Abstract

The following article examines the methodology and approach of Islamic Jurisprudence studies. According to the author the urgent need of the study and the develop of Islamic Law nowadays is considering not only applying normative/ theological approach but also hermeneutics approach. The characteristics of hermeneutics as approach or methodolody in Islamic studies is the text either that of holy scripture or that of anyform is cultural product, polyphonics and open to interpret by many interpreters in accordance with situation, condition, culture and historical challenge of human. Accordingly, Islamic Law thought constitutes as opened texts and closed relation to historical and cultural background where the texts produced, so fiqh should be reinterpreted, reconstructed and given new alternation in order to be able to answer the problem of law nowadays. Kata kunci: fiqh, ortodoksi, hermeneutika, dan sejarah.

Abstract

This articlewillexplainaboutcybercrime, effortsto overcome, focus, punishment andthe viewof Islami claw and positive law against cyber crime behavior. Cyber Crimeis a criminal activity using computer facilitiesor computer network without permission and against the law. According toIslamic shariathe punishment for cyber crime is ta’zirby difference method, such as imprisonment, exile, whips, and death penalty. The punishment (ta’zir) based on Islamic Law is very importance because Our country hasn’t yet aspecial regulation governing cyber crime, exceptsomepositive law generally. Abstract

Oneaspect of Islam reform is the family system from patrhiarchal to parental system.The model of reform includesthree modelsnamely: deconsruction, reconstruction and that of continuity. And the methodof deconstruction in this context comprises of two kinds totally and step by step process. This article tries to investigate the family law based on bilateralsystem and that of principle and it is expected to apply in Indonesia.Besides, it also offer the role of Islamic law as not only as a social control but also as tool of social enginering.This article also tracesthe concept of family law both the conventional fiqh and the act of marriage in Indonesia as representing the gender bias. Kata kunci: Fiqh, hukum keluarga, pembaharuan, bilateral, dan undangundang.

Abstract

The following article describes the source of ownership in Islamic law viewpoint. The basic concept of ownership in Islamic law perspective has a particular concept if it compares with that of Civil Law, Capitalism and Socialism, especially in terms of the source of ownership. The writer of the article declares that the sources of ownership in Islamic viewpoint are ihram al-megawatt, ad, khalafiyat, and tawallud min mamluk. The concept of aqd or transaction as a source of ownership in Islamic social law, muslims should develop the new kinds of aqd in accord with the free of the contract principle in Islamic law. To develop the new kinds of aqd in Islamic law is so important in the context of response the development of the modern social matters.

Abstract

The formulating of poligamy in KHI draft based on the goal of shari’ah. Departing from this, the basic principle of marriage in Islam is monogamy. Shahrur justifies poligamy as stated in Surat an-Nisa’ verse 3. This verse according to Shahrur including hududiyah, either hudud al-kamm or hududul kaif. While, according to KHI draft, it is impossible for husband to conduct the justice in term of poligamy, and then Shahrur stated that the verse of poligamy constitutes the theory of limits, either al-had al-adna or al had al-adna. Hence, poligamy permits but not more than 4 wives.

Abstract

Bank practices that practice by commercial banks can’t be free from materialistic capitalism. Those practices has made social problems that threaten human civilization. The hidden “poor” processing has been running body and spiritual. It happens because human faces materialistic business. Their dream about developing of economy can’t make true because unemployment and recession. That’s why, Economic Moslems try to formulate economy systems that keep away from negative effects to human civilization. They found mistakes from ways of thinking in modem society. Materialistic capitalism paradigm has got weakness, and serious effects -for moral crisis. It makes human is like machines that doesn’t care about his existence in social things. If they do what we call social things, of course it is not only than save his individualistic-ego. This paper tries to find those problems, and of course to give the results. It needs to other chosen about conventional bank institute that works is based on materialistic capitalism, because it is only producing social problems. It bases on histories Rosulullohs rules that managed financial system in his time, and tried to find Allah’s message in His verses. Those economist find “metafora amanah” (instruction metaphore) as its a paradigm. That’s why Islamic bank is really suitable to have more position than conventional bank. Of course It’s “metafora amanah” (instruction metaphore) can have more positive effects of ideology from Islamic economy, and it’s specially for bank system. It’s based on this system, of course, human can have balance between individual’s rule and social’s rules. By this concept, Islamic bank, by operational transactions, will have more benefits than other conventional bank. Islamic bank make clear of all transactions, more transparent, far away from exploring from one side and manipulation, and accountable. Finally, those benefits will give good effects for society, because this orientation will give good corporate and sharing.

Abstract

Langkah-langkah akomodatif negara terhadap umat Islam secara sosiologis dan politis diawali dari terintegrasinya pemikiran generasi baru Islam. Mereka mencoba mentransformasikan intelektual dan aktivitas yang dahulu bersifat legalistik formalistik menjadi lebih bersifat substansialistik, sehingga sikap semacam itu tidak antagonistik dengan konstruk negara bangsa Indonesia yang berideologi Pancasila dan Undang-Undang Dasar 1945. Kondisi ini diresponi oleh negara (pemerintah) dengan sikap akomodatif konstruktif. Baik di bidang politik, ekonomi, sosial budaya maupun keagamaan. Karena sikap umat Islam yang bersifat integratif itu telah menimbulkan kestabilan dan kemapanan sehingga memperlancar pembangunan.

Abstract

Dalam sejarah perkembangan hukum Islam pernah mengalami stagnasi perkembangannya, yang diakibatkan oleh suatu paham bahwa pintu ijtihad telah tertutup Pada masa ini masyarakat Islam hanya mengandalkan hukum Islam dari hasil pemikiran para mujtahid zaman dahulu yang jauh berbeda dengan seting sosial dan geografisnya dengan zaman sekarang. Sebagian masyarakat masih menganggap bahwa segala sesuatu yang terdapat di dalam kitab-kitab fiqih merupakan hal yang sakral dan tidak seorangpun yang berkompeten merubahnya. Dengan paham ini pula seseorang tidak diperbolehkan mengikuti pendapat madzab lain. Bahkan kecenderungan yang terjadi adalah mereka sangat sulit untuk menerima perubahan yang terjadi dalam kehidupan masyarakat sat ini.

Abstract

At first Islamic-either the Koran or the as-Sunnah are not set in concrete, about the recording of marriage. This is different from the verse muamalah that in certain situations instructed to record it. This is sometimes the legitimacy of certain circles for a wedding or marriage is not registered under the hand (Sirri). Demands of development, with a variety of benefit consideration, the Islamic law in Indonesia, set it as in the discussion of this article. Therefore, discourse is also important that the recording of marriage is a way to protect the rights of wives and children. Because Indonesias strong evidence that marriage is a marriage deed itself. Even the public also needs to be given the understanding that marriage is not listed on the side is not legal under the state also is not valid according to religion. Furthermore, from the standpoint of the State legislation, should be given criminal punishment for couples who do marry are not listed. Keywords: nikah sirri, maslahah, pembaruan, pluralisme hukum
