Al-Ihkam: Jurnal Hukum dan Pranata Sosial Al-Ihkam: Jurnal Hukum dan Pranata Sosial is a high-quality open- access peer-reviewed research journal published by the Faculty of Sharia, Institut Agama Islam Negeri Madura, Pamekasan, East Java, Indonesia. The focus is to provide readers with a better understanding of Islamic Jurisprudence and Law concerning plurality and living values in Indonesian and Southeast Asian society by publishing articles and research reports. Al-Ihkam specializes in Islamic Jurisprudence and Indonesian and Southeast Asian Islamic Law and aims to communicate original research and relevant current issues. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussion over current developments on Islamic Jurisprudence and Law concerning Indonesian and Southeast Asian plurality and living values. Publishing articles exclusively in English or Arabic since 2018, the journal seeks to expand boundaries of Indonesian Islamic Law discourses to access broader English or Arabic speaking contributors and readers worldwide. Hence, it welcomes contributions from international legal scholars, professionals, representatives of the courts, executive authorities, researchers, and students. Al-Ihkam basically contains topics concerning Jurisprudence and Indonesian and Southeast Asian Islamic Law society. Novelty and recency of issues, however, are the priority in publishing. The range of contents covers established Jurisprudence, Indonesian and Southeast Asian Islamic Law society, local culture, to various approaches on legal studies such as comparative Islamic law, political Islamic Law, and sociology of Islamic law and the likes.

Abstract

ABSTRACT There is a relationship between Islam and culture on the one hand and the law on the other. This paper attempts to answer the question about the influence of Islam and the culture in the formation of law in Indonesia. Through a systems approach gained answer that Islam and culture in Indonesia plays an important role in creating social order and piety. As a comprehensive belief system that includes the dimensions of the hereafter and worldly at the same time Islam play the role as a source of inspiration and legitimacy. Meanwhile, as a product of human in responding to natural and life lived culture played a role as a way of life and behavior on the side of religion. As a means to create order and a tool of social engineering, law in Indonesia can not be separated from Islam and culture. Establishment of state law will inevitably have to consider Islam and culture. If not, then the law will be alienated and lose relevance.

Abstract

ABSTRACT Justice, since the first issue, has been the subject of study both among philosophers and among theologians, politicians and thinkers or legal experts. However, if there are questions about justice, could not be determined what measures are used to determine something is fair or not. Various answers about justice usually never or rarely satisfying so that continues to be debated, so it can be concluded that the various formulations of justice is a relative statement. This issue ultimately encourages many people to take a shortcut by submitting formulation of justice to the legislators and judges who will formulate it based on their own considerations.

Abstract

Paper ini menggunakan pendekatan kualitatif dengan jenis penelitian lapangan (field research) dengan memaparkan; Pertama, bagaimana konsep anak luar nikah dan hak warisnya menurut KUH Perdata (Burgerlijk Wetboek), Kompilasi Hukum Islam dan Yusriprudensi MK? Kedua, Bagaimana kultur etnis Madura di Kebonan atas pembagian hak waris terhadap anak luar nikah?. Hasilnya Pertama, dalam Kompilasi Hukum Islam  dan KUH Perdata (Burgerlijk Wetboek) menjelaskan anak yang lahir dalam pernikahan walaupun tidak tercatatkan adalah anak sah, sedangkan anak hasil hubungan tanpa pernikahan adalah anak zina dan Yusriprudensi MK menegaskan hubungan anak dengan seorang laki-laki sebagai bapak semata-mata karena adanya ikatan perkawinan, akan tetapi dapat juga di dasarkan pembuktian adanya hubungan darah antara anak dengan laki-laki tersebut sebagai bapak. Sedangkan mengenai pengaturan hak waris anak luar nikah, adanya upaya pemerintah dalam pemberian satu bidang kekuasan kehakiman berupa Peradilan Agama yang membawahi konsep hukum kewarisan. Yang senada dengan konsep asas hukum Lex specialis derogat legi generali  yaitu asas penafsiran hukum yang menyatakan bahwa hukum yang bersifat khusus (lex specialis) mengesampingkan hukum yang bersifat umum (lex generalis). Kedua, dalam pembagian kewarisan anak luar nikah masyarakat Kebonan lebih cenderung menggunakan kewarisan kultural, yakni harmonisasi antara hukum perdata dan hukum Islam yang mengalami missinterpretasi dalam pemahaman kalangan hukum di Pengadilan Agama

Abstract

Perception of community are the regulation about tax of hotel in boarding house over 10 (ten) rooms in The Law No. 28 of 2009 about The Region Tax and Retribution is unclear and unfair. The problems are what are the nature meaning of hotel and boarding house services, second, analize tax of hotel in boarding house by fairness perspective. The research method is normative research with modern interpretation and fairness theory. The result are the nature meaning of hotel and boarding house services are differences. The regulation about tax of hotel in boarding house over 10 (ten) rooms is unfair.

Abstract

Handling inheritance from a deceased person is one of important matters that must be performed by the surviving heirs. However, the practice varies in communities, especially in areas affected by customary practices. The wealth of inheritance from the deceased is not only used as payment of funeral expenses and to be distributed to the heirs, but also used for the purpose of fidyah (compensation) for prayers left and others set in indigenous communities. The issue of tradition is important to study and clarify to society because it is not recognized in Islamic teachings and can even lead to diminishing the rights of others. Thus, this study aims to examine the extent of customary practices would affect the principle of inheritance distribution in the society of Pidie, Aceh, Indonesia.

Abstract

Corruption is an extraordinary crime because of its  negative impact on the aspects  of community life. People who have been infected by this deadly virus would die slowly but surely. This crime has a tremendous potential to cause misery, destitution and suffering of many people, especially the lower class people who do not have access to the power and economy; those who would have their rights only if they were given by the state. Corruption is a modern term whose synonym could not be found in the Islamic legal literature. However, by recognizing the elements contained, the term in Islamic criminal law is closely related to theft (sariqah), bribery (risywah), embezzlement of property (ghulul) and robbery (hirabah) with different legal sanctions. Corruption occurs because of many factors such as materialistic-consumerism lifestyle, costly political system, weak leadership, lack of religious and ethical education, social and legal systems that support corrupt behaviors. To eradicate corruption, repressive ways  can be done through the penal system as well as preventive efforts through non penal system.

Abstract

This study aims to examine the paradigm of moderate ijtihad by Ahmad Hasyim Muzadi and moderation discourse of Islamic law that was built by Ahmad Hasyim Muzadi. This study used the approach is the thought of Milton K. Munitz. This study showed that the paradigm of moderate ijtihad that built by Ahmad Hasyim Muzadi should not be based on the texts of Islamic law only, but also to be devout and clear thinking, honest, and sincere. In this way, the moderation  of Islamic law discourse that resulted will bear the legal system that is inclusive and accommodated to the dynamics of human life. Islamic legal discourse that has a balance and fairness in enforcement at the empirical level

Abstract

Pengangkatan anak merupakan hal yang lazim dilakukan di dalam masyarakat dengan tujuan untuk memperoleh kepastian hukum. Untuk mencapai kepastian hukum tersebut adalah mengajukan permohonan pengangkatan anak ke pengadilan. Hingga saat ini di Indonesia dalam perkara permohonan anak yang diajukan oleh orang yang beragama Islam masih mengenal dualisme bidang peradilan yaitu  Pengadilan Agama dan Pengadilan Negeri. Dalam mengadili dan memutus kedua lembaga peradilan tersebut mempunyai perbedaan dasar hukum yaitu Pengadilan Agama mendasarkan pada hukum Islam sedangkan Pengadilan Negeri mendasarkan pada hukum Barat. Dengan demikian  asas personalitas keislaman dalam perkara permohonan pengangkatan anak belum sepenuhnya berlaku karena orang yang beragama Islam masih dapat mengajukan ke Pengadilan Negeri.  Realita ini juga berlaku di Pamekasan dimana masyarakat lebih familier mengajukan ke Pengadilan Negeri.

Abstract

Pragmatisme ekonomi di berbagai negara telah mendorong pragmatisme di Indonesia dan berimplikasi pada hukum ekonomi syariah. Menurut pragmatisme, sesuatu dianggap ada, baik, dan benar jika bermanfaat. Pola pikir pragmatis ikut mewarnai perbankan syariah, ditandai prinsip mudharabah semakin tidak populer, prinsip murabahah semakin dominan, dan dipilihnya Pengadilan Negeri untuk menetapkan eksekusi objek hak tanggungan. Kajian ini fokus pada tiga pertanyaan. Mengapa pemenang lelang objek hak tanggungan pada perbankan syariah mengajukan eksekusi objek hak tanggungan ke Pengadilan Negeri. Bagaimana legalitas lelang oleh Kantor Pelayanan Kekayaan Negara dan Lelang terhadap objek hak tanggungan pada perbankan syariah. Bagaimana implikasi dan solusi norma eksekusi objek hak tanggungan pada perbankan syariah. Dengan menggunakan penelitian hukum normatif, diperoleh tiga temuan. Pertama, permohonan eksekusi objek hak tanggungan ke Pengadilan Negeri disebabkan mindset pragmatisme perbankan syariah. Kedua, jika lelang objek hak tanggungan didahului poses rescheduling, reconditioning, dan restructuring, maka lelangnya sah. Jika tanpa didahului ketiga proses tersebut, lelangnya tidak sah. Ketiga, jika penetapan eksekusi objek hak tanggungan pada perbankan syariah oleh Pengadilan Negeri, maka tidak sah. Sebagai solusinya, semua norma sengketa ekonomi syariah pra-Putusan MK No 93/PUU-X/2012 harus dilakukan harmonisasi atau rekonstruksi norma.

Abstract

Tema tulisan ini bukan hal yang baru dalam kajian keislaman, tapi permasalahan terkait dengannnya selalu saja terulang di tengah masyarakat sehingga penulis merasa  kajian tentang hal ini masih diperlukan, namun tentu dengan Analisa yang berbeda.   Terdapat hal yang ingin penulis dalami: 1) Gambaran hadits-hadits tentang hukman mati bagi pelaku riddah?; 2) Konstruksi hukum hadits-hadits tentang hukuman mati bagi pelaku riddah, ditinjau dari kapasitas Nabi saw., saat menyabdakan, dalam perspektif Mahmud Syaltut?Hasil penelitian ini: 1. Hadits-hadits tentang hukuman mati secara umum berkualitas shahih dan diriwayatkan dengan banyak jalur sanad. Hadits-haditnya pun dari sisi lain dapat dibagi menjadi dua macam: Pertama: Hadits qauli yang berisi tentang sabda Nabi saw. "Barangsiapa yang berpindah agama maka bunuhlah". Ada pula beberapa riwayat dengan tambahan lafad "Meninggalkan agama dan berpisah dari jamaah muslimin". Kedua: hadits-hadits fi`li dari Nabi saw. tentang beberapa orang murtad yang dibunuh karena kemurtadannya disertai dengan permusuhan dan tindak kriminal. Ada pula beberapa riwayat fi`li dari sahabat yang menghukum mati beberapa orang murtad berdasarkan pemahaman mereka terhadap hadits Qauli. Namun untuk memudahkan maka pengelompokan hadits-haditsnya dilakukan dengan melihat tema haditsnya untuk memudahkan dalam menganalisa. 2. Dengan berbagai analisa disimpulkan bahwa rasulullah saw. berkapasitas sebagai seorang imam ketika menyabdakanhadits-hadits tentang hukuman mati bagi pelaku riddah. Maka hukumannya merupakan ta`zir yang berlaku temporer tergantung situasi dan kondisi, jika dipandang oleh imam riddah membahayakan negara dan akidah kaum muslim, ia berhak untuk menghukum dengan hukuman paling berat, seperti yang dilakukan Ali bin Abi Thalib menghukum dengan cara yang paling keras yaitu membakar.
