Abstract

Mas}lah}ah mursalah as a method experiencing internal problems related to designation of meaning of the character of the text that is “sketchy” as well as externally as “temptation” faced by the mujtahid thus providing excessive portion of reasons result in the law established considered to be not in line with the spirit of Shari’ah itself. One of the scholars who actively studied this field was Najm al-Di>n al-T}u>fi. Through methods of library research, some works of Najm al-Di>n al-T}u>fi had found out that, according to al- T}u>fi sources of Islamic law which is the most powerful in the hierarchy is legal nas (the text of the Qur’an and Hadith) and ijma`. If both (texts and ijma) stated the law which is in line with the meaning and spirit formulated by mas}lah}ah mursalah then no problem arise, however if there is a conflict (texts and ijma `versus mas}lah}ah mursalah), then mas}lah}ah mursalah should take precedence (priority) with takhshis way (specialized meaning of one of them) and bayân (explaining the meaning of one of them), not by denying or neglecting it at all. As occurs in as-Sunna, a source of law can take precedence over the Qur’an using bayân method. It happened because mas}lah}ah (benefit) is the ultimate goal of the application of Islamic rules’ against mukallaf, while the other sources of law in Islam is the means by which to understand the purpose.

Abstract

Qibla is the compulsory direction for a Muslim to face when praying. However, due to the distance and different places, it often raises the issues of Qibla direction, among which is the issue of accuracy of Qiblah direction actually facing Baitullah al-Haram, including the direction of Qibla mosque in the city of Mataram. With the help of science and technology, particularly science of Falak, the Kaaba as the Qiblah direction can be detected accurately by using careful calculation and measurement which fits well with the principles of science of Falak. Based on the descriptive-analytical study, the qualitative design, it was found out that almost 90% of mosques taken as the sample shows that the direction of mosques in Mataram is in the direction of the Qibla, althought some are not accurate, it still within acceptable limits, i.e. below five degrees difference. Yet remeasurement is still necessary to increase the accuracy and reliabilility, according to the method of measurement and calculation of the direction of the Qibla in Science of Falak.

Abstract

The notion of a sentence requires criminal sanctions are expected to be more effective to prevent the perpetrators from recommitting their actions. Therefore, there is a need for expansion of textual interpretation of the Koran and al-Hadith when in contact with local values and culture containing the same spirit, including the Book of Qanun Melaka, to achieve a sense of security and welfare. This research was conducted to examine some of the provisions contained in the book of Qanun Melaka, especially with regard to criminal law (jina>ya>t). These articles are related to punishment for crimes such as burglary, robbery, violence, and adultery. This research is a library research by examining the Book of Qanun Melaka as the primary data source. The secondary data sources were taken from variety of literature that examines Islamic law from a variety of schools thoughts. The structure of the book of Qanun Melaka illustrates the acceptance of Islamic law and the development of the Malay Islamic legal thought. Adoptation and selection of substance of customary law and Islamic law is one style of Qanun Melaka in realizing Melaka royal authority and the welfare of the Melaka community.

Abstract

The problem of declining purchasing power of the currency after inflation, has a negative effect on people’s lives, in terms of economic, social, and political. As a result, there will be inequity in the pending debt payments. Parties who have money will lose some wealth due to the loss of purchasing power of the money they had. On the other hand, Islamic concepts provide a solution to the problem, but it has not been widely studied. To explore this issue, the method used is descriptive normative i.e. by doing a search of the literature related to the issue of monetary economics literature both Islamic and conventional economics. The results showed that Islam has several appropriate methods to use in making payment to realize justice and avoid harm between the parties who make transaction and can prevent bad influences of inflation. Several methods can be used to avoid a decline in the value of money due to inflation, such as adjusting the value of money to the value of gold and silver, adjusting debt with fixed-value currency, doing indexation, avoiding ih}tika>r practices and restore the monetary system to a standard system of gold and silver.

Abstract

Thought Jurisprudence of Tuan Guru Bengkel which was built in locality-based fiqh in the worship and muamalah has raised controversy. Through the library research on these thoughts, reinforced by interviews, content analysis, and external and internal criticism, the following results were obtained: first, local jurisprudence thought of Tuan Guru Bengkel was the response to the social dynamics of the Sasak people of Lombok at the time. The concept of how propaganda was taught by the Prophet Muhammad’s kha>tib alna> s hasba ‘uqu>lihim had been practiced by Tuan Guru Benkel; second, the process of tafhi>m al-ummah by Tuan Guru Bengkel in the areas of worship and muamalah was based on strong arguments to adopt the Sha>fi’iy school of thought which, although not binding on anyone to adopt other school of thoughts on conditions that they know the details of their argument. His consistency in following the school of thought indicated his fat}anah to provide the firm attitude of the Sasak people of Lombok at that time in order to arrive at the stability of heart in worship and muamalah. His adaptive and contextual propagation made him as one of the pioneers of Islamic revival and renewal in Lombok.

Abstract

Jihad in Islam is understood in various ways by Muslims, including the Salafi Congregation. The group is seen as a group that understands the concept of jihad literally, so it is assumed to have a relationship with the idea of radicalism in Indonesia. To explore this problem, library research is used with content analysis approach. The results showed that in giving interpretations of jihad, Salafi applied textual interpretation, i.e. according to the meaning of the text. Therefore, jihad for the Salafi is divided into jihad t}alab and jihad difa’. In the case of jihad thalab (attack), Salafi’s attitude is divided into two: Salafi Yamani who hold the view that jihad is not necessary t}alab (attack) not even be in the way of bombing. As for Salafi Jihadists, the war is still going on against “enemies of Islam”, then any way to do is permitted including terror. On the other hand, jihad difa’ is defensive when attacked by another group.

Abstract

Islam revealed its characteristics as a religion that defenses against the elements of humanity. Historically, the values were applied in life since the beginning of the existence of Islam in this earth. Equality before the law, protection of society from tyranny, and protection guarantee of basic rights, are some scratches of uncontested history, from the Prophet Muhammad’s prophetic treatise that concerns with the existence of these human values. Disclosure of this fact was done through historical studies, with emphasis on the sources of the documents (relevant books), using content analysis. The results showed that the maqa>s}id al-shari’ah was a strong pillar for the necessity of implementation in life, because it was inherent to the existence of Islam as a religion and civilization, as well as experimentation of Mi>tha> q Madi> nah. But the dynamics of history and politics played its part to determine the “face” of the embodiment of universal values, which implies a social atmosphere.

Abstract

The existence and purpose of human creation comprises individual responsibility in all aspects of life. The purpose and responsibility indicated the human functions that make its existence become meaningful. This concept is already contained in the Qur’an in many verses and context, but has not been specifically revealed. This study discusses human activity as it explained in the Qur’an. The method used is the library research, where the al-Quran as the main document. In the implementation, the author focused on verses that explicitly show the conception of human deeds and accountability, more patterned on scientific thematic interpretation. Responsibility in the Qur’an is grouped in two categories: First, individual responsibility against him personally, and second, human responsibility to others and the environment (social) in which he lived. The existence of such responsibilities is as a consequence of the “freedom” of man in actualizing its potential to do good and evil
