Abstract

Siraman (bathing) is a Javanese ritual ceremony that is done one day before the bride does the ijab qabul. In the siraman ritual, the operational rule and the equipments (uborampe) that are used are already definite (maton/pakem) as the symbols that have meanings. The meanings of the symbols in the siraman cannot be put off from Javanese context. Phenomenology and philosophy approaches using hermeneutic method towards siraman ritual are interpreted comprehensively to make the meanings of symbols clearly therefore the symbols in the siraman ritual can be understood. This research figures the inter relations among philosophy, culture and Islam.

In the contemporary, theology can be studied by interdisciplinary sciences, which eventually theology became the source of the birth of some sciences. In order to integrate the belief and sciences, it is needed the effort of islamization of science and the effort to reconstruct theology into a format that make it possible to dialogue with the reality of current development of thinking.

Abstract

Conflict resolution on SARA requires pluralistic approaches. Hence, the presence of legal pluralism becomes a new approach to resolve the problem. This study is qualitative research that conveys three dimensions of legal pluralism, namely natural law, state law, and society law. The study used secondary data, with primary and secondary legal materials obtained by documentation resources. Data were analyzed inductively, used the contemporary theories to produce more conceptual and general propositions for conclusions and recommendations. The result shows that there have been 8 cases on SARA conflict in Indonesia during the last three years. To solve these problems, religious leaders can use the natural law approach to re-internalize religious values and tolerance. In addition, the government also should understand that those conflicts were a form of society law owing to the discreditable law society and religious diversity. Therefore, a non-penal policy with persuasive appeals is needed to reduce the problems. However, penal policy through law enforcement should also be implemented as a form of state positivism law. In other words, state positivism law should go hand in hand with natural law and society law in order to reach the best decision based on moral and religious ethics as well as social values.

Abstract

The relation between ritual and socio-political environment should become a deep reflection. Rituals which take place in order for salvation, harmony, and natural balance instead generate the ambigue and ironic situation. Rituals had been going on amazingly but the social as well as natural disasters seems go on continually. In Bali, religious rituals that formerly guarded by mantra-mantra (spiritual wordings) recently enstead by a group of Pecalang (tradition guardian in Bali) and metal detector (at the time of Pamarisudha Karipubhaya Bali Blast of 2002 and 2005). Nowadays Balinese are eager to perform rituals spectacularly. But instead, Bali now is struck by continous disaster, not only the disaster came from external sources but also the internal ones.***Hubungan antara ritual dengan lingkungan sosial politik harus menjadi bahan renungan yang dalam.

Abstract

Identity is political rather than natural. It is always influenced by the politics of race, class, gender, religion, education, disability, and so on. This paper examines the complexity of political forces that shape female identity at the beginning of the 20th century Java and the reaction the women show in response to the circumstances where they find themselves, with reference to Pramoedya Ananta Toer’s Gadis Pantai. The novel, which is based on the true story of his own grandmother, portrays the life of a practice wife of priyayi, the hereditary governing class of Java. Using interpretive analysis and close reading of the text, the study argues that feudal and patriarchal circumstances help shape female identity in the 20th century Java. Women are doubly discriminated; they find themselves subject to higher powers, i.e. the powers of the feudal lord and the male. However, throughout the novel, the author displays a brand-new female image different from the socially dominant discourses, an image that has qualities of rebellious fervor to trouble the discriminating social category of identity.

Abstract

The Holy Quran and Sunnah contain universal values that require correct reasoning to be understood and applied by the Muslims. In this context, the scholars have been justified by Allah Almighty to undertake the ijtihād and ijmā’. This study aims to describe the ijtihād jamā’iy (collective ijtihād theory), as well as to analyze the implementation of ijtihād jamā’iy at MUI’s Fatwa Commission in Lampung. This study is a combination of literature and field research. The data were obtained through literature studies of books, articles, and journals in related issues. Besides, the authors also interviewed MUI members to gain deeper information. Theoretically, the contemporary ijmā’ process can be pursued by an independent forum to conduct studies until a consensus is obtained from the majority of the participants. The panel must involve all religious elements in a representative manner. The practice of establishing Islamic law carried out by MUI’s Fatwa Commission of Lampung Province is in accordance with the concept of ijtihād jamā’iy in the science of uṣūl fiqh. This analysis is important so that people have a high level of compliance after knowing that the MUI Lampung fatwa is ijma, which in fact is one of the sources of Islamic law.
