Abstract

Article 44 of the Penal Order stipulates that it is not punishable for anyone acting in a state of disficed or impaired soul due to a disease. Article 44 of the Criminal War clearly mentions one of the possible restrictions on a person's ability to account for his or her actions before the law. The research methods used in this study are normative approaches and empirical approaches. The data sources in this study consist of primary data and secondary data. The problem is, in the process of investigating the perpetrator of a crime suspected of having a psychiatric disorder and whether the legal consequences arising from the investigation of a criminal suspected of having a psychiatric disorder. The results of this study show that the investigation of suspected criminals with psychiatric disorders in accordance with sop investigations ranging from summons, arrest, detention, seizure, examination, requesting forensic expert information, shooting suspects and submiting case files to the court. As a result of the law that arises from the investigation of the perpetrator of the alleged criminal disorder based on the expert's description in this case forensic experts through psychological examination of the psychological condition of the perpetrator which from the results of Visum et Repertum Psychiatricum states that the suspect is in a healthy condition of his soul and continues the investigation process.

Abstract

Abstract The implementation of rehabilitation on underage narcotics users based on state regulation of narcotics, an addicts narcotics users is obliged to take a rehabilitation process, but this policy has never been applied, most of the underage narcotics users were sentenced to be put in jail than taking rehabilitation. The formulation of the problem in this thesis is: why is the implementation of rehabilitation on underage narcotics users so low. What is the problem with implementing rehabilitation on underage narcotics users? What do the police at Polda Lampung do on underage narcotics users? The result of the research show that the implementation of rehabilitation on underage narcotics users is not in line with state regulations, they are government policy, policy of health minister on technical regulation on medical rehabilitation for the drugs addicts, drugs users, and victim of drugs users, which stated that the underage narcotics users is supposed to be put in rehabilitation but this rule has never been applied on, most of the underage narcotics users were put in jail than on rehabilitation. The problem on rehabilitation is affected by some factors like law structure of Direktorat Narkoba Polda Lampung on the implementation of rehabilitation is not optimal, law culture on the level of obedience of the society about the law is not optimal, and the effort of Kepolisian Daerah Lampung in solving the underage narcotics users is through preemptive, preventive, and repressive way. Keywords: Rehabilitation, Under Age, NarcoticsAbstrak Pelaksanaan rehabilitasi pengguna narkotika di bawah umur berdasarkan peraturan negara narkotika, pengguna pecandu narkotika wajib mengambil proses rehabilitasi, tetapi kebijakan ini belum pernah diterapkan, sebagian besar narkotika di bawah umur pengguna dihukum untuk diletakkan di penjara daripada mengambil rehabilitasi. Rumusan masalah dalam skripsi ini adalah: mengapa pelaksanaan rehabilitasi pada narkotika pengguna di bawah umur sangat rendah. Apa masalah dengan melaksanakan rehabilitasi pada pengguna narkotika di bawah umur? Apa yang polisi di Polda Lampung lakukan pada pengguna narkotika di bawah umur? Hasil penelitian menunjukkan bahwa pelaksanaan rehabilitasi pada pengguna narkotika di bawah umur tidak sejalan dengan peraturan negara, mereka kebijakan pemerintah, kebijakan menteri kesehatan pada regulasi teknis rehabilitasi medis untuk pecandu obat, pengguna narkoba, dan korban narkoba pengguna, yang menyatakan bahwa pengguna narkotika di bawah umur seharusnya dimasukkan ke dalam rehabilitasi tapi aturan ini belum pernah diterapkan pada, sebagian besar pengguna narkotika di bawah umur yang dimasukkan ke dalam penjara dari pada rehabilitasi. Masalah rehabilitasi dipengaruhi oleh beberapa faktor seperti struktur hukum Direktorat Narkoba Polda Lampung pada pelaksanaan rehabilitasi tidak optimal, budaya hukum pada tingkat kepatuhan masyarakat tentang hukum tidak optimal, dan upaya Kepolisian Daerah Lampung dalam memecahkan pengguna narkotika di bawah umur adalah melalui cara preemptive, preventif, dan represif. Abstract

The assimilation of prisoners must meet certain conditions first which are not regulated in the Correctional Law based on article 14 paragraph (2) which reads that the provisions regarding the requirements and procedures for the implementation of the rights of prisoners as referred to in paragraph (1) shall be further regulated by regulation. The government. The problem in this research is how the assimilation of prisoners in the Class IIa Correctional Institution in Kotabumi is carried out and how is the responsibility of prisoners who receive assimilation. The approach used in this study is an empirical approach, which is an approach that is carried out by conducting direct research to collect all information related to this research, either by interviewing related parties, or by careful observation of the object of research. Based on the results of the study, it can be seen that the Implementation of Prisoners' Assimilation at the Class IIa Penitentiary in Kotabumi, the implementation of an assimilation program for prisoners is needed, looking at Article 7 of the Universal. The implementation of the assimilation program at the Class II a Kotabumi Penitentiary has been running according to applicable procedures and is legal according to law, and from several assimilation theories and the responsibility of prisoners who receive assimilation. According to Article 1 point 4 of the Correctional Law, the role of the Correctional Institution is responsible for all existing prisoner assimilation programs, both in terms of supervision, data collection, and social sanctions carried out by assimilation prisoners who act again within the community itself. The author's suggestion is to carry out assimilation with third parties, this is more effectively done than only in the prison environment. Prisoners who assimilate with third parties will meet more with the community, in contrast to assimilation in the prison environment which only meets visitors and the surrounding community. Assimilation with third parties can be done in Islamic boarding schools, to deepen religious knowledge.

Abstract

This study discusses the JURIDIC ANALYSIS OF CRIMINAL ACTS ARTICLE 372 of the Criminal Code (study of Decision No.55/Pid.B/2019/PN.Kbu), Methodology has many meanings, such as (a) the logic of scientific research, (b) the study of scientific processes and concepts. , and 9c) science and processes and procedures. Based on this, it can be interpreted that science is a simple tool in improving science and technology as well as art. Therefore, the research aims to present the facts in a systematic, methodological and consistent manner. Based on the description in the previous article, it can be concluded: a. the application of unlawful materials for the combination of embezzlement violations, serial number 55/Pid.B/2019/PN.Kbu in the author's opinion is correct and in accordance with the law. , both testified about the terms and conditions of the accused. And the judge upheld the claim that the defendant had been jointly charged with being a defendant and was threatened with punishment under Article 372 of the Criminal Code, a statement of Article 55.1 of the Criminal Code.

Abstract

Usaha Mikro Kecil dan Menengah (UMKM) merupakan salah satu bagian terpenting dalam perkembangan ekonomi di negara kita. Tidak hanya itu, Usaha Mikro Kecil dan Menengah (UMKM) juga membantu pemerintah dalam mengurangi tingkat pengangguran dan kemiskinan. Perkembangan Usaha Mikro Kecil dan Menengah (UMKM) di Kabupaten Lampung Utara khususnya di Desa Abung Jayo Kecamatan Abung Selatan sangat minim, dikarenakan jumlah tenaga kerja UMKM setiap tahunnya tidak ada peningkatan, jumlah pelanggan kurang meningkat dan jumlah penjualan pun kurang meningkat. Melihat pengalaman, keberadaan usaha kecil dan menengah dapat diandalkan sebagai penggerak pertumbuhan dan pembangunan ekonomi, serta dapat bertahan dimasa sulit (krisis) yang sekarang tengah kita hadapi bersama. Tujuan penelitian ini adalah menganalisis pengaruh jiwa wirausaha dan manajemen pemasaran terhadap keberhasilan usaha para wirausaha di lingkungan Agrowisata Lembah Bambu Kuning Desa Abung Jaya Kecamatan Abung Selatan Kabupaten Lampung Utara. Metode penelitian ini adalah eksplanasi (Explanatory Research), penelitian ini mencari hubungan dan pengaruh dari dua variabel, yaitu antara variabel jiwa wirausaha dan variabel manajemen usaha dengan variabel keberhasilan usaha. Hasil penelitian yang didapat adalah bahwa variabel jiwa wirausaha (X1) dan manajemen pemasaran (X2) secara parsial dan simultan berpengaruh negatif dan signifikan terhadap keberhasilan usaha para pelaku Usaha Mikro Kecil dan Menengah (UMKM) di Agrowisata Lembah Bambu Kuning Desa Abung Jaya Kecamatan Abung Selatan Kabupaten Lampung Utara dengan demikian hipotesis pertama dan kedua yang diajukan tidak terbukti. Abstract

The purpose of this paper is to compare the reasonableness of insurance for children as victims of sexual violations as directed in Act Number 35/2014 on the Revision of Act Number 23/2002 on Youngster Insurance to the treatment of child victims of sexual mistreatment with a therapeutic equity approach as set forth in Act Number 11/2012 on the Adolescent Criminal Equity Framework. This paper is based on the regularization of legal examination. The findings of the investigation show that the protection of children as victims of sexual savagery in Article 71D of Act Number 35/2014 on the Correction of Act Number 23/2002 on Child Security does not completely mirror the treatment with therapeutic equity approach.

Abstract

One of the Bank's services is the launch of an ATM card (Automated Teller Machine). Literally ATM can be interpreted as an automatic cash register or often called an Automated Teller Machine which means an automatic cash register without a person, placed inside or outside the bank's yard that can issue cash and handle routine banking transactions, such as depositing, withdrawing money, transfer between accounts, settlement or payment of credit card bills. However, at this time many ATM facilities provided by the Bank have been misused by criminals to commit crimes, one of which is the wedge trick mode, this wedge trick is an ATM card entered by a customer who is inserted into this ATM can enter but will be difficult to get out. as if the ATM card was swallowed by the machine even though it was only stuck, this crime with the jamming mode can be classified as a criminal act of theft by violating the provisions of Article 363 of the Criminal Code. The problem approach in this study uses a normative approach, which is done by approaching the problem from a legal perspective, discussing and then reviewing books, statutory provisions and those related to the problems to be discussed. The results of the study concluded that efforts to overcome the crime of theft of the Automated Teller Machine (ATM) block mode by the West Lampung Police are through penal efforts (criminal law) and non-penal efforts (not / outside of criminal law), in addition to efforts made by the Police West Lampung in this response is carried out by increasing the activity of raids, patrols and guarding, but only when a crime occurs, does not involve the surrounding community and parties from the Bank and there is no cooperation with other parties and the West Lampung Police officers are inconsistent in carrying out operations/patrols. to prevent the most likely crime of theft by breaking into Automated Teller Machines (ATM). The inhibiting factors are internal factors and external factors, where internal factors include law enforcement itself. The imbalance of the rules used makes these crimes still increase from year to year. External factors include the lack of care and awareness from the public who do not report to the police. In addition to other inhibiting factors, namely the law that regulates it, law enforcement officers and legal culture factors.

hak-hak konstitusional pekerja dapat dilindungi dari tindakan pengabaian dan pelanggaran. Sebab pemberi kerja senangtiasa berada di atas kaum pekerja di dalam lapangan social ekonomi. Perlindungan dan Pelayanan Ketenagakerjan haruslah berorientasi pada kepuasan masyarakat meliputi kesederhanaan prosedur, Kepastian waktu, kejelasan persyratan, keamanan, akurasi, bertanggung jawab, disiplin, kemudahan akses, ramah dan lingkungan yang nyaman. Penelitian ini menggunakan pendekatan hukum normative, yang sumber datanya didapatkan dari data sekunder terdiri dari hukum primer seperti norma atau kaidah dasar sedangkan bahan hukum sekunder seperti buku-buku, hasil penelitian serta doktrin pakar hukum. Bahwa Hak Konstitusional para pekerja tertulis pada Pasal 28D ayat (2) “Setiap orang berhak untuk bekerja serta mendapat imbalan dan perlakuan yang adil dan layak dalam hubungan kerja”. Ditambah pelaksanaan Pelayanan publik merupakan hak sosial dasar masyarakat tetapi dalam kenyataan masih banyak hambatan atau penyimpangan, terjadinya penyimpangan-penyimpangan dan kasus-kasus maladministrasi yang seharusnya harus berlandaskan pada pelayanan prima dengan prinsip makin cepat, makin sederhana, aktual, makin baik dan makin murah.

the issuance of Law No. 06 of 2014 concerning Villages, villages get better attention from the central government and local governments because there is a village fund policy from the central government to finance village community development and empowerment worth hundreds of millions plus the Village Fund Allocation from the Regional Government for finance the administration of government, implementation of development, community development and empowerment of rural communities worth tens of millions. The size of the budget obtained by the village makes the election of the village head more attractive.In North Lampung, there are 141 villages that will conduct village head elections simultaneously and 463 Village Head Election Participants. In Law No. 6 of 2014 concerning villages, the administration of village government is in accordance with the characteristics, culture and local wisdom of each region. However, at the stages of village head elections, problems arise that are not in accordance with local wisdom in North Lampung, such as indications of alleged violations of money politics, persecution perpetrated by one of the candidates for village head
