Abstract

Among the goals of the 1945 constitution amendment is to create the balance among  the legislative, executive and judicative powers, and thus the check and balance function may take place. So as the proposal for enhancing the authority of the parliament members, which is according to the second amendment  hold the supervisory function as has been provided by section 20 (1).

Abstract

The process of amending UUD 1945 has created different kinds of views regarding its form of amendment. One side demands “amendment system” as the one applied in United State of America. The other side demands a total change by creating a new constitution such as in France, Netherlands, and Germany. The main problem that would be investigated and answered in this research is how the amendment of constitution in theory and constitutions in several countries. This research is a case study about the method used in the amendment of constitution. The approach used in this research is not only normative jurisdiction, but also comparative approach, because it has normative comparison on the constitutions in several countries. This research has concluded; first, the way UUD 1945 amended theoretically does not divert from the general principles of constitution changing and democracy country. Second, the amendment of UUD 1945 follows the form of the amendment or constitutional adandum of United States of America.Key words : Constitution, amendment, UUD 1945

Abstract

Bersamaan dengan hadirnya demokasi di Indonesia lewat Reformasi pada tahun 1998, praktek penyelenggaraan Negara berlangsung secara dinamis. Salah satu kedinamisannya adalah otonomi daerah yang implementasinya telah memicu interpretasi yang luas dikalangan masyarakat. Salah satu perihal yang mengundang pro dan kontra dalam hal otonomi daerah adalah keberadaan peraturan daerah syariah di beberapa tempat di Indonesia; satu diantaranya adalah pada Kabupaten Tasikmalaya. Sementara itu mereka yang tidak setuju mempunyai alasan bahwa urusan agama adalah pada tangan pemerintah pusat dan tidak diberikan sebagai bagian dari otonomi.Kata kunci: formalisasi syariah, pemerintah daerah

Abstract

The legal process from the detention to the court session for the activist of KOMJI (Jihad Commando) seems to be unprofessional, not transparent and mostly engineered by the lawgivers. The topic being examined includes how to accommodate the Human Rights aspect during the process of investigation and verdict in the case of Jihad Commando. The research using doctrinal and non-doctrinal approach is focused on the primary and secondary data. This research shows that there has been a human rights abuse in the case of Jihad Commando in all stages of the case either in the process of detention and preparing the documents bearing the case (BAP) by Kopkamtib/ Laksusda (Command for the Restoration of security and public order), Police Department, Attorney, or in the examining process in court.

Abstract

The inclusion of Regional Representatives Council (DPD) in the parliament, side by side with House of Representatives (DPR), suggests that the parliamentary system applied in Indonesia is bicameral system, since there are two bodies within this parliament.  However, considering that  People’s Consultative Assembly (MPR) is not a joint session between DPR and DPD but rather an independent body with independent authorities,  can be said accordingly that Indonesian parliamentary system is a “grey” system stands between bicameral and tricameral system.

Abstract

This research discusses: First, the juridical ratio of the position of People’s Consultative Assembly’s adjudication which re-enters the regulations of law hierarchy. Second, the position and legal status of the People’s Consultative Assembly’s adjudication based on Law Number 12 of 2011 on the Formulation of Regulations of Law compared with the position and legal status of the previous People’s Consultative Assembly’s adjudications. The research method used in this research was normative-juridical method. The approach used was historical and statute approaches. The research finding shows that: First, the position of People’s Consultative Assembly’s adjudication in the regulations of law hierarchy is condition sine quanon. Second, the legal status of the People’s Consultative Assembly’s adjudication based on Law Number 12 of 2011 is different from the People’s Consultative Assembly’s adjudications prior to the amendment of Constitution 1945 of the Republic of Indonesia. This is in regards with the fact that the People’s Consultative Assembly after the amendment of Constitution 1945 has the position as state high institution.

Abstract

Law and legal reform is not only about the supreme court (Mahkamah Agung) governance but also the socializing and the restructuring of the implementation of the new decision by judge. It has many problems that really need consideration. Many gaps are found in the implementation of new judges’ decision (vonnis) on the restructuring of the supreme court (Mahkamah Agung) development. It can be the result of the previous judges’ decision (vonnis). This article aims at seeking a good and reasonable solution of applying the act number 3 of 2009 concerning the optimal restructuring of the supreme court (Mahkamah Agung).Key words: supreme-court, judges, decision, law and legal reform

Abstract

The researched problem is how the existence of court judge seen from juridical thinking and justice concept through time is. The research method was normative research with philosophical and conceptual approach. The findings of this research are: first, judges are responsible for judicial proceedings and decision related to all the cases they handle, by using legal logic and thinking as well as justice principles. Second, judges who act as a part of law enforcement are responsible for upholding justice by finding the legal principles by digging, obeying, and understanding any values existing in societies. Third, judges should always make judiciary as a primary institution which is independent and decisive, and as a central institution, not as a marginal institution which is dependent and controlled by any political, financial, and authority influences. Fourth, in the future, judges must be willing to participate actively in eradicating and preventing any occurrence of judicial mafia and making the judiciary free from any judicial mafia. Fifth, maintaining the existence of judges is determined by work performance, professionalism, idealism, and sufficient facility as well as internal and external supports.

Abstract

The central government policy which granted the autonomy for some local governments has brought about the rise of local regulations which are drafted in accordance with the local aspirations. Accordingly, for the residences where their socio-historical backgrounds are marked with Islamic tradition, tends to aggregate Islamic values in the regulations they issue.

Abstract

This research focuses the issue of legislative policy of fine and its implementation in effort to overcome corruption. By using normative and qualitative legal method, this research revealed the following facts. First, implementation of fine in positive law of Indonesia not accordance with the punishment objectives as regulated in Criminal Act besides Indonesian Civil Code. In fact, fine seems like ineffective sanction. So, even though there are lots regulation about fine which mostly imposing high fine to defender, but it cannot creates preventive and deterrence effect. Second, effectiveness of fine implementation in court practice still questionable. In corruption case, sometime judges imposed high imprisonment to offender and supplemented with lower fine. In imposing fine, mount of fine is under the minimum standard which regulated in Corruption Act. Third, fine must be formulated with rational, exact and efficient ways. Related with the effort to overcome corruption, fine must be maximized to punish offender to achieve deterrence effect.Key words : Fine, corruptions, legislatife policy
