Abstract

This research is aimed at examining the socio-economic impact of local communities due to the policy of closing Puncak Sosok carried out by the government at the beginning of the covid-19 pandemic and analyzing the enactment of the new normal tourism business activities of Puncak Sosok. This research uses a socio-legal research approach that combines normative research (legal text studies, legal norms) and empirical research (non-legal science approach). Meanwhile, the research method used is a qualitative research method with data collection techniques in the form of interviews and observations with a research period from May to November 2020. Furthermore, the data is described in an analytical descriptive manner. The results showed that local communities were socio-economically affected by the closure, seen from changes in people's mindsets, changes in the way people interact and communicate, communities lost sources of income, reduced income turnover and changes or shifts in livelihood sources. In addition, the enactment of the new normal tourism business activities of Puncak Sosok after three months reopened was colored by various forms of easing of health protocol rules by puncak sosok managers. Penelitian ini ditujukan untuk mengkaji dampak sosial ekonomi masyarakat lokal akibat kebijakan penutupan Puncak Sosok yang dilakukan oleh Pemerintah di awal pandemi covid-19 dan menganalisis pemberlakuan new normal kegiatan usaha pariwisata Puncak Sosok.enelitian ini menggunakan pendekatan penelitian socio-legal yaitu mengkombinasikan penelitian normatif (studi teks hukum, norma hukum) dan penelitian empirik (pendekatan ilmu non-legal). Sementara, metode penelitian yang digunakan adalah metode penelitian kualitatif dengan teknik pengumpulan data berupa wawancara dan observasi dengan jangka waktu penelitian dari bulan May hingga November tahun 2020. Selanjutnya, data tersebut diuraikan secara deskriptif analitis. Hasil penelitian menunjukkan masyarakat lokal terdampak secara sosial ekonomi dengan diberlakukannya penutupan, terlihat dari perubahan pola pikir masyarakat, perubahan cara berinteraksi dan komunikasi, hilangnya sumber penghasilan, berkurangnya omzet pendapatan dan terjadi perubahan atau pergeseran sumber mata pencaharian. Selain itu, pemberlakuan new normal kegiatan usaha pariwisata Puncak Sosok setelah tiga bulan dibuka kembali diwarnai berbagai bentuk pelonggaran aturan protokol kesehatan oleh pengelola Puncak Sosok.

Abstract

This article aims to determine the principles and regulations of international trade and to analyze the regulation for imposing security measures on imports of fabric products. The method used in this study is a normative juridical legal research type, with a statutory approach or statute approach to analyze legal issues. This research finds that the principle of International Trade adopted by the Indonesian state/Government is essentially aimed at protecting domestic products to maintain a healthy trade climate. International Trade is regulated by General Agreement on Tariffs and Trade, General Agreement on Trade in Services, The Agreement on Trade-Related Aspects of Intellectual Property Rights and Dispute Resolution of the World Trade Organization. Furthermore, in regards to the imposition of security measures on the import of fabric products in Indonesia, it is regulated in the Minister of Finance Regulations and its amendments. However, the Ministerial Regulation felt to be contradictory to the Minister of Trade’s Regulation. So, it is considered less effective because it will only burden local entrepreneurs/companies who need material products from abroad, on one hand the volume of imports has been limited and on the other hand there is an additional imposition of import duty as a result of security measures.

Abstract

Market manipulation in the capital market in Indonesia is only regulated in several articles in the Capital Market Law, so there are no clear rules regarding this matter. This study aims to identify and analyze market manipulation arrangements in the capital market in Indonesia and in several countries. The research method used in this study is a normative research method with a statutory approach, a conceptual approach and a comparative approach. The results of this study explain that in Indonesia regulations regarding market manipulation are only regulated in the Capital Market Law and there is still a blurring of norms regarding the phrase pseudo-description in these provisions. Market manipulation arrangements in the capital market are regulated in several countries, namely Australia and European Union countries where these regulations regulate more clearly regarding market manipulation in the capital market in these countries. Manipulasi pasar dalam pasar modal di Indonesia hanya diatur dalam beberapa pasal dalam Undang-Undang Pasar Modal, sehingga belum ada aturan yang jelas terkait hal tersebut. Studi ini bertujuan untuk mengetahui dan menganalisis terkait pengaturan manipulasi pasar dalam pasar modal di Indonesia dan di beberapa negara. Metode penelitian yang digunakan dalam studi ini adalah metode penelitian normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan komparatif. Hasil studi ini menjelaskan bahwa di Indonesia pengaturan tentang manipulasi pasar hanya diatur dalam Undang-Undang Pasar Modal dan masih ada kekaburan norma terkait frasa gambaran semu dalam ketentuan tersebut. Pengaturan manipulasi pasar dalam pasar modal diatur di beberapa negara yaitu Australia dan Negara Uni Eropa yang mana pengaturan tersebut mengatur lebih jelas terkait manipulasi pasar dalam pasar modal di Negara tersebut.

Abstract

Marriage law in Indonesia is a law based on God. This divine basis is applied in Article 1 of Law Number 1 of 1974 on Marriage that marital relations are based on the belief in the One and Only God. In practice, this is overlooked when it comes to law enforcement in court applications. The waiver has the potential to occur if it is related to interfaith marriages/marriages between religions and beliefs in court, lack of public knowledge, or is considered a violation of the right to marry. Remembering that marriage is one's privacy. This article aims to analyze the transcendental principle in Law Number 1 of 1974 on Marriage and to elaborate the enforcement of the transcendental principle in court. This article uses the methodology juridical and normative research, which means that research is using principle of law and doctrine to answer the legal issues. This results show that the practice of transcendental principle is the nature of God Almighty, so every marriage must be based on this principle. Another finding, there are attempts to change this principle through judicial review but are always rejected by the court in Constitutional Court. Transcendental principle has not been able to answer the needs of each society individually. It is because there are still people who ignore this principle.

Abstract

The objective of this research is to explore the regulation of freedom of opinion and expression under international law and its implementation within the context of Russia's national law, particularly in relation to the Russia-Ukraine war. The study aims to examine and analyze the justifiability of the current restrictions imposed by Russia under international law and whether they align with the established criteria. According to General Comment No. 34, freedom of opinion should not be subject to limitations during an emergency, whereas freedom of expression may be restricted under specific conditions outlined in the Siracusa principles. These conditions encompass the requirement for restrictions to be based on clear and accessible laws, serving legitimate purposes, and implementing measures that are proportionate to protect the relevant interests. Through normative legal research methods utilizing statutory, case, and factual analysis, along with a conceptual/analytical approach, this paper concludes that freedom of opinion and expression are safeguarded and their limitations are determined as outlined in the ICCPR. As a result, Russia's actions in curbing freedom of expression do not align with the principles of international law. Penulisan ini memiliki tujuan untuk mengetahui bagaimana pengaturan kebebasan berpendapat dan berekspresi berdasarkan hukum international serta bagaimana pengaturannya dalam hukum nasional Rusia di tengah perang yang terjadi antara Rusia dan Ukraina. Tulisan ini berupaya mengidentifikasi dan menganalisis ketepatan pembatasan hak berpendapat di Rusia menurut hukum internasional. General Comment Nomor 34 menyatakan bahwa kebebasan berpendapat adalah salah satu elemen, yang tidak akan pernah bisa dibatasi walau dalam keadaan darurat sekalipun. Hal ini kemudian berbeda dengan kebebasan berekspresi yang dapat di batasi apabila memenuhi secara komulatif syarat dari prinsip-prinsip siracusa, yaitu: Pertama, pembatasan wajib berdasarkan hukum yang dapat diakses dan tidak kabur. Kedua, pembatasan wajib memiliki tujuan yang sah. Ketiga, pemerintah wajib menetapkan pembatasan dimana merupakan limitasi yang serendah mungkin untuk melindungi kepentingan yang ada. Metode penelitian hukum normatif digunakan dalam penyusunan penulisan ini, dengan menggunakan pendekatan perundang-undangan, kasus, dan fakta, serta pendekatan konseptual/analitis. Tulisan ini menemukan bahwa kebebasan berpendapat dan berekspresi telah dilindungi dan ditentukan batasan-batasannya dalam ICCPR. Dengan demikian, tindakan Russia dalam membatasi kebebasan berpendapat dan berekspresi adalah tidak sesuai dengan kaidah hukum internasional yang berlaku.

Abstract

Traditional villages in Bali have the potential to become tourist destinations that benefit the local community. Culture and customs are what set apart traditional villages. The legal politics of the Bali tourist village have deteriorated into the new normal. This research aims to develop a tourist village model, a new theory for elaborating Balinese cultural values based on local wisdom values, a creative economy, and human resource management during the COVID-19 pandemic. The research method is a qualitative descriptive empirical legal analysis based on a socio-anthropological approach and law sociology, supplemented with cultural studies. The findings revealed that the value of local wisdom in the traditional village adds value to a tourist village in Bali. The Ceking traditional village's tourist rice terraces are appealing due to the culture of farmers becoming a tourist village. The Penglipuran traditional village's artistic potential, social capital, nature, and local wisdom are the codification of culture in power politics. Tourism is a helpful tool for economic development. Bali must explore the potential for increased innovation and community participation as a tourist destination by using traditional villages as a buffer for culture, Hinduism, and local wisdom. Furthermore, Bali tourism is exceptionally vulnerable to health concerns that affect tourism and ecotourism activities.
