Abstract

This study raises the issue of, first, reinterpretation of ar-riqab in an effort to optimize the function of zakat for social welfare, and second, contextualization of ar-riqab reinterpretation as a victim of human trafficking crime to optimize the function of zakat for social welfare. This research is doctrinal research with  legal  and  conceptual  approaches.  The  results  show  that,  first,  ar-riqab  in  the  conventional terminology as a slave is no longer relevant to the current conditions. Ar-riqab can be understood as a person shackled in structured and massive poverty, making it possible for zakat functioning as a public economic instrument to achieve the success of promoting welfare. Second, one of the meanings of ar-riqab in accordance with the current conditions is victim of human trafficking. This group is vulnerable to economic exploitation, making it difficult to empower themselves because they are in the power of other people. The instrument of zakat as an economic power can play a role for the empowerment of trafficking victims by including them as aznaf ar-riqab. This study recommends that zakat management contextually interprets ar-riqab and is no longer fixated on the meaning of slave, thus enabling optimum functioning of zakat as an instrument to achieve social welfare.

Abstract

The 1998 reforms opened a new discourse on the direction of the Indonesian constitutional system. There were six aspects that became the demand for the reform at the time, one of which was the rearrangement of central and regional relations, by bestowing autonomy to the regions to the broadest extent possible. In relation to this particular issue, the formulation of the problems in this paper is as follow: first, how is the complexity of the problem of regional autonomy in Indonesia, especially in terms of authority? Second, what are the implications of the complexity of the problem for the existence of the Unitary Republic of Indonesia. The method used in this research is juridical normative, where the focus of data collection and exploration is through literature study and supported by interviews. This study concludes, firstly, the complexity of the problem of regional autonomy is triggered by, among others, the efforts of decentralization in the Regional Government Law after reform. Whereas Indonesia with a very broad cultural background and regional reality, is more suitable to be managed in the form of an expanded asymmetric decentralization model. Secondly, if the relationship between the central government and the regions is managed centrally it has the potential to cause resistance from the regions, it can threaten the existence of the Republic of Indonesia.

Abstract

The structure of agricultural policy in Indonesia is still reaping with many problems which include the conversion of agricultural land to non-agricultural land, the low level of the farmers’ welfare, as well as the land reform policy. To unravel the causes of these problems, this research intends to first, discuss the politics of agricultural law in Indonesia from the Old Order era to the Reformation, and second, to offer ideas for improving the development of agricultural law politics in order to face the global challenges. This study uses a normative legal research method by reviewing the statutory approach and historical approach. The research concluded that, first, during the Old Order the political direction of the agricultural sector was emphasized on the i1nventory of agricultural and plantation land. During the New Order era, the political direction of the agricultural sector was divided into two, namely, the direction of food sovereignty and semi-industrial agriculture. During the reform period, the dominance of the influence of foreign capitalism in the legislation. Second, the ideas offered to face the global challenges are by building a legal policy for agriculture based on economic democracy as initiated by Bung Hatta.

Abstract

Sebagai negara hukum dan bagian dari warga masyarakat dunia, Indonesia tidak dapat bersikap apatis terhadap persoalan hak asasi manusia (HAM). Untuk itulah, implementasi nilai-nilai HAM haruslah dirumuskan dalam peraturan perundang-undangan. Berangkat dari persoalan bagaimana implementasi nilai-nilai HAM global ke dalam sistem hukum Indonesia yang berlandaskan Pancasila, maka melalui penelitian hukum normative akan dicari jawaban atas persoalan dimaksud.Dari hasil pembahasan, dapatlah disimpulkan bahwa implementasi nilai-nilai HAM global kedalam sistem hukum suatu negara tidaklah dapat mengabaikan nilai-nilai yang hidup dalam masyarakat yang bersangkutan. Demikian halnya Indonesia dengan Pancasila sebagai cita hukumnya, yang akan mempengaruhi dan berfungsi sebagai asas umum yang mempedomani (guiding principle), norma kritik (kaidah evaluasi) dan faktor yang memotivasi dalam penyelenggaraan hukum (pembentukan, penemuan, dan penerapan hukum) dan perilaku hukum. Hal ini menempatkan Pancasila sebagai bintang pemandu (leitstern) bagi pembuatan undang-undang HAM di Indonesia agar selaras dengan nilai-nilai HAM yang terdapat pada Pancasila dan UUD NRI 1945. Pancasila telah menjadi dasar pengikat konsistensi dari sistem hukum Indonesia, sehingga norma HAM yang terkandung dalam UUD NRI 1945 dapat berfungsi regulatif maupun konstitutif. Fungsi regulatif menempatkan norma HAM dalam konstitusi (UUD) sebagai tolok ukur untuk menguji, apakah undang-undang atau hukum positif telah selaras dengan cita-cita HAM yang didasarkan pada Pancasila.  Sebagai fungsi konstitutif menentukan tanpa semangat HAM dalam UUD, undang-undang atau hukum positif akan kehilangan makna sebagai hukum yang bermanfaat untuk kemaslahatan masyarakat.

Abstract

The fact that it is obliged to Sharia Supervision Board (DPS) in every Sharia Bank Financial Industry (IKBS) and non-bank financial industry (IKNBS) to abide by sharia conditions has made sharia supervision inseparable from sharia compliance. Such thing can be seen from several regulations issued by DPS-MUI which become a reference for IKBS and IKNBS in running their activities in the sector of sharia finance. This research focuses on the regulations issued by DSN-MUI and their implementation regarding IKBS IKNBS, as well as DPS as the one having the authority to supervise every sharia-based finance industry. This was a normative research, which searches for data in the form of books and other written data which have correlation with the research object by using descriptive-analytic approach. The findings show that DPS as the one having the authority to supervise sharia compliance, has responsibility as stated by a strict legal system. The existence of DPS really determines the establishment of sharia compliance, which becomes the main unsure in the existence and continuity of syariah financial industry.

Abstract

The existence of KPK based on the act No. 30/2002 is aimed to be special super body organization to optimize in wiping out corruption inIndonesia. The special features are-: caused first the institution of law up holder existed(c.c policeand attorney) is dependent institutionally because of the position is underthe executive (c.qPresident); second, the action, of law enforcement forthe corruption criminal by both institution tend to show theirrecklessness. In other words;it is not effective, efficient and optimal and it has bom pessimistic for the public as well about law supremacy especially in wiping out the corruption practices. Toenhance the public trust as well as the prestige of KPK it self, so KPK must wipe out the corruption practices continuously without any compromising but is must be suitable with the task and authority given by legislation.
