Abstract

This research discusses: first, the tendency of judges to impose imprisonment without considering any additional criminals in the form of counseling as a criminal sanction in KDRT (domestic violence); second, effective applicable policies in the implementation of Criminal Counseling. This research used normative approach with empirical data. The method of data collection was interview to judges to obtain primary data. The finding of this research shows: first, based on the existing facts, judges have never implemented any additional criminal in the form of counseling because it has not been well-known in court; there has not been any prosecution using Article 50 of UU PKDRT; the institution for counseling has not been established yet. Second, in the implementation of additional criminal counseling, efficient applicable policies in the future should refer to the idea of double track system, by optimizing both types of sanctions in a proportional manner (criminal sanctions and measures). Revision for stipulation in Article 50 point b is needed, so that it is more understandable and can soon be implemented by judges. In addition, the arrangement of standard operating procedure is needed for the implementation, supervision, and report of counseling process for the subject of domestic violence.

Abstract

This article sum up that Judicial Commission (JC) in Indonesia has a strong position in the constitution, UUD 1945 (after amendment). Its JC‘s position is legally considered a similar position with The Supreme Court and Constitutional Court. In practice, however, its JC‘s function is less effective to be an external control against judges code of conduct.Three factors are involved to make the JC fails to establish control effectively. One is the decreasing integrity of the JC due to the fact that The Deputy of Chief was involved in bribery practice. Second, the weakness of leadership which set a side of the JC‘s core business, as an external control. The third, The Constitutional Court is decision led the JC‘s function to undermine its authority. In order to improve its effective control, it is necessary to attempt certain efforts. On the one hand, the JC is demanding not only to maintain its personal integrity, but also need to change a leadership system. More importantly, the JC capability to join collaboration in supporting government and legislative member in revising the bill No 24/2002 need to take into account.Key words : Judicial commission, judges code of conduct, and supreme court

Abstract

An agreement shall be binding upon the parties, and each party is obliged to be responsible for what is stated in the agreement. This research focuses on the legal perspective of a lease agreement made before a notary public and its relation to the decision of Supreme Court Justice. The study uses normative, philosophical, juridical analysis; in addition, it is a qualitative, comparative research. During the study, a library research is conducted and legal materials are analyzed qualitatively using a case approach. The research leads to a conclusion that, first, a lease agreement made before a notary public is legal and authentic, and second, the decision of Supreme Court strengthens the lease agreement made before a notary public, and the Notary Deed is validated and inviolable.

Abstract

Generally, the procedure to prove the application of actio pauliana is not simple. In addition to this, the application for the settlement of actio pauliana is lack or coordination among the relevant authorities. It is considered therefore that the protection on creditor’s interest through actio pauliana is possible to be enforced. Abstract

This study discussed the problem of the indigenous law community existence in Indonesia, and the dynamics of the indigenous law community viewed from the Acts of Constitutional Court. This study was focused to analyze two matters, namely: First, how is the existence of the indigenous law community in Indonesia? Second, how does the indegenous law community take the Acts of Constitutional Court? This study used the statute approach. In addition, case study approach was also used to find the ratio decidendi used by the judges of Constitutional Court in adjudicating the statute test case related to the indigenous law community. The result of the research concluded that: first, the existence of the indigenous law community in Indonesia had already been accomodated in the prevailing laws of regulations including the 1945 Constitution of Republic Indonesia, Acts, Regional Regulations, Governors’ Decrees, and Heads of Regions’ Decrees. Second, the law politics of the indigenous law community took the Acts of Constitutional Court as strengthening the existence of the indigenous law community in Indonesia by providing the interpretation or explanation.

Abstract

Legal history found that the practice of judicial review has been long recognized in the Muslim community starting the period of the propthet Muhammad Rasullah Saw hundreds years ago long before Justice John Marshall of the United States of America’s Supreme Court in 1803 made a decision for a constitutional case ‘writ of mandamus’ filed by Marbury. The US Supreme Court declared the Judiciary Act 1789 was against the Article II Section of 2 of the US Constitution. The propthe Muhammad saw was remined by Allah SWT for his statement that over the prophtet ojection to use honey as medicine was against the holly Quran. The holly Quran is the hightest-ranked sources of law in Islam. In term of the Perda Syariah should be no objection as long it is line with the holy Quran and no doubt the Perda should also considered in line with the 1945 ConstituionKey words : Islamic law created by local government

Abstract

Fair trials are universal principles included in various international human rights instruments, procedural law and professional codes of conduct that guide judges in analyzing, hearing and deciding cases. Identifying these isntruments enables us to assess the presence or absence of a fair trial. On this basis, the researcher formulates the research problems in the study as follows: first, what is the tendency of violation of the Code and the Judicial Code of Conduct (KE PPH)? Second, what is the tendency of the recommended sanction and sentence for the period of 9 (nine) years of KY (2005-2014)? This research is classified as non doctrinal legal research with socio-legal approach. The study concluded that: first, for the first five-year period, there are no significant increasing trend of case reports, while during the second five years there was a significant raise of case report. Meanwhile, the most region with most case reports is Jakarta Special Region. The most common type of violations of KE PPH is the unprofessional, undisciplined, unfair and dishonest behavior of the judge. Second, as with types of sanctions the moderate sanctions and medium sanctions are highly dominant. Meanwhile severe sanctions in the form of dishonorable discharge, dismissal with pension rights and unofficial sanction for 1-2 years is likely to increase from year to year.

Abstract

In the criminalization, there are three primary principles need to be considered; legality, subsidiary, and equality before the law. There are also criteria to be taken into account; the act shall be in contravention with the sense of justice of the people, the ability of the existing legal framework to cater such act, the balance between the instruments required and the outcomes, the balance between the cost and benefit of the criminalization, the effect of such criminalization, and the last is the ability of the judicial system to enforce the law on the criminalized act.Keywords: Basic principle, Criminalization, Criminal Law
