Abstract

Tulisan ini membahas bagaimana fikih Indonesia diformulasikan. Gagasan fikih Indonesia yang secara akademik pertama kali disampaikan oleh T.M. Hasbi as-Shiddieqy bergerak dari apa yang disebut living laws menjadi positive laws. Diskursus fikih Indonesia yang lahir di Indonesia merupakan bentuk fikih yang bergumul dengan problem realitas masyarakat Indonesia seiring dengan pertumbuhan dan perkembangan negara dengan jumlah penduduk muslim terbesar di dunia. Tidak mengherankan jika dalam konteks fikih Indonesia lahir berbagai domain fikih kontemporer seperti fikih lingkungan, fikih sosial, fikih pluralisme, fikih perempuan, dan lain sebagainya. Melalui tiga periode, yaitu periode perintis, periode pembentukan, dan periode taqnin, fikih Indonesia yang berbasis kontemporer dan merupakan living laws ini selanjutnya dinaikkan statusnya menjadi positive laws yang bersifat mengikat pada seluruh masyarakat muslim di Indonesia.

Abstract

Campus sexual violence is a pervasive issue affecting institutions worldwide, with a concerning upward trend in reported incidents. This article scrutinizes legal policies and the efficacy of collaborative governance in mitigating this pervasive problem. The model of collaborative governance, a globally recognized legal policy approach, is at the heart of this study. Utilizing socio-legal research methods, the article employs comparative legal and conceptual legal approaches, drawing from secondary literature sources. The study reveals that the implementation of legal policies and collaborative governance can significantly curb campus sexual violence in Indonesia. This can be achieved by actively engaging both academic community and the wider public. By drawing lessons from countries such as the United States, the Netherlands, Canada and the United Kingdom, Indonesia can replicate their success in reducing campus sexual crimes. These measures include the creation of legal policies, establishing partnerships with central and local governments, and fostering collaborative governance. Key initiatives that have proven effective in these countries include the development of service guidelines that prioritize victim and survivor protection, amplified anti-sexual violence campaigns on campuses, and the promotion of sexual violence awareness education. The establishment of a National Campus Sexual Assault Commission to evaluate the enforcement of educational ministerial regulations and religious affairs ministerial regulations in preventing and addressing campus sexual violence is also recommended. This article offers valuable insights for policymakers in their efforts to devise effective legal strategies to prevent sexual violence on campus.

Abstract

Implementasi pengaturan kehidupan berkeluarga adalah perwujudan dari keinginan norma hukum agar pengendalian dalam kehidupan berumah tangga dapat terealisasi dengan baik. Ketika pemberlakuan aturan dilaksanakan dengan baik, sejak itu pula hukum berbaur dalam kehidupan masyarakat. Demikian pula sebaliknya, kalau pemberlakuan hukum tidak dijalankan dengan baik maka secara otomatis norma hukum pun tidak menyatu dalam kehidupan masyarakat. Mengingat modernisasi pada ranah hukum keluarga sudah banyak dilakukan, maka penelitian ini berusaha untuk menganalisa apa saja aspek yang mempengaruhi modernisasi hukum keluarga yang ditinjau dari yuridis dan sosiologis. Penelitian ini menggunakan studi kombinasi antara penelitian normatif dan empiris. Hasil dari pnelitian ini yakni pertama, modernisasi hukum keluarga dalam analisis sosiologis ditemukan beberapa aspek yang dapat mempengaruhinya antara lain yakni: aspek kekerabatan, kemudian aspek pendidikan, aspek keilmuan, aspek politik. Kedua, aspek yuridis dalam pembaharuan hukum yang dalam hal ini memenuhi beberapa poin sebagai berikut: Konsistensi asas-asas atau prinsipnya, Sebagaimana dalam regulasi hukum keluarga proses pembentukannya memang telah memerhatikan asas lex superior derogate legi inferiori yakni kesamaan hak dalam UUD 1945, sehingga UUP No 16/2019 menyamakan usia perkawian pria dan wanita. Kemudian proses perumusannya, perumusan adanya pembentukan UUP terbaru dikatakan demokrasi, juga dikatakan otoriter. Kemudian tingkat kemampuan hukum dalam operasionalisasinya, dalam modernisasi hukum keluarga yang dibuktikan terakhir kali adanya UUP No 16/2019 masih belum efektif di kalangan masyarakat.

Abstract

Change  is  sina  qua  none  in  life.  Fiqh  respond  to  changes with the tools that have been prepared. Rigid nature onthe one hand and bending on the other side of the fiqh made itelastic in the face of various  changes.  No  wonder  if  the  views  of  fiqh  changing  following the  change  of  date  and  place  (salihun  likulli  zaman  wa  makan). Precisely there, fiqh finds himself as the legal formulationthat always compitable with all space and time.

Abstract

Early marriage is currently a significant concern in developing countries, such as Indonesia. Attention has been directed towards the causes and effects of the high prevalence of early marriage. Various government agencies, community leaders, traditional leaders, and religious leaders have implemented efforts to prevent early marriage; however, these initiatives have not succeeded in significantly reducing its incidence. This study examines the social phenomenon of a Kyai in Lamongan Regency, East Java Province, Indonesia, who plays a pivotal role as a religious figure in the prevention of early marriage. This research adopts a qualitative methodology employing field research methods. Primary data sources were obtained from relevant agencies in Lamongan Regency, the Kyai as an actor, santri (Islamic students), parents of santri, and the broader community. Data collection was conducted through structured interviews, participatory observation, and documentation. The research data were subsequently analysed using functional structure theory and Islamic law, particularly focusing on the aspect of maslahah (public interest). The findings of this study indicate that the role of the Kyai as educators and charismatic religious figures has positively impacted the reduction of early marriage rates in Lamongan. Furthermore, the social role of the Kyai is inextricably linked to their position as figures who encourage the community to foster a conducive environment for the development of the younger generation. The strategies devised by the Kyai include the design of a curriculum that encompasses material on marriage, the provision of guidance to the guardians of Islamic boarding school students, and the organisation of religious lectures for the general public. This study presents a functional structure model that operates effectively and advocates for local governments to optimise the role and function of the Kyai in the prevention of early marriage in Indonesia.
