Functioned as a regional representative council, DPD possessing a regional representative character principally has a broader representative character compared to DPR (Legislative Assembly). It is because its representative dimensions are based on all of the citizens living in the regions. The issues being studied include (1) Is the existence of DPD in line with the idea of its establishment based on the bicameral legislative system?, (2) Is the constitutional authority of DPD synchronic with its existence as a state institution? This is a normative research focused on primary and secondary materials of law including the regulation of law and the literatures relevant as the research object. In obtaining the primary and secondary materials, a library research was conducted by involving a descriptive-qualitativeanalysis. The research result then shows the existence of DPD in relationship with DPR and MPR as regulated in the Constitution of 1945 is not in line with the thought of its establishment. At this point, the reform on the structure of Indonesia Constitution toward a strong bicameralism is not materialized in the Constitution of 1945.

This study focuses two legal issues deal to the meaning and legal tests of good faith on contract performance. Using the descriptive analysis with normative juridical approach, and library data, this study reveals: First of all, the meaning of good faith on contract performance is not universal, but there is a tendency its meaning refers to objective good faith. Lastly, legal test of that good faith uses objective tests, namely reasonableness and equity.

The research focuses on the legal definition of land procurement for public use that caused many disputes in the past. The problem studied here is the understanding on public interest, land rights, and proper indemnification of the land owners and the land procurement acting authorities. This research is qualitative research with socio legal approach using constructivism paradigm. The research used data from field study and literature study. The findings conclude that the dispute on the land procurement for public use was caused by injustice because of legal understanding gap between the land owners who viewed law as traditions and values prevailing in society and the land procurement acting authorities who viewed law in form of regulations which was comprehended only in formal-textual context.

Political party and corruption in Indonesia can be allegorized as two sides of a coin, both of which relate closely to each other. Law No. 2 of 2008 in conjunction with Law No. 2 of 2011 on Political Party mentions one of the reasons of the political party dismissal, namely conducting an activity which violates the regulations of law. The proposition to dismiss a political party comes only from the Government. This fact closes the opportunity of other parties like individual or community group to propose a political party dismissal. The problems studied in this research are: First, the reason why an individual or a community group should be given the legal standing in the proposition of the political party dismissal. Second, the relevance of the legal standing provision to an individual or a community group in the proposition of the political party dismissal. Third, what attempt that can be conducted to provide the legal standing for an individual or a community group in the proposition of the political party dismissal. The method used in this research is normative juridical method employing law material approach. The result of the research concludes that: First, the urgency to provide the legal standing for an individual or a community group in the proposition of the political party dismissal to interpret the implementation of the people sovereignty in the law state principle. Second, by the provision of legal standing for an individual or a community group, the citizen monitoring toward the political parties will be more effective. Third, the attempt that can be conducted to provide legal standing for an individual or a community group in the provision of the political party dismissal is by revising the Constitutional Court Law.

The purpose of this article is to discuss ius constituendum on abortion in Indonesia from criminal law perspective between Common Law System and Civil Law System. Ius constituendum on abortion in Indonesia is not directed to legalization of abortion as carried out both in The Netherlands and USA but tends to be harmonized with therapeutic abortion concept both in medical and psychiatric fields. Such a harmonization would result in the enlargement of exception in carrying out abortion not only limited on ‘for saving mother’s life based on medical indication’ but also for other reasons such as ‘pregnancy because of rape and incest’, ‘mother experiencing huge mental disorder’ and ’the fetus experiencing huge physical destruction’.Key words : abortion, criminal law, common law system, civil law system

For more than 30 years, a discourse regarding the selection of judges has become a hot issue around the world for several reasons. It is mainly related to the primary function of the courts to resolve disputes that may affect the lives of individuals and society. Problems posed, first, how filling the positions of justices and judges in the Indonesian constitution of post-reform? Second, how is the ideal concept in filling the positions of justices and judges of the constitution? This research is doctrinal, using primary and secondary legal materials, in the form of some legislation, literature and research results which are relevant to the object of research. The approach used in this study is the approach of legislation and conceptual approaches. The study concluded, first, filling the positions of Chief Justice and Judges of the Constitutional shows that it is more politicking because of the participation of the People's Representative Council or Parliament. Secondly, the renewal and principle of self-restraint need to be done by each branch of power to minimize political bias.

Cutting hand penalty for theft cases, according to Muslim jurists’ view, is a maximum penalty, and hence, not all of such cases deserve for this mode of penalty. In case that the requirements for the implementation of such penalty cannot be found in a theft case, cutting hand may not be implemented and ta’zir shall apply instead. Ta’zir then, is considered as an educative penal system which falls under the authority of the judges to exercise their ijtihad capability.

This research focuses on the eradication of economic crimes policy in Indonesia. This is a normative juridical research using statute approach and conceptual approach. Legal materials collected by literary study which is analyzed qualitatively. This research found that eradication of economic crime policy as public policy to solve economic crime is still focused on the effort of criminalization through legislation dan legal enforcement using criminal justice system, in which non-criminal justice sistem actors still do not perform well in eradication of economic crime through preventive action.Key words : Criminal Policy, economics crime, and law enforcement

The most common type of conflict involving indigenous people is the dispute on the ownership of economic resources and cultural sites which are convicted and guaranteed as traditional indigenous rights. In this regard, indigenous people stand vis a vis with investors’ interest which is usually safeguarded by state legal instruments. Indigenous people are shaky in this kind of conflict and in the factual cases, the process to weaken and destroy indigenous community has been made through regulations, policies, as well as real actions made by the government. In the post-reform, the establishment of the Law No. 25 year 1999 about the Financial Proportionality between Central Government and Local Government and the Law No. 33 year 2004 about the Financial Proportionality between Central Government and Local Government, Distribution of Proportionality Resources have turned into the distribution of natural resources of local areas. The issue to be analyzed deals with in what financial sector the local areas initiatively find the revenue sources needed to implement their autonomy as a reflection of a decentralization-based implementation as stated in Constitutional of 1945. The method used in the research is based on the judicial-normative approach by applying the materials of primary law, secondary law, and tertiary law. This research additionally applies a normative-qualitative analysis. The establishment of Regulation on the Financial Proportionality in the post of reform shows a very significant outcome for the implementation of autonomy in the local areas. It is due to the local budget is not merely based on the local revenue but, much more than that, the local areas also have the budget resources originated from the local areas alone – that currently is absorbed by the Central Government.
