of legal events in the form of in heritance, it can be said that the heirs who receive the transfer of owner ship rights as heirs must register the transfer of rights to the Office of National Defense.Within a period of 6 (six) months from the date of the death of the heir it shall be registered,it is intended to be issued a new certificate in the name of the heirs concerned and so that the heirs certainty and legal protection for the new holder of property rights.The registration of transfer of rights due to in heritance is done directly by the right holder / heir to the National Land Office accompanied by documents that must be fullfilled that the respondent who register the transfer of owner ship rights because the in heritance is done through the lurah as much as 18 respondents or 60% who make the request Through notary services as much as 9 respondents or 27% and who register the transfer of rights due to individual in heritance as much as 7 respondents or 19%.

Abstract

ABSTRACT The purpose of this research were to know the implication of 5 year’s rule of law legal security of land right in Tenggarong, Kutai Kartanegara and to know the mecanishm of canceling the land right that canceled by the court. The method of this research used normative law reasearch, were to investigate and study the rules of regulation about list of land right. According to analysis result and theory, the researdier found that law security of the owner of land right related to applied rechtsverwerking institute in article 32 clause 2 in goverment regulation no. 24 in 1997’s was not adequate because the periode of 5 years could be refuted and the canceling of land right by the court given technical guidelines to the land officials to cancel it administratively. The goverment were expected to guarantee the law legal of the owner land right that listed on register that coorporated with BPN (National Land Affairs Agency).Keyword : land rights certificate, legal certainty, Goverment Regulation No. 24 in 1997

Abstract

ABSTRACT In terms of Indonesian (National) law, the existence of National Sharia Arbitration Board (BASYARNAS) as an Islamic arbitration institution has a very strong legitimacy because the current positive law enables an institution outside the judiciary to become a referee / judge in dispute settlement the parties. This can be seen in Law No. 4 of 2004 Article 3 paragraph 1 on the principal of judicial power and Law No. 30.In 1999 on Arbitration and Alternative dispute resolution of the parties. Indonesian National Arbitrage Agency. Both have the same authority to settle civil disputes by way of peace, but BASYARNAS in exercising its authority is guided by Al Quran and Al Hadist.BASYARNAS has the authority to resolve the business dispute of the parties in accordance with the BASYARNAS procedure rules in the case of handling disputes arising in the trade, industrial, financial, service, etc where the parties agree to submit the settlement to BASYARNAS. But BASYARNAS is not authorized to resolve disputes such as inheritance, grants, divorces etc. in that it is the authority of the Religious Courts.

Abstract

ABSTRACT       In the case of validity of a treaty, the absolute requirement that must exist in the power of attorney agreement is the agreement of the parties to enter into a power of attorney agreement, in this case the role of the Notary in performing his / her duty is obliged to provide complete and clear illumination of the consequences the law of each agreement made, and in terms of providing services and services to the parties as far as possible to avoid the occurrence of disputes in the future in order to create a legal certainty, especially in the field of land in accordance with applicable government regulations.The absolute power is what is meant in the Second Dictum of a of the Instruction of the Minister of Home Affairs Number 14 of 1982 namely:   "The Absolute Power which in the First Dictum is a power which in it contains an irrevocable element by the authorizer".        The absolute prohibition of power contained in the Instruction of the Minister of Home Affairs Number 14 of 1982 concerning the Prohibition of the Absolute Use of Proxy of the Marketer of Land Rights, where it is a power which in it contains irrevocable elements and essentially the transfer of rights to the land which gives authority to the authorized party to control and use the land and to perform any legal act which according to law can only be done by the right holder.Absolute power is what is meant in the Second Dictum of the Instruction of the Minister of Home Affairs No. 14 of 1982 namely: "The Absolute Power in the First Dictum is a force in which it contains elements that can not be annulled by the authority".         The absolute prohibition of power contained in the Instruction of the Minister of Home Affairs Number 14 of 1982 concerning the Prohibition of the Use of a Power of Attorney for Marketers of Rights to Land, which constitutes a force which contains irrevocable elements and is essentially a transfer of rights on land authorizing the authorities to control and use the land and take legal action which by law can only be done by the rights holder.  Keywords: Absolute Power, Land Rights Transfer

AbstractThe province of East Kalimantan, especially the city of Samarinda has a lot of abundant natural resources potential, so the development of this city depends on the exploitation of natural resources, although every year the government seeks to change the consumptive behavior of regional development, from the use and exploitation of natural resource exploitation to become the center of service industry and tourism area, so that Samarinda City does not depend on the exploitation of natural resources Sub Sector of Coal Mining in the original revenue area for regional development.Environment Department of Samarinda City to be more active in constructing constructive communication to the Samarinda City Community, through making public complaint post, socialization to the community, and providing information about the living environment adequate, because in performing its duties and functions Environment Department of Samarinda City is in desperate need community participation so that the community plays an active role in environmental management.

Abstract

ABSTRACT The technical execution of the ex-wife's right to the salary of her ex-husband, the division of salary if the divorce occurs because the will of the Civil Servant of man then his salary is divided as follows: If no child, then ½ for the Civil Servant concerned; For ½ part wife; If having children and children join the Civil Servant concerned, then 2/3 for the Civil Servant concerned and his / her child and 1/3 for the wife. The legal consequences of divorce are as follows: At the level of talaq ba'in, a divorce has entered the three talaq level in which the married couple is forbidden to reconcile before his ex-wife first marries another then the person divorces him. Divorce due to li'an, then marriage can no longer be done forever. Collective property is shared between husband and wife while the cost of maintenance and education is the responsibility of the father. The more entitled to take care of his children is his mother, as long as the mother is married to someone else.

Abstract

ABSTRACT The rapid development of information and tecnology  today and trigger the occurrence of criminal acts, inculding criminal acts of obscenity. Obscenity undertaken by minors is a very discriminating phenomenon, because the effects of susch immorality actions can lead to individual priblematics for the continuity and future development of children. The process of handling children with the category of obscenity can couse problems because they must be hendled legally the use of criminal justice system is considered the from of response to kriminal countermeasures and the from criminal law enforcement efforst. The results of this study show about how the regulation and legal protection for children  under the age of perpetrators of crime of fornication and how the procedure of the implemntation of criminal justice of children committing crime of fornications according to law No. 35 of 2014 on the amandement of law No. 23 of2012. Key Words: Child Protection, lewd

Abstract

ABSTRAKAnak sebagai pelaku tindak pidana harus diperlakukan secara manusiawi untuk kepentingan terbaik bagi anak untuk mewujudkan pertumbuhan dan memberikan perkembangan fisik, mental dan social. Negara dan Undang - Undang wajib memberikan perlindungan hukum yang berlandaskan hak - hak anak, sehingga diperlukan pemidanaan edukatif terhadap anak.System pemidanaan edukatif terhadap anak pelaku tindak pidana harus dilandasi perlindungan hukum. Indonesia memiliki aturan untuk melindungi, mensejahterakan dan memenuhi hak - hak berdasarkan Undang - Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Anak dan Undang - Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak.Diversi dan konsep restorative justice perlu menjadi bahan pertimbangan dalam penanganan kasus anak. Konsep ini melibatkan semua pihak dalam rangka untuk perbaikan moral anak. Menempatkan anak pada penjara menjadi pilihan terakhir dan dengan jangka waktu yang sesingkat mungkin. Menempatkan anak pada lembaga - lembaga yang mempunyai manfaat dan fungsi social serta perbaikan bagi anak, namun lembaga - lembaga tersebut dapat memberikan perawatan, perlindungan, pendidikan, dan keterampilan khusus yang bersifat mendidik sehingga dapat berguna dengan tujuan membantu mereka memainkan peran - peran yang secara social konstruktif dan produktif dimasyarakat.
