Abstract

Perkawinan siri banyak dilakukan masyarakat sejak dahulu, yaitu perkawinan yang hanya dilakukan menurut agama Islam tanpa dilakukan pencatatan perkawinan oleh pegawai pencatat pemerintah sehingga tidak bisa dibuktikan dengan akta nikah dengan muncul beberapa dugaan tentang alasan mengapa nikah siri dengan segala resikonya masih juga dijadikan sebagai alternatif. Di kalangan masyarakat yang awam hukum dan masyarakat ekonomi lemah, bisa dimungkinkan karena keterbatasan dana sehingga dengan prosedur yang praktis tanpa dipungut biaya, pernikahan bisa dilaksanakan.Bila dilihat dari aspek agama, ada kemungkinan karena khawatir melakukan dosa dan terjebak dalam perbuatan maksiat, maka pernikahan dengan prosedur yang cepat dan dianggap sah telah memberikan ketenangan batin tersendiri. Hal tersebut agar dapat memberikan keterbatasan maka tujuan yang ada dalam mengutip dari permasalahan faktor dan masalah apa saja yang melatar belakangi terjadinya Nikah Siri, konsep perkawinan siri (tidak dicatatkan) menurut hukum Islam dan Undang-Undang Perkawinan, akibat hukum perkawinan siri terhadap kedudukan anak.Jenis penelitian yang digunakan adalah diskriptif dengan metode yuridis normatif, yaitu penelitian hukum yang dilakukan dengan menggunakan peraturan perundang-undangan. Dalam hal ini peneliti memahami konsep perkawinan siri (tidak dicatatkan) menurut Hukum Islam dan Undang-Undang Perkawinan yang terdapat di Kabupaten Karanganyar dalam masalah yang menyertai Nikah Siri.Hasil kompilasi hukum dasarnya pernikahan siri dilakukan karena ada hal-hal yang dirasa tidak memungkinkan bagi pasangan untuk menikah secara formal. Ada banyak faktor yang melatarbelakangi terjadinya pernikahan siri, yang menurut peneliti, semua alasan tersebut mengarah kepada posisi perkawinan siri dipandang sebagai jalan pintas yang lebih mudah untuk menghalalkan hubungan suami isteri akibatnya dalam pengurusan hak anak sangat sulit.Marriage series of propositions many done society for the first, namely marriage only done according to mohammedanism without done registration marriage by employees your government so that cannot be proven by marriage certificate by appearing some alleged about reasons why hymeneal series of propositions with all the risks still used as alternate.In the society of being a layman law and economic community weak, can possible because of budget constraints so by procedures that practical without free marriage can be implemented.Seeing from aspect religion, any chance for fear commit a sin and are caught in deed maksiat, and marriage by procedures that quickly and deemed valid has given inner peace cloistral.lt in order to provide so the purpose limitation existing in quoting from problems factor and matter what drive the occurrence of wedlock series of propositions, concept marriage series of propositions ( not listed) according to islamic law and laws marriage, due to matrimonial law series of propositions against the child.The kind of research used is diskriptif by method juridical normative, namely research legal conducted using the legislation. In this researcher understanding the concept marriage series of propositions ( not listed) according to islamic law and the act of mating contained in thousand karanganyar in the problem with hymeneal series of propositions.A compilation of laws essentially thewedding siri done because there are things which inflation does not allow for a couple to marry formally. There are many factors siri, melatarbelakangi the marriage according to researchers, all these reasons leads to a position marriage siri viewed as a shortcut easier to menghalalkan husband, relations wife consequently the rights of children in population is very difficult.

Abstract

The factors and reasons in Divorce Petition that can become the basis of your divorce petition in Religion Court include: “Husband makes sexual intercourse outside of marriage, is a drunker, drug abuser, gambler, and etc; he has left you for 2 (two) successive years without license or clear and right reason; it means that the husband consciously and deliberately leaves you, he is imprisoned for 5 (five) years or more after marriage, he does violence and like to treat you poorly, he cannot undertake his obligation because of his disability or disease, the incidence of ongoing dispute and quarrel without the probability of concord, the husband breaks the taklik-talak he had said during ijab-kabul, he converts leading to discordance within family.            The research method employed was descriptive one. As a prescriptive research, this current research studied legal objective, justice value, rule of law validity, legal concepts and legal norms. This descriptive research aimed to describe systematically a certain population or area. The descriptive research was intended to provide prior data as thorough as possible about human, condition or other phenomenon. The qualitative data analysis was a research method providing descriptive data in which what the respondents say in either written or spoken form and what they do actually were investigated and studied as something intact.            The legal rationales the Judge made still referred to legislation or government decision or enacted rule norms such as Law No.1 of 1974, Islamic Law Compilation (KHI), Civil Code and Herzien Inlandsch Reglement (HIR), and etc. It means that the Judge’s rationales in deciding the divorce (petitioning divorce) case considered firstly the posita and petitum existing in the petition. Then, the facts in the trial and the evidence brought into trial, either written or spoken (witness), were also taken into account. Meanwhile, non-legal rationale was made by the Judge as the attempt of confirming and clarifying the existing legislation in order to be consistent with the expectation; these rationales included usefulness, economic, time or effectiveness, and so on. Secondly, there were two perspectives on the effectiveness of petitioning divorce verdict implementation in Religion Court: society perspective and court perspective. In society perspective, a petitioning divorce verdict was considered as ineffective because it was not realized as due. It means that the wife’s rights as included in the verdict were frequently unfulfilled by the husband (former husband). Meanwhile, in Religion Court perspective, the result of verdict made and imposed to the parties was considered as effective because no report from the parties on the right or obligation denial by one party. Keywords: Petitioning Divorce Factor, Petitioning Divorce Reason, Divorce Petition.

Abstract

This study aims to know knowing because the land acquisition cash viilage Sawahan, common interests in the village sub-districts Ngemplak, district Boyolali and to know the recruitment process due to the village as a substitute for land acquisition viilage Sawahan, common interests in the village sub-districts Ngemplak, district Boyolali. This includes legal writing research empirical juridical, legal materials collection techniques by means of studies and interviews with library and using qualitative methods of analysis. Based on the research process land buying process cash village because the public interest in the village Sawahan, sub-district Ngemplak, regency Boyolali because the public interest includes several phases land acquisition was conducted in a deliberative manner to obtain an agreement between committee land acquisition with the proprietor of land. The village government Sawahan propose discharge to a 's consultative village to ask for approval from the presence of the release of the right. While the land acquisition process cash village substitute as because of land acquisition village because the public interest in the village sawahan, sub-district Ngemplak, regency Boyolali are in accordance with the presidential number 36 0f 2005 on land acquisition for the implementation of development for public interest. Abstract

The land owners to which some right inherent and each use of such the right obligatorily has the evidence of right-to land ownership called  land deed; to obtain such the deed, some registration should be passed through for the land owned to which some right inherent, in order to prevent some problems from occurring in the future.The objective of research was to study and to find out the role of Land Deed Making Official (PPAT) according to Government Regulation Number 24 of 2007 about Land Registration the writer took from Notary and PPAT Office owned by IMMAWATI USWATUN CHASANAH, S.H., M.Kn. This study was expected to improve and to develop the learning material and teaching book in legal science, particularly in Faculty of Law of Surakarta University, and to give input and knowledge increase for those related who wanted to register their rights through Land Deed Making Official (PPAT), in addition to find out how the mechanism of right-to-land registration is. This study was a normative sociological research. Technique of collecting data used were structured interview, observation, supported by library study and the data collected was analyzed qualitatively.  The Notary and PPAT office in the right-to-land registration served as an official institution appointed by the stated as the government’s arm in disciplining the publication of right-to-land owned by individual or enterprise, by authenticating the right in the form of deed. In this case, the applicants who wanted their right legally usually appointed Notary and PPAT to propose whether right transfer, exhortation (wasiat) or trade on an object of right-to-land to be registered in National Land Affairs Agency (BPN). The Notary and PPAT office later would deal with any completeness and prerequisite including the cost spent by the applicant until the publication of deed for what the applicants had applied. Meanwhile, the constraints the notary and PPAT office of Immawati encountered in the process of registering the applicants’ right was not too severe, because it was technical constraint only in the right application process; the constraint from the applicant usually included less complete data, particularly regarding the beneficiaries; the constraints from the National Land Affairs Agency included the less number of BPN personnel leading to the delayed document checking in the application process to right registration.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana syarat terjadinya pembatalan akta otentik dan akibat hukum yang timbul dari adanya pembatalan akta otentik. Akta otentik merupakan legal cover yang dimana mempunyai nilai kepastian hukum dan kekuatan pembuktian yang sempurna bagi para pihak yang membuat. Penelitian ini merupakan jenis penelitian Hukum Normatif. Adapun sumber data yang menjawab setiap pembahasan dari permasalahan yang timbul yaitu dengan pendekatan kasus perdata mengenai pembatalan akta otentik dan pendekatan perundang-undangan yang terkait dengan akta otentik. Dalam pendekatan kasus perdata Nomor 143/Pdt.G/05/PN.Ska terjadi pembatalan akta otentik berupa akta hibah. Alasan pembatalan akta otentik berupa akta hibah adalah Tergugat (penerima hibah) terbukti menelantarkan Penggugat (pemberi hibah) disaat Penggugat (pemberi hibah) tertimpa musibah, hal ini memenuhi ketentuan Pasal 1688 ayat 3 KUH Perdata yang menyatakan bahwa suatu hibah dapat dilakukan pembatalan apabila penerima hibah menolak memberi tunjangan nafkah kepada pemberi hibah ketika pemberi hibah jatuh miskin. Mengacu kepada Pasal 1320 KUH Perdata tentang syarat sahnya suatu perjanjian yang terdiri dari syarat subyektif dan syarat obyektif. Suatu akta dapat dibatalkan apabila syarat subyketifnya tidak terpenuhi yaitu sepakat dan cakap. Dalam perkara perdata ini, syarat subyektifnya sudah tidak terpenuhi karena pihak pemberi hibah sudah tidak sepakat lagi untuk memberikan hibah kepada penerima hibah dengan berdasar bukti bahwa penerima hibah sudah menelantarkan kewajibannya. Akibat hukum dari pembatalan akta otentik berupa akta hibah sudah tidak berkekuatan hukum lagi sehingga tanah dan bangunan yang semula telah dihibahkan dan menjadi milik Tergugat (penerima hibah) beralih kembali menjadi milik Penggugat (pemberi hibah).

Abstract

The objectives of research were to study and to understand the role of the Republic of Indonesia’s Police (POLRI) in dealing with domestic violence, and to study and to understand the constraints in dealing with domestic violence.The methods of collecting data used were interview and library study. In this study, the writer employed two approaches: juridical normative, the one based on legislation and juridical sociological, the one viewing the problem existing in the society from the prevailing legislation.The result of research showed that: The role of POLRI in dealing with domestic violence included a) preventively by holding general seminar, giving recommendation, and lecturing concerning domestic violence, b) repressively, by conducting enquiry and investigation, c) protecting the victim in collaboration with related institution, d) deciding the Article when the perpetrator of domestic violence proved guilty. Then, the constraints in dealing with domestic violence included: a) limited number of witness, b) the victim did not report directly the incidence befalling her, c) the family reluctantly reported the domestic violence because the perpetrator was their member of family, and d) the society’s uncaring to domestic violence leading them to reluctantly interfere with the problem the family was facing.   Keywords: Women, Violence, Family

Abstract

forced sell on margin trading financing is securities selling which done forcefully with or without announcement or investor’s approval. Some cases related to this force selling considered as a violation of investor’s rights. This research purposed to knowing whether force selling on margin trading financing by securities fulfilled by the investor legal protection and how is the investor legal protection ideal concept in force selling. This research was using statute approach and conseptual approach. Based on the result of the research, force selling as written on the Bapepam-LK Rule Number V.D.6 has been appropriated by the Indonesian Civil Code but this rule against investor legal protection as ruled on The Capital Market Law and The consumer Protection Law. ABSTRACTPT. Bank Negara Indonesia (Persero) Tbk. One is the founder and Pension Fund. The problems discussed in this research is how the implementation of the agreement, PT Pension Fund. Bank Negara Indonesia (Persero) in the main branches of Surakarta and legal consequences in case of breach of contract committed by one of the parties in the implementation of the agreement, PT Pension Fund. Bank Negara Indonesia (Persero) Tbk. The goal is to determine the implementation of the agreement, PT Pension Fund. Bank Negara Indonesia (Persero) Tbk in the main branches of Surakarta and legal consequences in case of breach of contract committed by one of the parties in the implementation of the agreement, PT Pension Fund. Bank Negara Indonesia (Persero).mplementation of the agreement, PT Pension Fund. Bank Negara Indonesia (Persero) started since reaching an agreement between the parties known of the existence of participant's signature on the membership application form and ending at the time of payment of pension benefits, either died or moved to another Pension Fund. In the event of default of the parties, the legal consequences for the Pension Fund is responsible for the harm done, whereas for participants who violate the agreement in the agreement then the agreement is declared null and void. Abstract

Penelitian merupakan sarana transportasi tertentu di daratan dengan batas batasan yang jelas,dilengkapi dengan prasarana dan sarana angkutan penumpang dan barang bawaan untuk  tujuan tertentu.dan sarana angkutan umum para penumpang dapat secara langsung menikmati kenyamanan dan sekaligus barang bawaannya terangkut untuk mencapai tujuan tertentu dan selalu terbentuk perjanjian pengangkutan terhadap para pengguna jasa yang tercantum dan tertulis di kartu pembayaran pengguna sarana tranportasi umum(karcis) Pembayaran.yang dimaksud dengan perjanjian PO. NUSA baik antar pengangkut dengan pengirim ,dimana pengangkut mengikatkan diri untuk menyelenggara pengangkutan barang dan orang dari suatu tempat tujuan dengan selamat,sedangkan pengirim mengikatkan diri untuk membayar uang angkutan tersebut berkewajiban membayar uang angkutan sebagai kontrak prestasi dari penyelengaraan pengangkutan yang dilakukan oleh pengangkut.Dalam menyelenggara usahanya di bidang jasa angkutan penumpang umum, PO NUSA mengahadapi berbagai hambatan dengan adanya persaingan sesama perusahaan angkutan yang semakin ketat,  Sehingga perusahaan harus senantiasa meningkatkan baik dari segi fasilitas maupun layanan layanan lain yang sekiranya dapat memberikan kepercayaan kepada para penguna jasa angkutan tersebut , misalnya: AC,TV,VIDEO dan lain sebagainya untuk menarik pengguna jasa angkutan. Di sisi lain perlu adanya layanan khusus seperti pemberian bonus bonus tertentu ,keramah tamahan  dari pegawainya tentunya hal ini mengatasi persaingan secara sehat antar peusahaan angkutan,dan para pengemudi terhadap peraturan peraturan yang diberlakukan oleh perusahaan,dimana para pengemudi kadang kadang menurunkan penumpang di sembarang tempat sehingga mengakibatkan di tangkapnya oleh yang berwajib dan menghambat waktu perjalanan . Dan kadang kadang dalam perjalanan sering terjadi hal ha yang membahaya karena dengan adanya hambatan hambatan yang ada pihak PO NUSA terus meningkatkan berbagai fasilitas dan pelayanann serta adanya pembinaan atau pengarahan dari pihak PO NUSA kepada para pegawainya.
