Abstract

From the perspective of international law, indigenous peoples have the rights to own, use, and control their natural resources within their territories. In the United States, the Navajo Tribe has enjoyed those rights. In terms of law making process, this tribe can enact some acts to preserve a control over their natural resources. Specifically, the Air Pollution Prevention and Control Act, the Clean Water Act, and the Solid Waste Act. Concerning law implementation and enforcement, Navajo Tribe has a right to equitable benefit sharing in natural resources and fair court proceeding for breach. As a result, the existence of rights for natural resources requires the U.S federal government to ensure fair administration of natural resources in order to mitigate an economic exploitation of natural resources in indigenous land.

Abstract

There has been a concern over the adverse influence of globalisation on local culture. Trade and investment agreements have included cultural concern in their provisions.  Employing these provisions, countries initiated trade and investment-related measures to secure what they have presumed as cultural traditions and values. This article seeks to examine if the incorporation of cultural concern under trade and investment agreement is effective to reconcile the need for securing culture and the spirit of free trade and free flows of investment. This article is normative research, examining the existing cultural concern under trade and investment agreements, cultural-related measures of particular countries, and how the judicial bodies have responded these measures in their decisions. This article argues that the incorporation of cultural concern has triggered a wide range of cultural-related measures. Nevertheless, the decision of judicial bodies, to some extent, has been effective to shield the purpose of cultural concern, especially to avoid disguise or inefficient protectionism, and to admit the right of countries to protect or promote their cultural traditions and values.

Abstract

There have been some concerns over the existence of trade and investment agreements. They have been doubted because of the poverty and inequality issues in some regions across the globe. The rise of the spirit of national interest of their members has also exacerbated the situation. Hence, these two miserable facts may end up with a question whether Indonesia should keep joining trade and investment agreements. This article is aimed to examine if Indonesia should continue its participation in trade and investment agreements. Employing a normative legal research, this article put three parameters, analysing the continuity of Indonesia’s participation, namely the benefits of international trade and foreign direct investment, the rationale of trade and investment agreements, and how trade and investment agreements (that involve Indonesia) have positively affected Indonesia’s development. This article then claims that Indonesia should keep joining trade and investment agreements for realising its targets on economic growth and development.

Abstract

The existence of inequality and poverty in some countries doubted the contribution of the WTO. The overwhelming spirit of national interest through the imposition of discriminatory and protective measures has deteriorated the WTO. Given its role for enforcing trade commitments, the dispute settlement mechanism is crucial to save the future of WTO. This paper aims to analyse the existence of the dispute settlement mechanism of WTO, whether it is still supreme in upholding the vision of trade liberalization. This paper argues that the supremacy of this mechanism has ensured the future of WTO by looking at two parameters. Firstly, it has a ruled-based character with a high level of legalism. Next, by looking at the decision of the Panel and the Appellate Body, the dispute settlement mechanism has effectively controlled the overwhelming spirit of national interest. This mechanism shows its supremacy by limiting the capacity of the WTO member states to impose discriminatory and protective measures, particularly related to public morals exception and cultural concern.

Abstract

The proliferation of liberalisation has been historically generated by the establishment of World Trade Organisation (WTO). Services sector was comprehensively regulated by General Agreement on Trade in Services (GATS). Regionally, AFAS was initially established to bolster the objective of GATS. In inward looking perspective, AFAS has underscored the increasing participation of ASEAN member states through strengthening their domestic services capacity, efficiency, and competitiveness. In outward looking perspective, it was intended to eliminate progressively any restrictions and internal governmental regulations in the transaction of services whose impact eventually emerged trade harassment. As a legally binding sector under GATS and AFAS, tourism is moving invariably to be one of the most dynamic sector of economic activity in ASEAN. Hence, it has cardinal role for sustainable socio-economic growth and the diversity in cultures, economy, and the complementary advantages across the region. This paper attempts to identify, decipher, and analyse meticulously challenges and opportunities of AFAS on tourism referring four modes of supplying services under article 1 of GATS encompassing: cross-border supply, consumption abroad, commercial presence, and natural persons presence. Intrinsically, ASEAN member states need to be strengthened and focused in achieving the target of a free trade area in services on tourism by 2015 as a pathway of anticipating liberalisation of services on tourism globally.

Abstract

Sejumlah fakta menunjukkan bahwa Australia telah beberapa kali melakukan upaya penyadapan terhadap Indonesia. Secara umum diketahui bahwa tindakan penyadapan merupakan suatu tindakan pengumpulan informasi secara rahasia dalam hubungan diplomatik suatu negara. Penyusunan artikel ini dimaksudkan untuk menganalisis perlindungan hukum dan upaya hukum yang dapat ditempuh oleh Indonesia dalam kasus penyadapan. Tulisan ini merupakan penelitian hukum normatif yang menggunakan pendekatan peraturan perundang-undangan yang dalam hal ini menganalisis perjanjian internasional yang relevan, pendekatan kasus, pendekatan analisis konsep hukum, dan pendekatan perbandingan. Kesimpulan dari penulisan adalah tindakan penyadapan yang dilakukan oleh Australia terhadap Indonesia dilarang baik berdasarkan hukum internasional maupun hukum nasional kedua negara. Adapun bentuk upaya perlindungan hukum yang dapat dilakukan Indonesia adalah implementasi atas Code of Conduct on Framework for Security Cooperation serta pengajuan kasus ini ke Mahkamah Internasional.

Tulisan ini menggunakan penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan fakta. Tulisan ini akan menggambarkan kompetensi pengadilan dan kekuatan mengikat keputusan. Kesimpulan yang dapat ditarik melalui tulisan ini adalah SIAC memiliki kompetensi untuk menyelesaikan kasus Astro All Asia Networks Plc Beserta Afiliasinya dan Lippo Group yang keputusannya bersifat mengikat.

Abstract

Natural resources shall be considered as a highly essential element in an ecosystem. Each components of natural resources and its ecosystem shall be interdependent and its exploitation shall impacts adversely on twofold, thus, any deterioration shall also lead to the disruption of ecosystem. Hence, a means of conservation as a management tool of natural resources both in situ and ex situ is highly prerequisite. Pursuant to Law No 5 of 1990, such means of protection and conservation are regulated. This writing is composed by utilizing normative legal research and statutory approach in its methodology. It is expected that protection of conservation to be enforced in Indonesia to prevent breach of conduct from regulation stipulated which later triggered the application of penal sanction.

Abstract

This writing shall be entitled as “The Authority of The Constitutional Court on The Result of Local Election’s Dispute". With normative, descriptive, evaluation and legal argumentation research, combined with statutory approach in its composition, this writing shall dicuss the authority of Constitutional Court before and after the existence of Constitutional Court Decision No.97/PUU-XI/2013. Before the issuance, the Constitutional Court has the right to resolve the dispute on the result of regional election. But it’s unconstitutional since Local Government and General Election was organized in a different chapter. After that desicion, the Constitutional Court has no right to resolve the dispute. Alternative that can be taken is giving authority to the High Administrative Court to resolve the dispute by publishing laws immediately.
