Abstract

This paper is a research result which discusses about the thought of Kalam Hassan Hanafi by focusing on the review of its epistemology reconstruction. This research concludes that the basic epistemology of Hassan Hanafi is not solely based on the awareness and western paradigm, but also rooted in the consciousness and traditions of Muslims themselves. This basic epistemology is then applied to reconstruct a new thought. In this case, the reconstruction gives a new meaning and name towards the terms. It is also a part of his great project that includes al-yasar al-islami, turats revitalization and Occidentalism. Further, the judgment on his theology reconstruction that changes the religious terms into mere materials makes the spiritual understanding just become a social, practical and functional agenda.

Abstract

Man and women who want to marry should consult with someone who are expert of marriage in the perspective of Islamic law. Consultation in the form of conseling, it is expected that the guidance can build the Islamic family. In addition, it can serve as a model of dakwah about marriage rules in accordance with Islam. A phenomenon that occurs in now days society, before marriage is not begin by consulting with the expert. So that when they build the household there was a commotion until divorce.

Abstract

The results of a study evaluating on how ideal and organized the management of press. Besides, management as a science and art, and management functions were discussed. Then what and how the press and journalism, the press law and ethics perspective, and the functions of the press were also described. This article concludes that the press as an organization cannot be separated by the application of management, both as a science and an art in order to achieve the objectives. Then, the existence and dynamics of the press at this time cannot be separated with the past life of the press, the press in the pre-independence as a struggle-oriented tool, press in the era of independence that slowly leads to economic and social institutions that tend to forward commercialism and neglect idealism.  Moreover, the freedom of press cannot be interpreted as freedom to carry out journalistic activities freely, but these freedoms must be subject to the law and journalistic ethics. Therefore, a good press is a press that is able to manage the balance between the demands of idealism and commercialism.

Abstract

This article is a research result that discusses the thoughts of Zakiah Daradjat about the role of Islamic education on mental health. Education in his perspective includes human life that is not only focused on the aspects of faith or morality, but much broader and deeper than it all. Understanding mental health related to the potential of men refers to the establishment of a genuine harmony between the functions of the soul and ability to deal with common problems and avoid the anxiety. Therefore, this article concludes that Zakiah’s thoughts about the role of Islamic education on mental health can guide, help and control in morality and mental disorders.

Abstract

This paper is the result of research that reviewing the factors affecting spirituality, as well as the significance of the development of spirituality and age level. The conclusion of this paper, there is a significant relationship between the development of spirituality and age level. However, in addition to the age level still found other factors that affect the level of spiritual development. The factors are: the type of personality, childhood environment and understanding of the material. Religion conversion cannot be separated with the conditions and situations experienced by a person included it ages. So that the age level that is sufficiently closely linked to the physical and spiritual growth of man.

Abstract

This research paper examines the mortgage done by Blambangan villagers in OKU Selatan. Furthermore, Islamic law regarding its practice is also discussed. It can be summarized that the mortgage there has a very low level of intensity. It is caused by three factors. First, the urgent needs of the people make the practice happen. Even if that happens, they try as hard as possible to borrow money from creditors who do not require any collateral. Second, there is a negative value for those who do the mortgage for the sake of borrowing money to meet their daily needs. Third, the creditors generally want valuable goods from the mortgage such as rubber plantations and rice fields in order that they can take advantage from the mortgaged things. Basically, the underlying principle of mortgage in Blambangan village of OKU Selatan is empowerment. However, the mortgage usually happens due to the desire to gain advantage over the troubles of others. The contract used in their mortgage is al-rohn.

Abstract

Dakwah pada hakikatnya adalah usaha orang beriman untuk mewujudkan Islam dalam semua segi kehidupan pada tataran individu, keluarga, masyarakat, umat dan bangsa. Sebagai aktualisasi iman, dakwah merupakan keharusan dan menjadi tugas suci bagi setiap muslim setingkat dengan kapasitas dan kapabilitas yang dimiliki. Dakwah merupakan salah satu bentuk komitmen muslim terhadap agamanya. Setiap muslim dan muslimat wajib mendakwahkan Islam, sesuai dengan kemampuan dan kesanggupan masing-masing, sesuai dengan profesi dan dedikasinya kepada orang lain, baik orang Islam maupun orang-orang yang tidak atau belum beragama Islam. Istilah dakwah digunakan dalam Al Qur’an baik dalam bentuk fi’il maupun dalam bentuk mashdar berjumlah lebih dari seratus kali. Dalam Al Qur’an, dakwah dalam arti mengajak ditemukan sebanyak 46 kali, 39 kali dalam arti mengajak kepada Islam dan kebaikan, 7 kali kepada neraka dan kejahatan.Beberapa dari ayat tersebut:Mengajak manusia kepada kebaikan dan mencegah kemungkaran ( QS. Ali Imran: 104); Mengajak manusia kepada jalan Allah (QS an-Nahl:125); Mengajak manusia kepada agama Islam (QS as-Shaf: 7); Mengajak manusia kepada jalan yang lurus (QS al-Mukminun:73); Memutuskan perkara dalam kehidupan umat manusia, kittabullah dan sunnaturrasul (QS an-Nur:48 dan 51, serta QS Ali Imran:23); Mengajak ke surga (QS al-Baqarah:122).This article discusses the meaning of propaganda used by the thematic approach and semantic analysis based on the perspective of the Qur'an. Quran is the basis for the study of the meaning of da'wah studied. The results showed, Da'wah is an attempt to realize the believer of Islam in all aspects of life at the level of individuals, families, communities, people and nation. As the actualization of faith, preaching the necessity and become a sacred duty for every Muslim a level with the capacity and capabilities. Da’wah is one of the commitments of the Muslim religion. Every Muslim and muslimat obliged to preach Islam, in accordance with the capability and capacity of each, according to the profession and dedication to others, both Muslims and people who are not or have not been Muslim. The term propaganda is used in the Qur'an either in form or in the form mashdar fi'il more than a hundred times. In the Qur'an, preaching in the sense of inviting found as many as 46 times, 39 times in a sense invite to Islam and kindness, 7 times to hell and evil. Several of the verse: Inviting people to goodness and forbid the (Qur'an, Ali Imran: 104); Invite the people to the way of Allah (Surah an-Nahl: 125); Invite people to Islam (Sura al-Shaf: 7); Invite the people to the straight path (al-Mukminun: 73); Judge in the life of mankind, kittabullah and sunnaturrasul (Surat an-Nur: 48 and 51, as well as Surah Ali Imran: 23); Invite to heaven (Surah al-Baqarah: 122).

Abstract

Makalah ini mengkaji tentang metode-metode penelitian dalam kajian-kajian Islam. Hal ini berlandaskan bahwa Islam tidaklah meletakan ilmu itu dalam kerangka dikotomis. Yang membedakannya adalah nilai-nilai manfaat dan maslahat. Munculnya pemikiran yang diklaim sebagai paham dikotomis ilmu agamawi dan duniawi, secara historis, tampaknya salah satu konsekuensi dari era disintegrasi. Kelanjutannya, muncul statemen bahwa ilmu yang agamawi (ilmu-ilmu agama) harus mendapat perhatian yang lebih ketimbang ilmu yang duniawi (ilmu-ilmu dunia). Kemudian, pahala ilmu agamawi dipandang lebih banyak dibanding ilmu-ilmu duniawi. Statemen dan pandangan semacam ini tentu saja tidak memiliki dasar pijakan atau dalil yang jelas. Sedangkan metode-metode penelitian dalam kajian-kajian Islam ada empat macam, yakni: metode bayani, metode burhani, metode tajribi, metode ‘irfani. This paper examined about the methods of research in Islamic studies. It was based on that Islam did not put science in a dichotomous framework. What distinguished it was the benefit values and benefit. The emergence of thought which was claimed as a dichotomous understanding of the science of religious and secular, historically, it seemed one of the consequences of the era of disintegration. The sequel, appear statement that the science of religion (religious sciences) should receive more attention than the secular science (science world). Then, the reward of religion science was seen more than secular sciences. Such statements and views certainly did not have a foundation or a clear proposition. While the methods of research in Islamic studies there were four kinds, namely: bayani method, the method Burhani, tajriibi method, the method of 'Irfani.

Abstract

Penelitian ini mengkaji tentang status anak di luar nikah perpektif hukum Islam. Pertimbangan Hukum Majelis Hakim Mahkamah Konstitusi Nomor: 46/PUU-VIII/201. Pandangan Hakim Pengadilan Agama Kelas 1A Palembang terhadap Putusan Mahkamah Konstitusi Nomor: 46/PUU-VIII/2010 adalah: Putusan uji materi pasal 43 ayat 1 UUP, sesungguhnya ditujukan untuk anak yang lahir di luar perkawinan akibat nikah sirri atau kumpul kebo. Berdasarkan penetapan pengadilan agama yang berkaitan dengan pengesahan perkawinan/itsbat nikah dan penetapan asal usul anak, maka anak yang dilahirkan dari perkawinan sirri dapat dinyatakan sebagai anak yang sah. Dengan status anak sah, maka anak tersebut mempunyai hubungan perdata dengan ayah biologisnya. Hubungan perdata yang timbul akibat dari adanya hubungan darah ini meliputi hubungan hukum, hak dan kewajiban antara anak dengan ayah dan ibunya yang dapat berupa:  (1)  hubungan  nasab;  (2)  hubungan mahram; (3) hubungan hak dan kewajiban; (4) hubungan pewarisan (saling mewarisi)  yang  merupakan  pelanjutan  hubungan  hak  dan  kewajiban karena  nasab  ketika mereka  sama-sama masih  hidup;  dan  (5)  hubungan wali nikah antara ayah dengan anak perempuannya.This paper examined the status of children outside wedlock in perspective of Islamic law. Consideration of the judges of the Constitutional Court Law No. 46 / PUU-VIII / 2010: included: the right to obtain legal status of the child; registration of marriage was not a factor in determining the legal of the marriage and registration of marriages was an administrative obligations required by legislation. The factors that determined the legal of a marriage was the conditions prescribed by the religion of each pair bride; problems concerned children born out of wedlock should receive law protection and law certainty to the status of a child born and rights available to him, including toward children born though the legal of the marriage still disputed. While the view of the religion Court Judge Class 1A Palembang to Constitutional Court Decision No. 46 / PUU-VIII / 2010: Decision of the judicial review of Article 43 paragraph 1 UUP, in fact intended for children born out of wedlock as a result of Sirri marriage or cohabiting. Based on the determination of religion courts that related to ratification of the marriage / marriage ithbat and determination of the origin of the child, then the child born of the marriage Sirri could be expressed as a legitimate child. With the status of a legitimate child, then the child had a civil relationship with biological father. Civil relations arose from the presence of this blood relationship included legal relationships, rights and obligations between the child with his/her father and mother who could be: (1) the relationship nasab; (2) the relationship of mahram; (3) the relationship of rights and obligations; (4) the relationship of inheritance (inherit each other) which was a continuation of the relationship of rights and obligations as nasab when they were both still alive; and (5) the relationship of guardians between a father with his daughter.

Abstract

Novel Khotbah Di Atas Bukit Karya Kuntowijoyo mengandung nilai-nilai etika kebahagiaan yang sama dengan Epikuros. Dimana Epikuros menghendaki untuk mencapai kebahagiaan seseorang harus mencari nikmat yang sebanyak-banyaknya dengan menghindari pertanyaan-pertanyaan, dan pikiran-pikiran yang membuat kesakitan badan dan jiwa. dengan itu Epikuros menghendaki keutamaan-keutamaan seperti kesederhanaan, tahu diri, penguasaan diri dan kebijaksanaan. Bergitu pula dalam Novel Khotbah Di Atas Bukit Karya Kuntowijoyo, dimana kuntowijoyo dalam novel khotbah di atas bukit menghendaki agar untuk bahagia seseorang harus mencari nikmat dan menghindari segala hal yang membuat kesakitan badan, sehingga jiwa menjadi resah. Dengan memperhatikan keutamaan seperti, kesederhanaan, penguasaan diri, dan kebijaksanaan. Kuntowijoyo’s novel “Khotbah Di Atas Bukit” containing ethical values of happiness in common with the Epicurean. Where Epicurean desires to achieve happiness, one must find favor as much as possible to avoid the questions and thoughts that make body and soul in the pain. With it, the Epicurean requires virtues such as modesty, knowing oneself, self-control and wisdom. Similarly, in the Kuntowijoyo’s Novel “Khotbah Di Atas Bukit”, Kuntowijoyo requires that to be happy one must seek favor and avoid pain of all the things that make the body and the soul becomes restless. Having regard to such virtues, modesty, self-control and wisdom.
