Abstract

A person cannot be proven to have committed rape if one of the conditions of proof is not met. This paper aims to reveal the confusion over the non-fulfilment of a primary charge filed by the Public Prosecutor against the defendant in decision No. 17/JN/2016/MS.Mbo at the Meulaboh Syar'iyah Court, and what the scope and proof must certainly be met. This research uses a qualitative method with a type of case study research. Based on the results of this study, it shows interesting facts where a judge rejected the primary charges of the public prosecutor because the evidence could not support the defendant had committed jarimah (offenses against the law) rape. The evidence is in addition to the testimony of witnesses who did not directly see the incident as well as written reports in the form of visum et repertum results in Islamic criminal law referred to as qari ̅nah. In this paper, it will be discovered that the post-mortem or qari ̅nah is part of the judge's ijtihad (effort), and its existence has been recognized by sharia.

Abstract

This study examines the Assuro Ammaca ritual practiced at the Sawerigading tomb in Pamatata Village, Selayar Islands, from the perspective of Islamic law and local community beliefs. In various religious and cultural traditions, rituals inherited from ancestors function as moral and spiritual guidelines that shape community life. However, such practices often raise theological questions when they intersect with Islamic doctrines. This research aims to explore the meaning, process, and legal implications of Assuro Ammaca within the framework of Islamic law, and to understand how the local community perceives and maintains the ritual. This study employs a field-based qualitative research method, using observation, in-depth interviews, and documentation to collect data from community members, religious figures, and traditional leaders. The findings reveal that Assuro Ammaca at the Sawerigading tomb is understood by the community as an expression of gratitude and respect toward a spiritual entity believed to provide protection, blessings, and assistance in daily life. The ritual involves specific offerings and prayers that reflect a syncretic blend of ancestral beliefs and religious expressions. From the perspective of Islamic law, this practice raises significant theological concerns. Appealing to entities other than Allah for protection or blessings contradicts the principle of tawhid (monotheism, the oneness of Allah), the core of Islamic belief. While Islam recognizes local traditions (‘urf) as long as they do not conflict with Sharia principles, the Assuro Ammaca ritual demonstrates a deviation in matters of belief. Therefore, this practice cannot be justified within Islamic law, particularly in its theological dimension.

Abstract

Traditional gender stereotypes domesticate women, making their roles subordinated, marginalized, stigmatized, and burdened with multiple responsibilities while exposing them to violence. Early marriage often occurs before the legal age of 19 years as stipulated in Law Number 16 of 2019. This study examines the factors causing early marriage and its implications for fulfilling conjugal rights in Brangsong village during the first three years of marriage—a period prone to conflict. Using qualitative-descriptive methodology with a historical sociological approach and purposive sampling, the research involved early-married couples, parents, and village officials. The results revealed that the primary factor driving early marriage is adolescent curiosity about sexual intercourse motivated by dating relationships despite strong parental control, socialization, and religious knowledge. The implications for marital rights fulfillment belongedl into three categories: first, couples who responsibly work toward marriage goals with gender-equal roles; second, those using marriage to escape problems; and third, couples failing to achieve sakinah, mawadah, and rahmah due to gender inequality, resulting in divorce. This research demonstrates that successful marriages require deconstructing patriarchal frameworks and establishing equitable partnerships regardless of age.
