Abstract

Hazairin is one of the pioneers who initiated the importance of  Islamic  law  with  Indonesian  pattern.  Even,  he  viewed  the importance  of  the  new  school  (mazhab)  in  Islamic  law,  namely  the Indonesian  mazhab. However, Hazairin’s thought on the methodology of ijtihad, as a basis for the establishment of a school of Islamic law, has not  been  widely  studied.  His  thought  which  was  more  studied  is  the idea  of  the  Indonesia  mazhab and  also  about  inheritance  law.  This article  specifically  explores  the  framework  of  Usul  Fiqh  proposed  by Hazairin. Epistemologically, the main topic of Usul Fiqh is about the sources of Islamic law and the method of how to formulate Islamic law from  the  source.  Therefore,  this  article  examines  Hazarin’s  thought about the two things, namely the sources of Islamic lawand its legal formulation method. From the study done, both on the  sources of law and Islamic law formulation method, Hazarin put the role of ulu al-amri (government, policy  makers)  in  a  strategic  position.  The  method  of legal formulation done by  ulu al-amrirequires  musyawarah(discussions), which  involves  jurists  and  other  relevant  scientific  experts  (collective ijtihad).  Results  of  ijtihad decided  by  ulu  al-amri will  automatically become binding formal rules of law, so that if the resultsof ijtihad is followed  and  practiced  by  the  public  widely,  it  will  become  a new school of Islamic law, namely the Indonesian mazhab.

Abstract

Religious  institutions  looked  having  an  important  role  in responding a violence, especially for women at domestic violence. It is because  our  understanding  that  any  religion  has  never  agreed  and received any kind of violence. However, time has changed, campaign and gender  mainstreaming  has  been  actively  issued  by  the  government  and non  government  organizations.  Therefore,  the  interpretation  of  the devine  text  by  the  religious  leaders  has  also  shifted.  This  article elaborates  the  role  and  paradigm  shift  in  the  religious  institutions  in anticipating and rehabiliting domestic violence in Yogyakarta.

Abstract

The existence of substitute heir still causes polemics either in the side of its derivation or in its validity.The substitute heir in KHI is formulated through yurisprudence which is taken from customary law. The substitute heir in customary law is an adoption of civil law (BW) of Dutch derived from Code Civil Napoleon in French. French’s civil law was born of romen’s law.The substitute heir develops toovercome the matters partaining to inheritance either in the level ofheir, traditional deliberation,  or  judicature  institution.  The substitute  heir  is  a  culture which is not based on faith, contrary to judicature principle, ijbari basic, not accordance with the elements pertaining inheritance  and it is also contrary  to  superiority  and  hijab  principle.  Therefore,  it  needs  to review.

Abstract

Change  is  sina  qua  none  in  life.  Fiqh  respond  to  changes with the tools that have been prepared. Rigid nature onthe one hand and bending on the other side of the fiqh made itelastic in the face of various  changes.  No  wonder  if  the  views  of  fiqh  changing  following the  change  of  date  and  place  (salihun  likulli  zaman  wa  makan). Precisely there, fiqh finds himself as the legal formulationthat always compitable with all space and time.

Abstract

The  rejection  of  unjustice  exploitation  to  natural environment  is  central  theme  of  green  constitution,  green  economic, and  sharia  economic  law.  The  problems,  how  do  comparison of essence and implementation between one and others. In  this paper is used study method in law normative. There are two important findings. First, the similarity of essence of green constitution, greeneconomic, and sharia economic law is focus on environment justice (eco-justice). The  differences,  environment  justice  under  perspective  of  (a)  green constitution  means  natural  environment  has  to  be  welfare  of  people, (b) green economic means natural environment is part of production, distribution,  and  ethical  consumption,  and  (c)  sharia  economic  law means  give  the  right  for  future  generations  to  enjoy  natural environment. Second, the similarity of implementation challenge faced by  three  concepts  is  inconsistention  of  law.  The  differences, inconsistention of law faced by (a) green constitution isinconsistension of environments Act with 1945 Constitution, (b) green economic is the loss  of  unlawfull  meaning  of  lawful  term  (c)  sharia  economic law  is systemic disobedience by sharia corporation to sharia principles.

Abstract

In  this  article,  the  writer  investigates  the  possibility  of  the existence of the notion of legal norm hierarchy in IslamicLaw through analysing several key concepts such as  hukm shar’i(detailed legal rule), asl kulli  (general principle),  qaidah fiqhiyyah  (legal maxim), and  kulliyyat (universals). The writer comes to the conclusion that itis possible to say the Islamic law knows the hirarchical structure of legal norms, but not  in  the  formal  sense  of  the  term,  rather  much  more  in  the substansial  one.  This  means  that  every  legal  norm  in  Islamic  Law  is based on a higher norm, but this higher norm does notfunction as a norm  which  formally  autorizes  its  making,  but  forms  a  source  from which it can be drived.

Abstract

Leasing  agreement  is  a  mixture  of  agreements  on purchasing,  selling,  and  renting.  In  leasing,  when  a  buyer  can’t  buy goods in cash, then the agreement is held in which the buyer is allowed to  repay  with  several  installments.  The  goods  will  be  owned by  the buyer by the time the installments have been paid. Duringthe payment of installments, as long as it is not paid completely, the  buyer is still a tenant. As a tenant, the buyer is only allowed to take  advantage of the goods  and  does  not  have  the  right  to  transfer  the  goods  to another person.  If  the  transfer  term  is  broken  before  the  payment  of installments is completed, then the buyer will be subjectedto criminal accusations because he/she makes the others’ property lost. Then, the leasing  agreement  here  is  likely  to  lead  to  a  form  of  a  purchase agreement rather than of a renting, for the main point is all about the transfer of property rights. The different status over the ownership of goods  will  also  have  different  legal  consequences.  In  terms  of purchase, a buyer becomes the owner of the goods, which makes him feel free to do over the things possessed, such as leasing them as rental, mortgage, and so on to another party. In terms of leasing, whereas the buyer  has  not  become  the  owner  of  the  goods,  he  could  not  act lawfully  over  them.  While  Islam  has  the  basic  law  upon  leasing agreement, it is necessary to implement this law in leasingagreement towards the Indonesia Civil Code.

Abstract

The  essence  of  siyasah  is  the  management  of  the  umat`s affairs  by  the  government  based  on  akhlak.  Siyasah  held in  certain territory  and  particular  political  contract  anyway.  The  aim  is  to establish the religion and maintain worldly affairs towards the common maslahah.  In  the  discourse  of  history,  the  responses  to  siyasah  are different.  There  are  who  regard  siyasah  as  the  cause  of  Muslim`s stagnation, but the others assert siyasah as the foundation, pillar, and moral  to  regulate  state  and  government.  The  discourse  of  siyasah  in Jews and Islam are the real examples of these responses.

Abstract

This  article  explores  the  reaction  to  and  criticism  of  the reform  aspects  introduced  in  the  kompilasi  which  have  arisen  among Indonesian Muslim, the ulama of two biggest Muslim organizations in particular and the legal apparatus and scholars. It addresses the issue by looking at specific questions relating to the rationales ofthe reforms. Deploying  socio-historical  legal  approach,  it  displays  the  reform aspects, the arguments and the tendency in their criticism and debate, as well as the key concepts and interpretations of Islamthey have used. It argues that these ‘ulama have distinct and differentways of looking at the reforms, which is intersected with the general attitude of these two organizations in deducting the laws of Islam. Thisarticle stresses that  the  reforms  have  always  not  been  accepted  in  their  whole  by Muslim  society  and  that  the  Islamic  rationales  of  the  reforms  have often  been  deemed  inappropriate,  demonstrating  in  this  sense  the harsh debate between the use of fiqhand Qur’anand between the use of Islamic classical law and the incorporation of  adatlaw as their sources and bases. Further it shows that, although the proposal of reforms was proclaimed  to  be  based  on  the  societal  growing  needs  and demands, they remained to be objects of criticism and debates from such certain groups of Muslims and legal apparatus who argued to also base their criticism on the needs of society.

Abstract

This study aims to demonstrate the reorientation toward the national  development  policy  of  quantitative  macro  size  (growth) towards  a  more  qualitative  measure  (happiness).  The  test  results  of multiple  linear  regression  on  the  variable  value  of  public  happiness index  in  each  province  of  Indonesia  with  variable  poverty, income inequality  and  income  per  capita  shows  quite  interesting  results. Apparently, only the poverty variable has significant negative effect on the  happiness  index.  This  means  that  poor  people  in  Indonesia  who have  limitations  in  various  aspects  of  life  feel  the  lowest  levels  of happiness. Another interesting finding is that income and the income gap does not significantly influence the level of happiness of society. Therefore,  the  government  needs  to  pay  more  attention  to  various aspects  such  as  the  quality  of  family  life,  social  and  various  other aspects.
