Abstract

Paper that had the title: "Juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the Legal Protection for the Rights to be Eelected." This explores two issues: 1) how the legal protection of the settings selected in the state system of Indonesia ; 2) what are juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the legal protection for the rights to be elected. To solve both problems, this paper uses normative legal research methods. Approach being used is the statute approach, case approach, and a conceptual approach. Further legal materials collected were identified and analyzed using descriptive analysis techniques. Legal protection for the right to be elected in the state system of Indonesia can be traced from the 1945 opening, the articles in the body of the 1945 Constitution, Article 27 paragraph (1), Article 28D (1) and paragraph (3) and Article 28 paragraph (3) 1945 Second Amendment, MPR Decree Number XVII/MPR/1998, Article 43 of Law Number 39 of 1999, Article 21 of the Universal Declaration of Human Rights, and Article 25 of the International Covenant  on Civil and Political Rights. Discussion of the juridical implications of the Constitutional Court Decision Number 011-017/PUU-I/2003 on the legal protection for the rights to be elected have been included: a) only on the juridical implications of representative institutions no longer marked with specified requirements as stipulated in Article 60 letter g of Law Number 12 Year 2003 in Law Number 10 Year 2008; b) juridical implications of the political field for the right to be elected is the absence of any discriminatory treatment in legislative product formed by the House of Representatives and the President as well as products of other legislation forward.

Abstract

The purpose of this study is to analyze the implementation of Article 31 (2) of the Constitution 1945 concerning the right of education for citizens, especially in remote village of Bangli Regency, Bali Province. The type of this research is empirical legal research. The study showed that the Government has provided a central school in one building both for elementary and junior high school so called “Satap” (School in one roof) in order to fulfill its constitutional obligation for the people in slop of mountains in the remote village of Bangli Regency. For this efforts are  supported by education funding of the National Government distributes budget operational school (BOS), grants of educational facilities from Government Budget of Bali Province (APBD Bali) as well as  Block Grand from the National Government Budget (APBN). However, those budgets are still considered relatively very small. For the better implementation of the right of education, therefore the efforts of government need to be improved as well as budgeting for the remote village should be prioritized, increased and supervised

Abstract

The scientific paper entitled fingerprint role in uncovering criminal investigation at Polda Bali. The method used is the method of empirical research with normative and empirical approaches, legal materials used are the primary legal materials do research at Polda Bali and secondary legal materials using literature and official documents. The investigation by the police is to obtain the truth based on actual facts. One of the investigation conducted by the police using fingerprint identification. Fingerprints have two properties namely latent fingerprint and a real fingerprint. Methods fingerprints obtained by gathering evidence at crime scenes. But the weakness of the fingerprint that is easily damaged and quickly disappear, therefore the police must stand guard the crime scene in order to collect fingerprint evidence.

Abstract

Bali Province is a province that relies on regional revenue in the tourism sector. Equitable development between North Bali South Bali require assistance through the form of government policy. One of the Bali provincial government policy is to break the waves of tourists is to build the port infrastructure development of tourism. Theory authority and policy concepts used to solve the problems concerning the form of government policy in the Bali Provincial Tourism Port infrastructure development as the carrying capacity of tourist distribution in promoting tourism in Bali. Normative research used in analyzing problems of government authority between state-owned enterprises and local goverment in accordance with regulations Indonesian republic. Explores the principle of decentralization adopted by the government system in Indonesia with a delegation of authority from the central government to local governments. Tourism ports is essential to be realized as one of the factors of sustainable tourism in Bali.

Abstract

The problem that there is a contradiction between the article 110 (1) C Undang-Undang Republik Indonesia number 28 year 2009 which is decisive that there is a contribution in the case of reimbursement cost of printing identification cards and article 79A Undang-Undang Republik Indonesia number 24 year 2013 on Residential Administration which prohibits any retribution on getting and issuing residential document. The study method employed in this study including kind of normative law study and the approach methods used are: law approach, history approach an conceptual approach. The conclusions are: considering that there a contradiction between the article 110 (1) C Undang-Undang Republik Indonesia number 28 year 2009 should not be in practiceany longer. Another conclusion is that the decree of the Majelis Madya Desa Pekraman Number : 14/12-SK/MMDP/VII/2014 in which arranged the management of incoming residents are to pay contribution when they apply for KIPS and STPPTS, is contradictory with Undang-Undang Republic Indonesia Number 24 year 2013 particularly article 79A, because the mentioned Undang-Undang is higher in position than the mentioned decree.

Abstract

Regional Innovation is an important factor to encourage competitiveness and prosperity in the region. Innovation is a collaborative process to improve effectiveness and efficiency in the Region. Innovation cannot run sporadically and partially, particularly at the level of regulation and governance. Reflection on experience shows, government apprehensive to innovate in the Region. Criminalization of policy, euphoria of corruption eradication causing poor innovation in the Region, so it should be given the rule that provides the flexibility to innovate without diminishing accountability or in formulating innovation policy, should be based on the principles in the running of innovation. Through the juridical analysis of substance of the Law 23/2014, have been set related to regional innovation. There is the possibility of expanding the activities of government, with narrowing of the risk of criminal prosecution.

Abstract

The study describes the overlap of arrangements of administrative sanctions in the Law No. 12 of 2011 with the construction of administrative sanctions in the Local Regulation of Bali Province No. 2 of 2012. The arrangements of administrative sanctions according to Law No. 12 of 2011 are stipulated in appendix II number 64 which stipulates that the substance in the form of administrative sanctions or civil sanctions for the violation of these norms are formulated into one part (chapter) with the norms that impose administrative sanctions or civil sanctions, and in appendix II number 65 which regulates if there is more than one norm that provides administrative or civil sanctions, administrative sanctions or civil sanctions are formulated in the last chapter of the section. Thus, it does not formulate the provision of sanctions that also contains criminal sanctions, civil penalties and administrative sanctions in one chapter. The arrangements of administrative sanctions in the Local Regulation of Bali Province No. 2 of 2012 are stipulated in Chapter XIV of Article 33 paragraph (1), (2), and (3), thus it is contrary to the provisions of Appendix II of Law of the Republic of Indonesia Number 12 of 2011 numbers 64 and 65.

Abstract

Legal writing on the authority of the commission is entitled to the prosecutor's duty to carry out supervision authority specifically to the public prosecutor. The background of the writing of this law is the increasing distrust and dissatisfaction of the public on the performance of law enforcement agencies and institutions secaara public prosecutor's office in particular. The method in this research is using normative where in the writing of this law into the background issues penelituan is going to commissions and the prosecutor in the line of duty to supervise the performance of the public prosecutor and what are the constraints commission prosecutor in supervision where the constraint is divided into two parts: internal constraints and external constraints. In the study found that in order to carry out the process of supervision of the public prosecutor, the prosecutor commission can not directly supervise, why is that? this is because there is an internal watchdog in the body prosecutor who take a stand if there is a public prosecutor alleged violation. Constraints of commission prosecutor in carrying out the control can be internal constraints such an evil do not want sightings of the prosecutor who was in trouble, while the external constraints such as obstruction by certain groups who want to impede the work of the commission prosecutor. Therefore let fungis of the prosecutor commission is enforced to match the function of other commissions in Indonesia is the role bgitu stand out and let people participate in helping carry out the task of the prosecutor's commission.
