Abstract

Kegiatan pendaftaran tanah untuk pertama kali baik melalui pendaftaran tanah secara sistematik dan pendaftaran tanah secara sporadik menghasilkan sertipikat sebagai tanda bukti haknya. Salah satu sertipikat yang diterbitkan oleh Kantor Pertanahan adalah sertipikat hak atas tanah. Dengan diterbitkan sertipikat hak atas tanah akan terwujud jaminan kepastian hukum dan perlindungan hukum bagi pemilik sertipikat. Namun implikasi tersebut juga diikuti implikasi lain berupa pembatalan apabila terjadi cacat yuridis dalam pembuatannya, dan gugatan apabila terjadi kerugian akibat adanya cacat prosedur dan perbuatan melanggar hukum.A certificate will be generated for land that registered for the first time through sporadic or systemic registration, this certificate will be issued for the proof of ownership purpose. One kind of certificates which is issued by the land office is Land Rights Certificate. The effects of this kind of certificate to the owner are giving a legal certainty and a legal protection. However this implication is followed by other implications such as cancellation and claim. Cancellation happen if there was a juridical flaw by the time the certificate is being made, while claim will be happened if there was a loss as the effect of procedural flaw and unlawful act.

Abstract

Dalam penulisan ini, kami menelaah secara kritis dasar yuridis dari cakupan pidana dalam Undang-Undang No. 6 Tahun 1983 sebagaimana telah diubah terakhir dengan Undang-Undang No. 16 Tahun 2009 tentang Ketentuan Umum dan Tata Cara Perpajakan (UU KUP) yang berfokus pada pertanggungjawaban pidana korporasi dan sanksi pidana yang terkait dengan pelanggaran tindak pidana di bidang perpajakan. penulisan ini bermula dengan pemaparan mengenai pertanggungjawaban pidana pada korporasi sebagai suatu prasyarat pemidanaan korporasi. Kami menganalisis tindak pidana di bidang perpajakan yang diatur dalam UU KUP dalam hal subjek hukum yang dicakup oleh UU KUP dan sanksi pidana dalam hal terjadi pelanggaran tindak pidana tersebut. Kami menyimpulkan adanya ketidakkonsistenan dalam pertanggungjawaban pidana terhadap korporasi dan sanksi pidananya yang diatur dalam Pasal 38, 39, dan 39A UU KUP. Kami akhirnya memberikan beberapa saran untuk perbaikan undang-undang ini dalam aspek pertanggungjawaban pidana untuk korporasi dan sanksi pidananya.In this legal research, will be critically examined the legal basis of the criminal coverage in the General Provision of Taxes Law (UU KUP) (Law No. 6/1983 which amended by Law No. 16/2009), which focused on the corporate criminal responsibility, and the criminal sanction related to tax crime. Started from the description of corporate criminal responsibility as a prequisite of corporate criminal penalty, then will be examined about the tax crime which regulated in UU KUP, especially about the criminal subject and the penalty. It is concluded that there are some inconsistencies about the corporate criminal responsibility and also the penalty which is regulated in Article 38, 39 and 39A UU KUP.

Abstract

Pembebanan hipotek atas kapal laut dilakukan dengan menggunakan akta otentik, pembuatan akta otentik jaminan hipotek adalah kewenangan dari Pejabat Pendaftar dan Pencatat Balik Nama Kapal sebagaimana telah ditunjuk oleh undang-undang. Faktual, pembebanan hipotek selalu dilakukan dengan pembuatan Surat Kuasa Memasang Hipotek yang berisi janji-janji terlebih dahulu. Walaupun tidak diwajibkan, Surat Kuasa Memasang Hipotek dirasa oleh masyarakat dapat lebih menjembatani dan melindungi kepentingan para pihak. Hipotek merupakan jaminan kebendaan, maka harus memenuhi asas publisitas, yaitu dengan mendaftarkan jaminan hipotek tersebut dalam register umum yang sifatnya terbuka. Pemenuhan asas publisitas ini akan membawa implikasi kepada pihak ketiga di luar perjanjian jaminan hipotek tersebut.The imposition of a ship mortgage should be done by using an authentic deed, the making of motrtgage’s deed is the authority of Pejabat Pendaftar dan Pencatat Balik Nama Kapal as it is designated by the law. Factually before the parties go to the Pejabat Pendaftar dan Pencatat Balik Nama Kapal for the imposition of a ship mortgage they will go to the notary to make such an attonery, which called Surat Kuasa Memasang Hipotek that contains some promises and agreements made and agreed by the parties. Eventhough this Surat Kuasa Memasang Hipotek is not a must but the substance of this deed could even more in giving protection and could accommodate the willingness of the parties, and also give more protection to the parties. Ship mortgage is a property rights guarantee, thats why it must fulfil the publicity principle which is done by registering the mortgage into the general register.

Abstract

Penulisan hukum ini dilatarbelakangi bahwa teknologi informasi memegang peranan penting dalam kehidupan manusia baik di masa kini maupun masa yang akan datang. Implikasi dari pertumbuhan teknologi informasi membawa masyarakat kepada pola perilaku yang semakin terbuka. Dengan kehadiran internet, maka membuat kehidupan manusia di seluruh dunia menjadi lebih mudah. Karena internet dapat menembus batas-batas antarnegara dan mempercepat penyebaran dan pertukaran ilmu baik di kalangan ilmuwan atau cendekiawan di seluruh dunia. Hanya saja, dibalik kemudahan penggunaan internet, terdapat sisi gelap yang merisaukan penggunanya, yaitu dari segi keamanannya. Keamanan sistem komputer berbasis internet perlu diperhatikan. Karena jaringan internet yang bersifat publik dan global sangat rentan dari berbagai bentuk kejahatan dunia maya atau cyber crime. Terutama kejahatan cracker. Cracker adalah pelaku atau orang yang melakukan aktivitas cracking di internet. Akibat dari kejahatan tersebut sangat merugikan. Diantaranya adalah dapat merusak jaringan, situs tidak dapat dibuka, terhapusnya data-data dan lain-lain. Karena modus operandi cracker ini berbeda dengan kejahatan konvensional lainnya. Dan yang paling membedakan adalah locus delictinya atau tempat kejahatan perkara. Setelah mengetahui modus operandi cracker, maka akan dengan mudah untuk dapat menangani kasus cracker.This legal research based on the fact that information technology plays an important role in human being nowadays and also in the future. The implication of the massive information technology development brings different behavior to some people. By the presence of the internet, it makes human being life become easier. Internet could definetely access data over countries, and could also be useful in knowledge exchange among scientists or scholars around the world. However, eventhough internet is ease of use, there are some risk which could harm the user, especially from the safety aspect. Thats why the safety of the internet based computer system security must be considered. Because the character of internet network is global public open access, it makes internet network become very vulnerable from any cyber crimes, especially cracking crime. Cracking is the activity while cracker is the person who done the cracking activity over the internet network. The effects of this crime are very harmful, such as broken network, broken website, and even worse, data loss. Because the cracker’s modus operandi is definetely different from other conventional crime, and the most prominent difference is the locus delicti (place where the crime happened), because tracking the internet network is not easy. Therefore by knowing the cracker’s modus operandi, it will be easier to resolve the cracking cases.

Abstract

Salah satu jenis fasilitas kredit yang saat ini banyak digunakan oleh para pelaku usaha adalah bank garansi. Bentuk perjanjian bank garansi ada 3 (tiga) macam yaitu: garansi dalam bentuk warkat yang diterbitkan oleh bank, garansi dalam bentuk penandatanganan kedua dan seterusnya seperti aval dan endosemen dengan hak regres, garansi lainnya yang terjadi karena perjanjian bersyarat. Isi dari perjanjian bank garansi yaitu memuat tentang syarat-syarat minimum penerbitan bank garansi dan juga memuat jenis-jenis transaksi antara pihak yang dijamin (nasabah bank) dengan pihak penerima jaminan (beneficiary atau bouwheer). Apabila pihak yang dijamin (nasabah bank) melakukan wanprestasi, maka setelah pihak yang menerima jaminan (beneficiary atau bouwheer) mengajukan klaim kepada pihak bank, selanjutnya pihak bank akan melakukan pembayaran atas klaim tersebut. Dalam hal terjadinya tuntutan ganti rugi atau klaim berdasarkan jaminan bank harus tetap memperhatikan Pasal 1400 dan Pasal 1401 Burgerlijk Wetboek.One of credit facilities type that commonly used by the enterpreneur is bank guarantee. Bank guarantee has 3 (three) kind: guarantee in a letter form published by bank, guarantee which is signed for the second time and so on like aval and endosemen withbregress rights, and also other guarantee that formed as the effect of a conditional agreement. The substance of bank guarantee consist of the minimum requirements for the bank guarantee to be issued, and also contains types of the transactions between guaranteed parties and the beneficiary. If the guaranteed parties does a default, then after the beneficiary claim to the bank, bank will do a payment to the related claim. In case claim does happened, it is a must to pay an attention to Article 1400 and 1401 of Burgerlijk Wetboek.

Abstract

Hubungan hukum yang terjalin di antara subjek hukum yang satu dengan yang lainnya dapat terjadi melalui perkembangan teknologi seperti media internet. Terutama dalam era globalisasi dewasa ini yang mana berbagai transaksi bisnis di antara para pengusaha itu terjadi pada domisili yang jauh berbeda, hal ini tentu saja membutuhkan metode yang dapat mempermudah para pihak untuk menuangkan kehendak dan mempercepat kehendak bisnis mereka. Kendala semacam itu teratasi dengan pemanfaatan fungsi internet yang mana dapat mempermudah para pengusaha dalam berkomunikasi dan bernegosiasi untuk mencapai kesepakatan yang nantinya akan melahirkan perjanjian. Namun terkadang tidak disadari oleh masyarakat jika terdapat berbagai resiko pernyalahgunaan atau kerentanan terhadap adanya perbuatan melawan hukum dalam penggunaan internet yang mana akan menimbulkan masalah hukum. Dalam hal ini Indonesia telah mengeluarkan aturan untuk menertibkannya yang mana tertuang dalam Undang-Undang No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik.The legal relationship between one law subject to other law subject could be rised through the technological developments, such as internet. Especially in today’s globalization era where most business transactions will be done by businessman who live in a far different domicile, this situation obviously needs a method which could make the parties become easier to facilitate each other will and also make the whole business process become faster. This kind of problem solved by the existence of the internet. By using the function of the internet it could make the businessman become easier to communicate or negotiate to each other which will ended up with an obligatory agreement generated by the parties. However sometime people doesn’t realize if there were such risks like abuse or unlawful act in using the internet which will raises legal issues. According to this situation Indonesia has generated rules to avoid the risk in a law form, which is law No. 11/2008 ITE.

Abstract

Hak Milik atas tanah dapat dialihkan melalui jual-beli. Dengan jual-beli, hak milik atas tanah berpindah dari pemilik tanah sebagai penjual kepada pihak lain sebagai pembeli. Jual-beli hak milik atas tanah dapat didaftarkan apabila memenuhi syarat materiil dan syarat formal. Syarat materiil berkaitan dengan kewenangan dan hak dari pihak penjual dan pembeli, sedangkan syarat formal berkaitan dengan pembuktian jual-beli hak milik atas tanah. Pendaftaran jual-beli tanah ke Kantor Pertanahan Kabupaten atau Kota harus mensyaratkan adanya jual-beli yang dibuktikan dengan adanya Akta Pejabat Pembuat Akta Tanah, tidak cukup dengan Akta di bawah tangan.Property rights of land could be transferred through trading activities, this activity could transfer owner (seller) land proprietary to the buyer. This land proprietary trading activity could be registered  if it meets the material and formal requirements. The material requirements are related to the rights and authority of the seller and buyer, while the formal requirements are related to the evidence of the land proprietary trading activity. It is presupposed by the regency or city land office to do the proprietary land trading activity which must be proven by the official land officer deed (Pejabat Pembuat Akta Tanah) for the purpose of the land proprietary trading activity registration. Non official deed (not done before a notary) will not be approved.
