The problem of research is how the legal provisions breach agreement, the implementation of competition law to businesses which violate the agreement. Abstract

AbstractThe Law No 30 of 1999 on Arbitration and Alternative Dispute Resolution contains provisions primarily on domestic arbitration. The provisions on international arbitration is scarce: it contains only 5 (five) articles which mostly regulate the international arbitration awards. Abstract

The demand for changes in law sector (political law), particularly in maritime and fishery sector, have the consequences of changes to happen. Thus, can be observed for the last 24 years (1985-2014) and has been changed twice, respectively, Law Number 9 of 1985 on Fishery, Law Number 31 of 2004 on Fishery and Law Number 45 of 2009 on Fishery. The changes shows that laws are made to suit society needs and social development, based on theories and law changer aspect. Fishery crime in Indonesia’s territory are dominated by IUU fishing (Illegal, Unreported and Unregulated Fishing). The even rising number of illegal fishing crime that caused financial less to Indonesia has made the government to produce law instruments outside of laws concerning fishery in order for enforcement of law and justice. Keywords : political law, law enforcement, and illegal fishing

Abstract

Abstract The implementation of rehabilitation on underage narcotics users based on state regulation of narcotics, an addicts narcotics users is obliged to take a rehabilitation process, but this policy has never been applied, most of the underage narcotics users were sentenced to be put in jail than taking rehabilitation. The formulation of the problem in this thesis is: why is the implementation of rehabilitation on underage narcotics users so low. What is the problem with implementing rehabilitation on underage narcotics users? What do the police at Polda Lampung do on underage narcotics users? The result of the research show that the implementation of rehabilitation on underage narcotics users is not in line with state regulations, they are government policy, policy of health minister on technical regulation on medical rehabilitation for the drugs addicts, drugs users, and victim of drugs users, which stated that the underage narcotics users is supposed to be put in rehabilitation but this rule has never been applied on, most of the underage narcotics users were put in jail than on rehabilitation. The problem on rehabilitation is affected by some factors like law structure of Direktorat Narkoba Polda Lampung on the implementation of rehabilitation is not optimal, law culture on the level of obedience of the society about the law is not optimal, and the effort of Kepolisian Daerah Lampung in solving the underage narcotics users is through preemptive, preventive, and repressive way. Keywords: Rehabilitation, Under Age, NarcoticsAbstrak Pelaksanaan rehabilitasi pengguna narkotika di bawah umur berdasarkan peraturan negara narkotika, pengguna pecandu narkotika wajib mengambil proses rehabilitasi, tetapi kebijakan ini belum pernah diterapkan, sebagian besar narkotika di bawah umur pengguna dihukum untuk diletakkan di penjara daripada mengambil rehabilitasi. Rumusan masalah dalam skripsi ini adalah: mengapa pelaksanaan rehabilitasi pada narkotika pengguna di bawah umur sangat rendah. Apa masalah dengan melaksanakan rehabilitasi pada pengguna narkotika di bawah umur? Apa yang polisi di Polda Lampung lakukan pada pengguna narkotika di bawah umur? Hasil penelitian menunjukkan bahwa pelaksanaan rehabilitasi pada pengguna narkotika di bawah umur tidak sejalan dengan peraturan negara, mereka kebijakan pemerintah, kebijakan menteri kesehatan pada regulasi teknis rehabilitasi medis untuk pecandu obat, pengguna narkoba, dan korban narkoba pengguna, yang menyatakan bahwa pengguna narkotika di bawah umur seharusnya dimasukkan ke dalam rehabilitasi tapi aturan ini belum pernah diterapkan pada, sebagian besar pengguna narkotika di bawah umur yang dimasukkan ke dalam penjara dari pada rehabilitasi. Masalah rehabilitasi dipengaruhi oleh beberapa faktor seperti struktur hukum Direktorat Narkoba Polda Lampung pada pelaksanaan rehabilitasi tidak optimal, budaya hukum pada tingkat kepatuhan masyarakat tentang hukum tidak optimal, dan upaya Kepolisian Daerah Lampung dalam memecahkan pengguna narkotika di bawah umur adalah melalui cara preemptive, preventif, dan represif. Abstract

Indonesia is a nation that has a philosophy of Pancasila, therefore, any values in the principles of Pancasila should be applied in the life of the nation. As principles number 4th Pancasila mention "Populist-led by the inner wisdom consultative / representative". Means, which put forward the principle of deliberation and consensus through its representatives and representative agencies in fighting the people's mandate. This view provides the justification that democracy in this republic run through election mechanism. Abstract

The Circulars letter of deputy attorney of general for special crimes number: B-113/F/ Fd.1/05/2010 can be used as a reference by prosecutors in doing law enforcement against corruption with small losses, but in practice law enforcement, this circular letter is making trouble in practice. The results of this research, namely: the law enforcement against corruption with a small loss of state must pay attention to the values of justice, expediency, and legal certainty. In enforcing the law against corruption with small losses only can be stopped during an investigation by utilizing the exchequer and redress demanded. the reason corruption cases with small losses were still continued by the prosecutor to the court proceedings after enactment of circulator letter because circulator letter contrary to corruption constitution and it has no the strength or binding in legal basis. The Suggestions are addressed for law enforcement officials (police, prosecutor, and judge) in order to do the law enforcement against corruption with small losses in order consider the value of a legal basis, namely: fairness, expediency and certainty. Abstract

The authority PT. Pelabuhan Indonesia II (Persero) Cabang Panjang in land management Ports after enactment Law Number 17 of 2008 on Shipping have experienced changes. Where the scope of portland management includes the formulation of Port Master Plan, the provision of portland, port monitoring land use, and exploitation of the portland. The results showed that the scope of authority land management port is a portland concession. it relates to the status of PT. Pelabuhan Indonesia II (Persero) Cabang Panjang as a Badan Usaha Pelabuhan(BUP) which has the function of a role as a port operator. As for the formulation of the Port Master Plan, the provision of portland, port monitoring land use under the authority of the Port Authority which has the function of a role as a regulator. In a land concession pass port, PT. Pelabuhan Indonesia II (Persero) Cabang Panjang is not included in the Port Enterprises whose business activities can run only after getting the concession of the port authority. Because granting concessions only to Port Business Entities are new. Abstract

The presence of foreigners in the area of Lampung is increasing rapidly. But most foreigners are missing or doing activities that are inconsistent with the purpose of providing immigration permit. Results of research and discussion show that law enforcement criminal act of abuse of a residence permits the immigration done by administrative measures and actions pro-justice immigration. Obstacles to the enforcement of the law against the crime of abuse of a residence permit immigration because the number of immigration officers who conduct surveillance and monitoring of the presence of foreigners is still lacking, a lack of coordination and cooperation across sectors, the lack of investigators Immigration master a foreign language other than English, the limited number of facilities operational support and Lampung people that are non-cooperative which reports or complaints from the public about the existence or activities of foreigners who are nearby are very limited. Suggestions from this study are the immigration officers should increase oversight of the existence and activities of foreigners. Pro-justice in law enforcement actions should be effected, in order to ensure a deterrent effect to the perpetrators and other foreigners so as not committing a crime similar immigration. Abstract Electoral system is one of the factors that affect the development of democracy and political state. It is need to get the attention of people who want improvement democracy. The electoral system, especially in implementation of house of representative election, it becomes a study that need attention given during the general election of house of representative (DPR) members eleven times from some period of democracy is different, it cannot fully realize the elections are truly ideal for the development of democracy and resulted in the representatives of the people and reflecting the aspirations properly represent the people's interests. Electoral Systems Member house of representative applied to the Election Period Old Order Period until Election Reform Order, both the closed proportional system and open proportional system and the rest of the votes, in principle have a weakness at the same advantages. Sistem pemilu, khususnya dalam penyelenggaraan pemilu anggota DPR, menjadi kajian yang perlu mendapat perhatian mengingat selama penyelenggaraan pemilihan umum anggota DPR sebanyak 11 (sebelas) kali dari beberapa masa demokrasi yang berbeda-beda, belum sepenuhnya dapat mewujudkan pemilu yang benar-benar ideal bagi perkembangan demokrasi dan menghasilkan wakil-wakil rakyat yang aspiratif dan benar-benar mewakili kepentingan rakyat. Sistem Pemilihan Umum Anggota DPR yang diterapkan pada Pemilu Masa Orde Lama sampai dengan Pemilu Masa Orde Reformasi, baik sistem proporsional tertutup maupun sistem proporsional terbuka dan sisa suara terbanyak, pada prinsipnya memiliki kelemahan sekaligus kelebihan. Abstract

Abstract an auction object the formal use of mortgage online in KPKNL arranged in Article 54 paragraph (3) Minister of Finance Regulation Number 106/PMK.06/2013 that the supply of indirect in writing can be done via email or the internet. The auction the object a mortgage via email done through the application of auction email (ALE), both in terms of registration prospective bidders and documents should be equipped with the determination of the winning bidder performed on these applications. Legal certainty in this case that is at the time of the registration process bidders up to set the winning bidder through ALE. This strengthens with the Law Number 11 of 2008 on information and electronic transaction, where Article 5 paragraph (1) described that information electronically and/or document electronic and/or result print is a legal evidence legitimate. The principle of legal certainty of the opinion that an auction had been conducted by KPKNL for the legal protection to parties concerned to an auction. Lelang objek hipotek melalui email dilakukan melalui penerapan email lelang (ALE), baik dari segi pendaftaran calon peserta lelang dan dokumen harus dilengkapi untuk penentuan pemenang lelang dilakukan pada aplikasi ini. Kepastian hukum dalam hal ini yaitu pada saat bidder proses pendaftaran hingga mengatur pemenang tender melalui ALE. Ini telah memperkuat dengan Undang-Undang Nomor 11 Tahun 2008 tentang informasi dan transaksi elektronik, di mana Pasal 5 ayat (1) dijelaskan informasi yang elektronik dan/atau dokumen elektronik dan/atau hasil cetak adalah bukti hukum yang sah. Prinsip kepastian hukum berpendapat bahwa lelang telah dilakukan oleh KPKNL untuk perlindungan hukum kepada pihak yang berkepentingan untuk lelang. Hal ini sesuai dengan undang-undang hak dijelaskan bahwa ketika debitur cedera janji, pemegang hipotek atas kekuatan sendiri memiliki hak untuk menjual melalui lelang umum. Menerapkan lelang dibuat risalah lelang oleh pejabat lelang adalah sertifikat otentik sesuai dengan Pasal 1867 dan 1868 Kitab UndangUndang Hukum Perdata. Risalah lelang digunakan penjual/pemilik barang, pembeli dan pejabat lelang untuk mempertahankan dan melaksanakan hak dan kewajiban mereka dan memiliki kekuatan yang sempurna sesuai dengan Pasal 1 Menteri 32 Keuangan Nomor 106/PMK.06/2013.
