Abstract

Artikel ini bertujuan untuk sekadar memberikan pemahaman tentang ketimpangan dan peran gender yang telah terjadi di bidang politik (lembaga legislatif dan eksekutif) di Indonesia dan Bali. Data yang berhasil dihimpun menunjukkan, bahwa terjadi ketimpangan gender yang mencolok dalam arti wanita jauh tertinggal dari pada pria di bidang politik (lembaga legislatif dan eksekutif), baik di tingkat nasional, provinsi Bali maupun di tingkat kabupaten/kota di Bali. Ketimpangan gender yang menonjol tersebut, membawa implikasi yang khas berkenaan dengan peranan wanita yang jauh lebih rendah dari pada peranan pria di bidang politik.

Abstract

This study aims at finding out the jurisprudence development on the effect of divorce toward the status of mutual property in the marriage (gunakarya). The study is conducted by using normative approach that is to study the judge decision at Denpasar Court of First Instance that related to the mutual property dispute. Results of the study indicate that the judge decision (jurisprudence) on the effect of divorce toward the status of mutual property has experienced some depelovment. In the past (in the period of Kertha Raad Custom Court), the status of mutual property after divorce was judged based on the guilty one in the divorce. If the divorce was caused by guiltiness commited by the wife, the mutual property was shared together with 1/3 for the wife and 2/3 for the husband. Recently the judge decisions (jurisprudence) have changed, namely if there is mutual property dispute after the divorce the Court always decides that the mutual is shared equally (? : ?) between the (former) husband and the (former) wife without considering who is the guilty one in the divorce. This normative study needs to be continued with emprical study so that the status of mutual property after the divorce can be indentified if the mutual property dispute is settled outside of the Court.

Abstract

Female migrants from the research location ? a poor village in the regency of Karangasem ? do not come from landless households (average hausehold property is 0,75 ha) and their families live in a (semi) permanent house. The main push factor that makes women migrate is the infertility of the dry soil and the lack of job opportunities outside the agricultural sector. The womwn primarily migrate to Gianyar, Denpasar and even as far as Surabaya to increase their income (57,5%) or household welare (25%). Consequently the largest part of household income comes from economic activity outside agriculture (78,9%). The womwn to go the city either because encouraged to do so by relativesm friends, or a broker, and a few go on their own initiative

Abstract

This reserch aim to find out and to what extent socio-demographic factors as well as pre and post delivery activities both separately and simultaneously are correlated with infant and child mortality. It furtherseeks to discover from the factors observed which of them has the most dominant correlation with infant and child mortality. The step taken to achieve the above aim is ti find the correlation index between the mother?s level of education, her age when giving birth, spans between childbirth, frequency of childbirth, pre and post delivery activities and incidence of infan and child mortality by using logit regression. The correlation index (r) and determination index(R) indicates the extent of the correlation and the contributing of the observed factors to infant and child mortality.The result of the reserch are as follows: the mother?s age when giving birth, spans between childbirth, pre and post delivery activities are most correlated with infant and child mortality.

Abstract

A sample of 50 famele respondents in the age group 18-50 years in the city of Denpasar, shows that dominant factors considered as causes for extra-marital affairs are disharmony between the spouses, as well as economic, social and psychological factors. More than 50% of the respondents condemn their spouse for having an affair, but they prefer to forgive their patner instead of seeking a divorce.

Abstract

The national government of Indonesia is committed to legal gender equality by the 1945 Indoensia Constitution, article 27 (1), and the ratification of the Convention for Elimination of all forms of Discrimination Against Women (CEDAW) in 1984. However, customary law still prevailing in many regions in Indoneia often perpetuates deeply rooted discrimination based on gender until today. Examples of such discrimination are to found in Minagkabau, Java, and Bali where inheritance is regulated by gender biased customary law. Appropriate development policies and education may bring about a legal culture and practice that upholds legal gender equality.
