Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Isu perempuan dan keluarga selalu menjadi penting bagi umat manusia sehingga problema yang ada tidak dapat diacuhkan begitu saja. Keluarga adalah unit terkecil dari sebuah masyarakat, sementara itu perempuan dianggap sebagai salah satu bagian di dalamnya. Artikel ini mengkaji ulang pembacaan sejarah dalam perspektif ahl al-bait terutama yang terkait dengan eprempuan dan keluarga. Terdapat dua pemahaman yakni perempuan dalam pandangan tradisional dan bahkan modern. Melalui pembacaan ulang ini akan dapat menghindari fanatisme dan kejumudan terhadap perubahan dalam kehidupan sosial, disamping mengukuhkan sistem kehidupan sosial berdasarkan prinsip-prinsip syariat. Konklusi akhirnya adalah sentralitas keluarga dan pembagian peran perempuan dan lelaki secara proporsional berdasarkan jenis kelamin, penetapan metode dan cara yang tepat untuk partisipasi perempuan di tengah masyarakat.

The Perspective of al-Syafi’I on Partnership in Marriage In husband and wife relationships, contemporary couples prefer a partnership pattern rather than one of leadership. Although the latter is not necessary better than the former, it is obviously more accommodative of modern ideas of justice, egalitarianism and gender equality. This article aims to explore the connections between household partnership patterns, as fundamental to contemporary Muslim’s, and the traditional Islamic jurisprudence (fikih) most dominant among the diverse adherents of Islam.  More specifically, this research describes al-Syafi`à thought. To explore the partnership patterns of married couples, it elaborates on three points: (1) the meaning of qawwamuna, (2) the concept of bride price and household expenses, and (3) interactions between husband and wife. The primary resource use in this research is al-Umm. This article concludes that Syafi’i jurisprudence implicitly accommodates the idea of partnership between marriage partners, as evident in (1) the acknowledgement of a woman’s right to choose her husband; (2) the bride price, which has both legal, formal and moral implications; (3) the co-understanding of the marriage partners in matters of household expenses and the emphasizing of discussion in solving financial problems; and (4) the use of good reason in dealing with household and personal conflicts.

Family problems are not unusual since parents are individuals with differences in attitude, manner, and ways of interaction. Problems can arise due to jealousy, economic problems, affairs, immorality, and other outside issues. Such problemss are found in newly married as well as longterm couples who have not engaged in the ta’aruf processes. Generally, Indonesian people choose the pre-marriage process, and in this case, ta’aruf are overlapped so that it becomes negative. The overlapping of ta’aruf affects self-esteem, psychological wellbeing and morality. The attitudes of the couple therefore effects their future life, men think negatively about the relationship and women are exploited as they are considered to be influenced by their emotions. Men think that the women are not what they want because the woman cannot keep support her own existence. The mutual relationship between men and women is used to minimize the family’s problems. This paper describes ta’aruf according to the Syafi’i and Ja’fari points of view, and considers which contributes more to ta’aruf actualization in Indonesia. Both philosophies proffer that women should dress in the khibah, that the way women dress women be appropriate to the activities of daily life, and that they may khalwat whether mahram or not. Through ta’aruf one may avoid problems that lead to zina (sexual sin).

A child’s right to education within the family according to Imam Syafi’i and its significance for early childhood education in Indonesia This research is based on library research on the rights of the child to education within the family from the viewpoint of Imam Shafi’i, and the impact of his teachings on early childhood education in Indonesia. The study is interesting because the first schools to appear in Indonesia were of the Syafi’i tradition. Imam Syafi’i jurists and ushuliyyin have collections of poems that express the need to develop education in early childhood. Despite this, the theory of children’s education in the school of Imam Syafi’i is under researched. This study examines three research questions. First, how does one undertake a biography of the thought of Imam Syafi’i and Imam Syafi’i school of thought. Second, what is the concept of children’s rights in the family in the view of Imam Syafi’i. And third, is there reference to early Childhood education that implies the concept of children’s rights to education in the view of Imam Syafi’i. This study concludes that Imam Syafi ‘i in scientific rihlah is purely academic. Imam Syafi’i also elicits several important ideas on a child’s rights within the family, the right to education and the right to self-expression. Imam Syafi’i schools are relevaant to early childhood education in Indonesia in which these (religious education) schools are widespread.

Prinsip sentralitas keluarga dalam sistem hukum Iran dapat banyak membantu keseimbangan kepentingan dalam sistem hukumnya. Hal-hal yang berhubungan dengan ahwal syakhshiyyah, terutama pernikahan, dalam seluruh agama, memiliki relasi yang kuat dengan kayakinan keagamaan. Dari satu sisi, ketidakpedulian terhadap perubahan-perubahan sosial akan memunculkan undang-undang yang mati dan kaku dalam hubungan sosial. Dan dari sisi lain, mengabaikan nilai-nilai keagamaan dan terutama pada perilaku yang memiliki sensitifitas terhadap madzhab akan melahirkan dualitas dalam sistem-sistem yang mendominasi perilaku sosial. Ide sentralitas keluarga, dengan memanfaatkan hukum-hukum fikih dan memperhatikan al-ghayah asy-syar’iyyah dari hukum pernikahan dalam fikih Ja’fari melalui pembaharuannya, relatif dapat memberikan dominasi pandangan terhadap hak-hak keluarga di Iran dalam menghadapi perubahan-perubahan sosial dan mengarahkan kepada sistem tunggal dalam sistem keluarga di tengah masyarakat Iran sebagai negara religius. Prinsip-prinsip hasil istinbath dari referensi-referensi ijtihad menurut maktab fikih Ja’fari dalam bidang hukum/hak-hak keluarga dan dimasukkan dalam UUD Republik Islam Iran, melahirkan dominasi sistem hukum khusus terhadap keluarga. Pasal 10 UUD Republik Islam Iran menjadikan keluarga sebagai yang terpenting dan pemersatu masyarakat. Maka seluruh undang-undang, aturan dan perencanaan yang berhubungan dengan itu bertujuan memudahkan pembentukan keluarga dan menjaga kesucian dan kelanggengan hubungan kekeluargaan.

The Urgency of Civil Registration in the Fulfilment of the Rights of the Child From birth Indonesian children have the basic right to be protected by the State and according to religion. One of the basic rights of the child is the right to obtain a birth certificate through the civil registration system. In this context, all children are seen to have the same basic human rights, and the same is true according to Islam. For example, there is no differentiation in relation to whether a child is born within marriage or illegitimately. From a human rights perspective, all children have an equal rights. Similarly, in Islamic jurisprudence according to the Imam Shafi’i School there are no limits to the care of a child. Civil registration of birth ensures human rights in relation to social status and individual benefits. The civil registration system gives individuals a unique identity, records the relationship with parents, and provides the foundation for citizenship. Birth certificates provide documentation of the birth of the child and usually one or both parents, which was fundamental to the determination of nationality, depending on the laws of each country. Civil registration is also important in recording death, marriage, divorce and so forth.

Keluarga, dalam pandangan Islam, terdiri dari seorang lelaki dan perempuan yang terjalin hubungan pernikahan di antara keduanya dan disempurnakan dengan kelahiran anak-anak. Artikel ini akan memaparkan pandangan al-Quran dan hadis terkait pengokohan bangunan keluarga. Dari ajaran Islam menjadi maklum bahwa indikasi kehidupan manusia muncul dari keluarga dan sesungguhnya Allah swt menciptakan Adam kemudian Hawa secara langsung setelahnya serta menjadikan hubungan pernikahan di antara keduanya. Dengan demikian, dari satu sisi kita mengetahui pentingnya sistem keluarga untuk pertumbuhan dan kesempurnaan manusia yang menjadi tujuan penciptaannya. Dan sisi lain membuktikan keberadaan sistem keluarga sebagai sebuah unsur natural dan fitri yang sesuai dengan kebutuhan ruhani dan jasmani manusia, dan bukan hanya sebatas komitmen atau partisipasi atau sejenis kepemilikan atau saling dominasi. Sistem keluarga bersifat natural bukan berarti tidak adanya kemungkinan penyelewengan, karena hari ini di dunia Barat kita melihat berbagai bentuk fenomena-fenomena ini, seperti maraknya homoseksualitas. Sementara itu, Islam memberikan penekanan pada keluarga dan menetapkan berbagai hukum untuknya dan hubungan antara isteri dan suami serta anak-anak. Berkenaan dengan kedudukan keluarga dalam Islam, Nabi Muhammad saw bersabda: “Tidak ada suatu bangunan di dalam Islam yang lebih dicintai Allah swt dari perkawinan.†Melihat pentingnya keluarga dan perannya dalam perkembangan dan kesempurnaan manusia, banyak hadis menekankan penguatan sistem ini dan memberikan metode-metode untuk itu. Hadis-hadis tersebut juga menjelaskan tantangan dan penyakit yang dihadapi oleh sistem keluarga serta memberikan solusi-solusi untuk menghadapinya.

Islam telah menganugerahkan identitas yang tinggi dan bermartabat kepada perempuan dengan hukum-hukum taklif dan akhlak yang mulia, mengeluarkannya dari perbudakan, kehancuran dan hilangnya jati diri, dan memandangnya dengan kemuliaan dan penghormatan di tengah masyarakat ketika tidak seorangpun ingin melahirkan seorang anak perempuan. Artikel ini membahas perempuan dalam Islam, terutama menurut perspektif madzhab Ja’fari yang akan menjawab pertanyaan-pertanyaan dan problema-problema yang muncul terkait perempuan dan kedudukannya dalam Islam dengan bersandar kepada ayat-ayat al-Quran dan riwayatriwayat. Dengan demikian, Islam telah memberikan kehidupan kepada perempuan. Islam telah merubah tradisi-tradisi terdahulu dan menyebutkan perempuan sebagai penyebab turunnya rahmat Allah swt. Dari satu sisi, membesarkan dan mendidik perempuan dijadikan sebagai sumber kebahagiaan kedua orang tua dan dari sisi lain, Islam memberikan penghormatan kepada seorang ibu dengan ungkapan yang terkenal: “Surga di bawah telapak kaki ibu.â€

A Woman’s Right to Marry without a Guardian According to Imam Syafi’i and Imam Ja’Fari To marry without a guardian and the issue of the marriage guardian are legal marriage issues that always arouse debate among Muslims. In classical literature, “it seems†women do not have the right to marry without a guardian. This paper examines whether women have the right to marry without a guardian and the issue of guardians. This matter not explained explicitly or in detail by the Prophet resulting in a multiplicity of interpretations. Religious leaders and schools of thought, as well as the State, discuss and examine these issues from a variety of perspectives. This paper explains the view of Imam Shafi’i and Iman Ja’fari, based on content analysis ond library-based research. This study looks firstly at patterns of thought and socio-cultural life according to Imam Shafi’i and Imam Ja’fari. Secondly, it discusses their views on the women’s right to marry without a guardian. Lastly, it explores the implications of their thought on the practice of women marrying without a guardian in Indonesia.
