Abstract

In 1999, the Indonesian People’s Consultative Assembly enacted the First Amendment to the 1945 Constitution. Over each of the next three years, it passed a further amendment. This paper argues that the amendments lacked what have widely been accepted as key features of a democratic constitution-making process. Many of the problems related to fundamental issues within the Constitution itself. It contained two aspects seen as crucial to the identity and survival of the country by most nationalists: the rejection of an Islamic state and the imposition in its place of a nationalist state ideology, the Pancasila. This paper proposes that to resolve the difficult relationship between Islam and the state - for the immediate future at least - the preamble and Article 29 should be made as a non-amendable and ‘entrenched’. From Indonesia’s experience, beside observing the general characteristics of constitution-making process in transition, scholars should note how the symbolic value of the 1945 Constitution strongly overshadowed the way the constitutional reform took place.Keywords: Constitution, Democracy, Amendment, Reform, Indonesia.

Abstract

ASEAN countries will enter the era of free trade through the agreement of Asean Economic Community Blueprint. This agreement will open the free flow of trade in goods, services, investment, capital and skilled labor. Regarding the investment, in particularly, all countries will apply the principles of the National Treatment and Most Favoured Nation. It means that all countries will give equal treatment between foreign investors and local investors. This poses a problem for Indonesian government on policy strategies to provide protection for local investors. This paper will use the normative juridical method for the discussion. However, to complete the analysis, empirical facts will also be carried to sharpen the argument. Based on the normative analysis, the result showed that Indonesian government has taken various strategies throughout legal instruments related to the investment law. Local investor protection is conducted by providing limits to the field of businesses, investment and divestment requirements for foreign investors.Keywords : policy strategies, asean economic community, local investor protection

Abstract

The paradox of positivistic view and progressive law in the criminal law enforcement happened because there is a difference among the law enforcement officer’s view and perception.  Our law education from the beginning until now still teaches the students the positivistic view so that after the students becoming law officers in running the law they still use positive law or positivistic view. The positivistic view is often far from the substantive justice and close to the formal justice. In order to functioning the progressive law in law enforcement especially the penal code constraint of positivistic view which rooted inside of the law enforcer’s mind, therefore it is need paradigm change by fixing the law system, law education, ethics and morality of law officers , and increasing religious consciousness.Keywords: paradox, law positivism, progressive law, criminal law enforcement

Abstract

The aims of this study are to assess the regulation regarding institutional authority of local environmental management agencies and discover the strong regulation model and reflect the principles of local autonomy and ecological sustainability. The research used doctrinal legal research method by using primary legal materials and secondary legal materials and analyzed in a prescriptive-analysis. The research discover that the regulations regarding local environment management agencies are weak, due to uncertainty and lack of local authority, different nomenclature, and the absence of clear regulation on inter-institutional relations procedure. The future regulation model, the local environmental management agencies should have a broad authority, covering planning, implementation, monitoring and enforcement aspects. Duties and functions must integrate coordination and operational functions, and there is a clear relationship system encompassing both inter-institutional and inter-regional center.Key word: authority, institutional, local autonomy

Abstract

The existence of marriage law in Indonesia has involved various interests such as religion, state, and women. In this sense, Indonesia expects to have a uniform marriage law in order to reduce gap and tension among the existing legal systems, namely Civil Law (Dutch Law), Adat law and Islamic law (fiqh). The research aims to study critically the reasons behind the gap between Fiqh Munakahah and Marriage Law Act in cause of marriage under age, to find out alternative policy resolving the gap. The research is normative legal research with non-doctrine approach. Both library and field research are conducted. The research find out that the alternative policy to overcome the gap is by enforcing legal sanction in marriage law, promoting more intensive legal awareness in the society and formulating a clearer provision in the marriage law act. Particularly on minimum age for marriage, therefore society might accept the law sociologically and philosophically.Keyword: legal gap, Marriage Law Act, under age, fiqh munakahah.

Abstract

The research aims at examining the characteristics of Islamic criminal law enforcement, co-existence of Islamic justice system (sharia law) and criminal justice system, and the factors inhibiting law enforcement in the Nanggroe Aceh Darussalam (NAD) province. The method employed in this research is normative empirical using qualitative data analysis technique. The result of the research shows that certain types of crime that become the competence of the Islamic judicial is based on provincial regulations called Qanun; therefore, the criminalization that occurs do not reduce the jurisdiction of civil court. Moreover, the result of the research also shows that the various factors which theoretically are known as factors supporting law enforcement are not working properly.Key words: law enforcement, Islamic criminal law, Qanun, Islamic justice system

Abstract

Law No. 11, 2006 concerning Aceh Government determines the existence of decentralization of authority in the land sector to the Aceh Government. However, in reality, the decentralization of authority could not be accomplished.  Therefore, this research aims at studying the authorities which have been decentralized and factors that led to the failure in implementing these authorities. The data were collected through literature research and field research. The literature research was conducted by reviewing the Law No. 11, 2006 and other statutory provisions as well as the views of relevant experts. Field research was conducted by interviewing officials of technical institutions and other relevant stakeholders. The results of the research show that the authorities in the land sector that are especially decentralized to the Government of Aceh through Law No. 11, 2006 are the autorithies to grand The Right to Cultivate and The Building Rights on Land. However, these rights have not been implemented due to the inavailability of more concrete rules and local officials whose fundamental duties and functions are specifically in the land sector.Key words: decentralization, authority, the land sector

Abstract

Persoalan penataan ruang tidak bisa lepas dengan lingkungan hidup dan sumber daya alam. Ketiga komponen ini selalu berkaitan, sehingga baik di dalam UUPR maupun di dalam Perda Provinsi dan Kabupaten/Kota tentang rencana penataan ruang selalu memperhatikan lingkungan dan sumber daya alam. Kajian ini bertujuan mengetahui dan memahami konsepsi dasar perlindungan dan pengelolaan lingkungan hidup baik di dalam UUD NRI 1945 maupun di dalam peraturan perundang-undangan organiknya. Dan untuk mengetahui dan memahami tentang konsep hukum pengaturan perlindungan dan pengelolaan lingkungan hidup di dalam UUPR dan Perda-perda RTRW di Provinsi NTB. Berdasarkan hasil kajian dan analisis menunjukan bahwa konsepsi dasar perlindungan dan pengelolaan lingkungan hidup telah diatur dengan jelas di dalam UUD NRI 1945 (amandemen) dan peraturan perundang-undangan organiknya. Lingkungan hidup adalah salah satu komponen kehidupan yang selalu melekat dengan manusia, oleh karena itu harus diatur, dikelola dan dilindungi dengan baik. Sedangkan Pengaturan perlindungan dan pengelolaan lingkungan hidup baik di dalam UUPR maupun di dalam Perda-perda RTRW di Provinsi NTB sudah diatur secara jelas dan detail. Dengan demikian, pengaturan perlindungan dan pengelolaan lingkungan hidup tidak hanya terdapat di dalam UUPPLH dan peraturan pelaksanaannya, akan tetapi diatur juga di dalam UUPR dan peraturan pelakksanaannya, serta Perda-perda RTRW Provinsi dan Kabupaten/Kota se-NTB.Key Words: Perlindungan lingkungan hidup

Abstract

The role of a judge is very important in deciding corruption cases in Indonesia, if a judge is affected by external which will make him/her unobjective in deciding a corruption case, thus his/her independency is judged. According to the research results, there is difference between cases which occurred in Java Island and Sumatera Island, where there is more corruption cases in Java compared to Sumatera and the punishment is more severe than in Sumatera, apart from that there are a lot of corruption done by company leaders with the average age of 46-54 years old. This shows that a leader of the mentioned range of age tends to misuse their position and opportunities while on the other hand, judges seldom give maximum punishment to corruptorKey words: Corruption, Judged, Independency, Legal Factor, Non Legal Factor.

Abstract

The Protection of Traditional Knowledge, especially protection traditional medicine, have been an academic debate in international forum. Research is aimed to find out: firstly, living norms protecting traditional konowledge of medicine in indigenous communities; secondly, comparing practices of developing countries in regulating Traditional Knowledge; and thirdly, identifying the current applicable concept in protection Traditional knowledge. The finding of the research comprises, firstly, as a valid owner of traditional knowledge, indigenous peoples have  reseonable rights to determine legal protection based on their perpectives.  Secondly, practices of medicinal knowledge arrangement in developing countries are variable and; thirdly defensive protection concept and positive protection involves intellectual property regime (patent, trademark and geographical indication) and legal regime sui generis to be applied in traditional knowledge, especially medicinal knowledge.Key Words: Traditional Knowledge; Indigenous Peoples; Ownership; Intellectual Property, Legal Protection.
