Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

The issue of homosexuality brings about various viewpoints that are controversial from any aspect. In terms of health, for example, many people link homosexuality as being the cause of the spread of HIV/AIDS, even though homosexuals themselves do not accept this accusation. In this article, Budi Wahyuni endeavours to look more "fairly" at this issue. According to her, HIV/AIDS and other sexually transmitted diseases are caused by unsafe sexual practices. Among those sexual acts vulnerable to the spread of sexually trans mitted diseases are oral sex, anal sex and masturbation, whether they are done by homosexuals or heterosexuals.

Abstract

The Alqur'an states that there are two kinds of sexual orientation in the history of mankind: heterosexuality and homosexuality. Nevertheless, the Alqur'an only acknowledges marriages of the first kind. There are many verses that stress that finding a partner (always a partner of the opposite sex) represents sunnatullah. In addition, the Alqur'an also criticizes the homosexual acts of the people of Lut, who is later punished by God. In this article Abdul Mustaqim goes further to cite the views of some commentators that contrary to what some people believe, homosexual potential is about nurture and not nature.

Abstract

Although they are not accepted and considered deviant by the majority of society, homosexual relationships are becoming increasingly prominent and openly declared, especially in modern times. Moreover, in some countries homosexuals are acknowledged and given empathy. This article endeavours to investigate this issue from the perspective of Islamic law. By using arguments from verses of the Alqur'an, the hadith of the Prophet, and the maqasid ash-syari'ah approach, this article refutes the practice of homosexuality in its various forms.

Abstract

Nowadays in some advanced countries homosexuality is being given increasing social acknowledgement compared to previous times. Here in Indonesia there are a small number of homosexuals who have started to open up socially. This article analyses the tendencies of "other homosexuals" - that is, transvestites and transsexuals, and tries to understand their world from the inside. Up to now the majority of society still tends to negatively stereotype them, making their life marginalized, even though socially they are far more open compared to homosexuals. For this reason we need to face the issue of transvestites with a perspective of wisdom.

Abstract

Thus far the views of experts of Islamic jurisprudence regarding homosexuality have been very clear in forbidding it. The Alqur'an, Hadith and Ijma' are the bases of the prohibition on marriages of this kind, although jurists differ in their views on the punishment for homosexual behaviour. Malik, ash-Shafi'i and Ahmad equate the punishment for homosexual acts with that for adultery, whereas Abu Hanifah views it as a ta'zir punishment (one determined by the government). Meanwhile, the· view of some that homosexuality is a natural and predetermined phenomenon presents its own challenges: how will Islamic law respond to the claim that homosexuality is a part of our basic human rights that must be protected?

Abstract

The existence of transvestism is something that cannot be denied, even though these tendencies represent symptoms of sexual abnormality. From this point, many views have emerged regarding transvestites. This article endeavours to explain the various forms of this phenomenon including homosexuality, transvestism and transsexuality, and the differences between them. It then goes on to review the Islamic laws concerning these by putting forward argumentation and quoting the hadith of the Prophet.

Abstract

It is very interesting to bring discourse on homosexuality and lesbianism, particularly from a psychological perspective into the arena of Islamic discourse. Study of homosexuality and lesbianism becomes even more interesting when we try to elaborate on the psychological theories of sexuality from the expert and pioneer of psychoanalysis, Sigmund Freud. Freud was considered by some as anti-God, anti-establishment, anti-argument, anti-consciousness and anti-rationality. This was because Freud created inner psychology, which not only examined the visible indications of the soul, but also those things connected to dreams, hysteria and imaginings. This article discusses the phenomena of homosexuality and lesbianism from a psychological perspective, mainly focusing on the theories of Freud. This is because Sigmund Freud is the psychologist who proposed psychoanalysis, which introduced and spread.
