Hukum kewarisan nasional yang dicita-citakan dan yang sedang direncanakan dewasa ini bersumber pada Hukum Islam, Hukum Adat, dan Hukum Perdata. Adapun tujuan dari penulisan ini adalah untuk mengetahui cara penetapan, kedudukan dan akibat hukum dari orang yang diduga meninggal dunia atau si yang tidak hadir atau afwezigheid, serta perlindungan hukum untuk ahli warisnya menurut Hukum Perdata. Penetapan oleh Pengadilan Negeri tentang afwezigheid dalam perspektif Hukum Waris Perdata, yaitu mereka sebagai ahli waris yang berkepentingan, apabila 5 (lima) tahun telah lewat semenjak kepergian si yang tidak hadir dari tempat tinggalnya, dapat mengajukan permohonan kepada Pengadilan Negeri. Pengadilan Negeri akan memeriksa dan melakukan pemanggilan kepada si yang tidak hadir, dan apabila si yang tidak hadir tidak datang/hadir tanpa memberi kuasa kepada seorang wakil, maka Pengadilan Negeri akan melakukan pemanggilan secara umum dalam jangka waktu selama sedikitnya 3 (tiga) bulan (Pasal 467 BW). Jika si yang tidak hadir/wakilnya tetap tidak hadir, maka Pengadilan Negeri akan menetapkan bahwa si yang tidak hadir diduga telah meninggal dunia. Dengan penetapan itulah ahli waris dapat menguasai harta warisan dari si yang tidak hadir dan jika diperlukan saat itu yang ditinggalkan dapat melangsungkan perkawinan yang baru dengan orang lain (Pasal 495 BW).The intended national and planned legacy of national heritage is based on Islamic Law, Customary Law and Civil Law (Burgerlijk Wetboek). The purpose of this paper is to know how the determination, position and legal consequences of the allegedly dead or the absent (afwezigheid), as well as legal protection for his heirs according to Civil Law. The determination by the District Court of “afwezigheid” in the perspective of the Inheritance Law of the Inheritance of the Inheritance of the Inherited Law, if 5 (five) years have passed since the departure of the absent from his residence, may apply to the District Court. The District Court shall examine and call to the absentee, and if the absentee does not appear / present without authorizing a representative, the District Court shall make a general summonment for a period of at least 3 (three) months (467 BW). If the absentee is not present, the District Court will determine that the absentee is suspected to have died. It is by this determination that the heirs can control the inheritance of the absentee and, if necessary, the moment left behind, may establish a new marriage with another person (495 BW).

Pejabat umum di Indonesia yang bertugas untuk menjamin kepastian hukum bagi masyarakat yang melakukan perbuatan hukum mulai dari jual beli, sewa menyewa, waris, hibah, wasiat dan perbuatan perbuatan keperdataan lainnya. Dalam hal ini notaris sebagai pejabat umum yang diberikan wewenang oleh undang-undang, melalui diundangkannya Undang-Undang No. 30 Tahun 2004 tentang Peraturan Jabatan Notaris. Meskipun dalam UUJN telah jelas mengatur mengenai wewenang jabatan Notaris, namun dalam jabatan pejabat umum notaris bukanlah satu-satunya jabatan yang disandang pejabat umum untuk membuat alat bukti otentik (akta). Dalam pembuatan akta di bidang pertanahan dikerjakan oleh Pejabat Pembuat Akta Tanah, sedangkan untuk membuat Akta risalah lelang dibuat oleh Pejabat Lelang kelas II yang semuanya itu mempunyai dasar aturan dan pertanggung jawaban yang berbeda padahal sebenarnya wewenang tersebut telah ada pada jabatan notaris dan wewenang tersebut telah diatur secara jelas pada Pasal 15 UUJN. Jurnal ini akan menggunakan metode penelitian normatif, akan banyak menggunakan pendekatan konseptual, dan menggunakan pendekatan histori yang mana akan membahas sejarah dari masing-masing jabatan pejabat umum. Dalam menganalisa isu hukum akan menggunakan beberapa teori seperti teori wewenang. Pada akhir jurnal ini dapat kita temukan alasan mengapa jabatan pejabat umum harus dipisah, dan tidak disandang hanya dengan jabatan notaris.General public officials in Indonesia who are committed to ensuring legal certainty for people who commit legal acts ranging from sale, lease, heirs, grants, wills and other civil actions. In this case the Notary as a general officer authorized by law, through the enactment of Law No. 30 of 2004 on Notary Public Regulation. Although UUJN has clearly regulated the authority of a Notary position, but in the office of a notary public office it is not the only office held by a public official to create an authentic proof (deed) tool. In the making of deed in the field of land is done by the Land Authorities Act, whereas to make the Auction Brochure Act made by the Class Auction Officer all of which have different rules and responsibilities whereas the actual authority has already existed notary and the authority is regulated clearly in Article 15 of the UUJN. This journal will use normative research methods, will use a lot of conceptual approaches, and use historical approaches which will explain the history of each public official. In analyzing legal issues will use several theories such as the theory of authority. At the end of this journal we can find the reason why the position of public officials should be separated, and not only served by notary office.

Lalu lintas merupakan salah satu sarana komunikasi masyarakat yang memegang peranan vital dalam memperlancar pembangunan bangsa. Salah satu hal yang dihadapi dalam lalu lintas adalah kecelakaan. Permasalahan ini pada umumnya terjadi ketika sarana transportasi, baik dari segi jalan, kendaraan, dan sarana pendukung lainnya belum mampu mengimbangi perkembangan yang ada di masyarakat. Adapun tujuan penelitian ini adalah menganalisis sebab-sebab terjadinya kecelakaan serta kajian upaya perbaikan dalam pencegahan lalu lintas di wilayah hukum Kepolisian Daerah Jawa Timur (Polda Jatim). Metode penelitian yang digunakan yaitu dengan pendekatan yuridis empiris, dengan data primer dan sekunder, dan analisa secara kualitatif dan disajikan secara deskriptif. Penelitian dilakukan di Polda Jatim dan beberapa Polres-Polres diantaranya, Polrestabes Surabaya, Polresta Sidoarjo, Polres Gresik, KP3 Tanjung Perak, Polres Batu, Polres Malang, Polres Pasuruan, dan Polres Probolinggo. Teori yang digunakan dalam penelitian ini adalah Teori Interaksionis dan Teori Kepatuhan Hukum. Hasil dalam penelitian ini, bahwa ada 5 (lima) faktor penyebab kecelakaan lalu lintas Khususnya di wilayah hukum Polda Jatim adalah: Adanya Faktor Kesalahan Manusia, Faktor Pengemudi, Faktor Jalan, Faktor Kendaraan Bermotor, dan Faktor Alam. Upaya perbaikan dalam pencegahan kecelakaan lalu lintas dengan dua cara yakni cara preemtif dan cara preventif.Traffic is one means of community communication that plays a vital role in expediting the nation’s development. One of the things faced in Traffic is an accident. This problem generally occurs when the means of transportation, both in terms of roads, vehicles, and other supporting facilities have not been able to keep up with the existing developments in the community. The purpose of this study are: to analyze the causes of accidents and study efforts to improve the prevention of traffic in the jurisdiction of POLDA East Java. The research method used is empirical juridical approach, with primary and secondary data, and qualitative analysis and presented descriptively. The research was conducted at POLDA JATIM and several POLRES-POLRES among others, Polrestabes Surabaya, Police Sidoarjo, Gresik Police, KP3 Tanjung Perak, Polres Batu, Polres Malang, Pasuruan Police, and Polres Probolinggo. The theory used in this research is Interactionist Theory and legal compliance theory. The results of this research are 5 factors causing traffic accidents Especially in jurisdiction of POLDA JATIM are: Existence of Human Error Factor, Driving Factor, Road Factor, Motor Vehicle Factor, and Natural Factor. Improvement efforts in the prevention of traffic accidents in two ways namely preemptive and preventive ways.

PERLINDUNGAN HUKUM TERHADAP ANAK SEBAGAI PENYALAHGUNA NARKOTIKA DALAM SISTEM PERADILAN PIDANA ANAK DI INDONESIA Beniharmoni Harefa

Dalam sistem peradilan pidana anak di Indonesia, anak sebagai penyalahguna narkotika, menjalani proses peradilan pidana. Sebagai pihak yang rentan dalam proses peradilan pidana, maka meski menjalani proses peradilan, kiranya anak tetap harus mendapat perlindungan. Bagaimana bentuk perlindungan serta apa faktor yang menjadi penghambat upaya perlindungan hukum terhadap anak sebagai penyalahguna narkotika dalam sistem peradilan pidana, menjadi pertanyaan yang akan dibahas dalam penelitian ini. Metode yang digunakan yakni metode penelitian yuridis normatif, yaitu penelitian terhadap data sekunder. Perlindungan hukum terhadap anak sebagai penyalahguna narkotika di Indonesia, diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, dan Undang-Undang Nomor 17 Tahun 2016 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2016 tentang Perubahan Kedua Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, serta berbagai peraturan perundang-undangan teknis lainnya yang berkaitan tentang anak sebagai penyalahguna narkotika. Upaya perlindungan pada anak sebagai penyalahguna narkotika, dilakukan melalui upaya diversi, bertujuan menghindarkan anak dari proses peradilan pidana formal ke peradilan pidana non formal. Perlindungan lainnya dengan pengawasan, pencegahan, perawatan, dan rehabilitasi terhadap anak penyalahguna narkotika. Faktor penghambat, pertama, kurangnya pemahaman dari aparat penegak hukum, kedua, kurangnya pemahaman masyarakat dan ketiga, kurangnya fasilitas khususnya di daerah-daerah terpencil di Indonesia.In the Indonesian juvenile justice system, children of drug abusers undergo trial. As a vulnerable person in the criminal justice system, then despite the judicial process, presumably the child should still be protected. How the form of protection as well as what factors are inhibiting legal protection of the child as a narcotics abuser in the criminal justice system, the question that will be discussed in this study. The method used is normative juridical research method, that is research on secondary data. The legal protection to the children of narcotics abusers in Indonesia is regulated in the Act No. 11 of the Year 2012 on Juvenile Justice System, the Act No. 35 of 2009 on Narcotics, and the Act No. 17 of the Year 2016 on Stipulation of Government Regulation in Lieu of Law No. 1 of 2016 on the Second Amendment to the act No. 23 of 2002 on Protection of Children, as well as other technical regulations relating to narcotics abuser children. Protection efforts on children of drug abusers are carried out through surveillance, prevention, treatment, and rehabilitation. Diversion efforts, aim to prevent children from formal juvenile justice processes to non-formal juvenile justice. Factors inhibiting the legal protection of drug abuser children are, firstly, the lack of understanding of the law enforcement from the officers; secondly, the lack of understanding of the community; thirdly, the lack of facilities, especially in remote areas of Indonesia.

Dalam dunia maya yaitu internet, informasi menjadi sesuatu yang sangat penting dan benar-benar hidup. Mobilitas begitu cepat dan bisa didownload, diproduksi, untuk kemudian diupload lagi. Jaringan internet merupakan salah satu sumber informasi paling populer saat ini. Banyak pengguna internet mengakses situs-situs yang berbau pornografi karena situs-situs yang berbau pornografi inilah yang menunjang perkembangan dari internet. Tindak pidana ini dinamakan dengan Cyberporn. Mengingat sangat besar dampak yang diakibatkan oleh perbuatan pornografi terutama pada situs internet, maka pemerintah mengesahkan RUU Anti Pornografi dan Pornoaksi menjadi Undang-Undang Pornografi. Dalam hal ini yang menjadi problem Undang-Undang Pornografi ini adalah sejauh mana efektifitas undang-undang ini. Undang-Undang Pornografi ini berperan aktif dalam penindakan tindak pidana pada situs internet walaupun masih banyak kendala-kendala dalam penerapannya di dalam masyarakat. Peran dari Undang-Undang Pornografi ini adalah untuk memfilter suatu tindak pidana pornografi terutama pornografi internet Cyberporn agar terjadi batasan-batasan bagi pengguna situs internet agar tidak melakukan hal-hal yang berbau porno di suatu situs dunia maya yaitu internet. Dari hasil penelitian telah ditemukan data-data pengguna internet yang melakukan akses situs porno. Ironisnya semua pengguna internet pernah melakukan akses situs porno dari yang sekedar iseng sampai kebutuhan lainnya. Undang-undang ini tidak mampu menjangkau semua aspek pornografi di internet karena sifat dari internet yang selalu terupdate. Undang-undang ini dirasa lemah dalam penanganan masalah pornografi internet. Internet selalu terupdate sehingga modus-modus kejahatan yang timbul tergolong baru sedangkan undang-undang ini tidak ada perubahan tentang isi dari pasal-pasal yang ada.In the virtual world of the internet, information becomes something very important and really life. Data mobility is so fast and can be downloaded, produced, and then uploaded again. The internet network is one of the most popular information sources today. Many internet users access pornographic websites because these pornographic websites support the development of the internet. This criminal act is called Cyberporn. Given the enormous impact caused by pornographic acts, especially on internet sites, the government legalized the Anti-Pornography and Porno-action Bill into Pornography Act. In this case the problem of pornography law is how far the effectiveness of this law. This pornography law plays an active role in criminal prosecution on internet sites although there are still many obstacles in its application in society. The role of this pornography law is to filter out a crime of pornography, especially Internet pornography Cyberporn in order to make restrictions for users of internet sites to not do things that smell porn on a web site that is the internet. From the results of research there are internet data found by users who access porn sites. Ironically all internet users have access to porn sites from a mere fun to other needs. This law is not able to reach all aspects of pornography on the internet because of the nature of the internet is always updated. This law is perceived as weak in handling internet pornography problems. The internet is always updated so that the crime modes that arise are new while the law does not change the contents of the existing articles.

PERLINDUNGAN HUKUM TERHADAP AHLI WARIS YANG MEMPEROLEH WARISAN TANAH ABSENTEE Novery Aditya Fakhrizal

Waris merupakan permasalahan klasik yang dihadapi manusia sebagai subyek hukum, yang lebih menarik apabila warisan tersebut merubah hak milik yang seharusnya menjadi hak mutlak ahli waris menjadi absentee dikarenakan ahli waris tersebut berdomisili di luar kecamatan obyek warisnya tersebut. Hal ini diatur dalam Pasal 3 ayat (1) PP No. 224 Tahun 1961 jo Pasal 1 PP No. 41 Tahun 1964 yang menyatakan bahwa pemilikan tanah pertanian oleh orang yang bertempat tinggal di luar kecamatan tempat letak tanahnya dilarang. Oleh sebab itu ditetapkan, bahwa pemilik tanah pertanian yang bertempat tinggal di luar kecamatan tempat letak tanahnya tersebut wajib mengalihkan hak atas tanahnya kepada orang lain di kecamatan tempat letak tanah itu atau pindah ke kecamatan letak tanah tersebut kecuali jarak kecamatannya berbatasan antara pemilik dan tanahnya, sehingga masih dimungkinkan untuk mengerjakan tanah tersebut secara efisien sehingga produktivitasnya bisa lebih optimal. Ratio legis diberlakukannya peraturan pemerintah mengenai larangan kepemilikan tanah absentee di Indonesia didasarkan pada beberapa faktor, diantaranya faktor efektifitas dan faktor keadilan, sedangkan apabila perolehannya melalui waris, maka aturan mengenai absentee tersebut dapat menghilangkan hak waris.The question of inheritance is a classic problem faced by humans as the subject of law, which is more interesting if the inheritance changes the right of property which should be the absolute right of the heir to be absentee because the heirs are domiciled outside the subdistrict of the heirs object. This is regulated in Article 3 paragraph (1) of PP 224 of 1961 jo Article 1 of Government Regulation no. 41 of 1964 which states that the ownership of agricultural land by persons residing outside the sub-district where the location of the land is prohibited. Accordingly, it is stipulated that the owner of agricultural land residing outside the sub-district where the land is located shall transfer the right to his land to another in the sub-district of the land or move to the sub-district of the location of the land unless the distance of his sub-district is adjacent to the owner and the land, It is still possible to work the soil efficiently so that its productivity can be optimized. Ratio Legis of the enactment of government regulations regarding the prohibition of absenteeism in Indonesia on several factors, risk factors and factors of justice, while the requirement of inheritance, the requirement of absenteeism can eliminate one’s inheritance rights.

Indonesia is a country which most of the population is islamic, so of course in the life of the economy should be based on existing principles of sharia. At present, it must be admitted that the principles of sharia have grown in various fields of economy, including Banking, Insurance, and Capital Markets. However, in the Capital Market, although some of its instruments have been found in the Capital Market, the redulation is very minimal. This research is aimed at assisting Financial Services Authority in implementing Roadmap of Sharia Capital Market starting 2015 to 2019 to find a concept of Capital Market Law in accordance with Sharia Principles, so that Sharia Principles can be applied in isolation and different from Market Law regulation Conventional Capital that has been done. Research is a normative juridical research because it focuses on the rules of legislation using empirical data. The approach used is the approach of legislation and concept approach. Sharia Capital Market is a place for investors and emitents whose business field is not contrary to Sharia principles to conduct buying and selling activities in a way that uses the principles of sharia. The implementation of Sharia principles in Shariah Capital Market is in the business field of issuers, contracts used, and there are also arrangements related to Sharia Capital Market Experts.
