Abstract

The  essence  of  siyasah  is  the  management  of  the  umat`s affairs  by  the  government  based  on  akhlak.  Siyasah  held in  certain territory  and  particular  political  contract  anyway.  The  aim  is  to establish the religion and maintain worldly affairs towards the common maslahah.  In  the  discourse  of  history,  the  responses  to  siyasah  are different.  There  are  who  regard  siyasah  as  the  cause  of  Muslim`s stagnation, but the others assert siyasah as the foundation, pillar, and moral  to  regulate  state  and  government.  The  discourse  of  siyasah  in Jews and Islam are the real examples of these responses.

Abstract

Epistemologi ushul fiqh merupakan teori ilmu hukum yang dibangun untuk mengkreasi diktum-diktum fiqh yang amat diperlulan untuk tatakelola kehidupan ummat manusia sehari-hari. Epistemologi ini mula-mula dibangun oleh al-SyafiI pada abadke-2 hijriyah untuk merespons alotnya perdebatan hukum antara kalangan ahl al-ray dan ahl al-hadith saat itu. Dengan hadirnya epistemologi ini maka setiap perdebatan menyangkut hukum dalam Islam bisa dibingkai secara akademik karena dapat merujuk pada kajian teori tertentu. Struktur ilmu ushul fiqh memadukan unsur teks normatif berupa wahyu verbal di satu pihak dan logika formal di pihak lain. Dengan struktur seperti ini tidak sedikit kalangan menganggap bahwa ilmu ini merupakan falsafah Islam faktual yang berfungsi mengawasi kehidupan manusia yang senantiasa beraktivitas di muka bumi. Tujuan ilmu ushul fiqh adalah memunculkun ketentuan hukum agar manusia tidak menyimpang dari fitrahnya dan terseret ke dalam berbagai ketimpangan. Karena itu, pemberdayaan ilmu ini secara optimal dan proporsional diyakini dapat memaksimalkan proses istinbath al-ahkam yang dapat berimplikasi pada dinamika hukum Islam sesuai tingkat perubahan masyarakat.

Abstract

Customary and Adat law is one of the directional tool in determining attitudes and behavior within the limits that have been justified by customary law. The aim in this paper is to examine the legal basic, the principles and objectives Indigenous justice, structure and scope of responsibilities of Indigenous leaders, and enforcement of Indigenous justice. The methode used in this paper are normative and empirical legal research. Legal dispute settlement arrangements in the Aceh Indigenous Judiciary 4th sila Pancasila and this has been recognized by the National Law of Indonesia. Customary justice aims to create balance and peace in society, protecting the rights of victims of crime and people can live in harmony back disputing. The device consists of a village justice element of village government, scholars, intellectuals and other traditional leaders. The implementation of the decision by Keuchik done in a ceremony set at a time mutually agreed.

Abstract

afs?r al-Qur?n al-A??man exegete Ibn Kathirs work. Feature is that the sharpness of analysis in reviewing the problems associated with the interpretation of the verses of the Koran. Differences of opinion are clearly presented, and then criticized the arguments put forward strong and defensible. The language is very easy to understand. Ibn Kathir using bi al-matsur. he was very careful and did not stick to the liberal and verses of the Koran, hadith, atsar friend and opinions of the scholars of the Salaf. But it looks less consistency in the interpretation of the piece QS al-Isr?: 78 of the Asr prayer and evening prayer time. Determine both prayer time, he was not based on history or the opinion or tabiin Companions (as one method of bi al-matsur). He interprets the verse pieces with al-rayi (ratio). Did Ibn Kathir consistently apply the method of bi al-matsurin the interpretation of legal texts? Based on the study, interpretation of Ibn Kathir in the verses of the law, never out of frame jumhur, and he always rejects the notion that outside Sunni or Ahlus Sunnah.

Abstract

Demokratisasi politik yang bergulir di Indonesia kini sangat memerlukan ragam tawaran konsep-konsep politik pada umat Islam agar mereka semakin cerdas dan arif menghadapinya. Sehubungan dengan itu, maka ajaran politik manaqib Syaykh Abd al-Qadir al-Jailani menjadi sangat relevan diketengahkan di tengah publik. Wacana-wacana politik yang berkembang di seputar manaqib lambat laun akan menjadi tawaran-tawaran sikap politik bagi para peminatnya. Sebagaimana diketahui bahwa aktivitas membaca terjemahan manaqib berarti menafsirkan. Membaca dan menafsirkan berarti menulis ulang dalam bahasa mental dan bahasa pikir pembaca. Keberanian penulis untuk membahas manaqib didorong olehbeberapa tulisan yang telah ada sebelumnya. Ada dua tahap yang dilakuan dalam penelitian ini, yaitu tahap pembacaan heuristik dan pembacaan hermeneutik. Pada pembacaan heuristik, penulis memfokuskan pada struktur bahasa dan penggunaan istilah. Adapun pada pembacaan hermeneutik, penulis memaknakan teks yang dianggap sebagai tanda terhadap sesuatu yang tersirat dari teks yang terbaca. Dalam telaah teks, penulis mengabaikan sisi prinsip historis menyangkut ruang dan waktu yang ada dalam narasi isi manaqib. Oleh karena itu, isi tulisan ini tidak akan menjawab persoalan apakah isi teks manaqib termasuk sejarah atau mitos.

Abstract

Polygamy both discourse and practice has always been a conversation kontroversif and contradictory. Some people regard it as a symbol of patriarchal and marginalization of women. While on the other hand polygamy is considered as part of the expression of faith, in fact is one of the rights that can not be intervened by anyone. Discourse on polygamy still rolling today. This study is not focused on the concept of thought, religious interpretation, certain scientific perspective, as well as studies in general about polygamy. But more to the mapping research on polygamy during the past three decades and the consistency of the results of research conducted along with qualitative explanation. With meta-interpretative approach, researchers are trying to map the writing or research on polygamy as well as finding and distinguishing development, both in terms of religion and culture.

Abstract

The basic problems have been faced by minority moslem who live in majority non muslim especially when they have to apply religious interpretation as understood in the majority moslem countries appeared a concept of fiqh al-aqalliyyat (fiqh of minority). It is a kind of islamic teaching that considered as acomodation to contemporary problems faced by minority moslem. Therefore, they can perform their religious teaching eventhought it seems different with the form of islamic law in general. This writing focus on study of form of fiqh alaqalliyyat? What are the principles and the methodological bases of fiqh al-aqalliyyat and what is the relationship between fiqh al-aqalliyyat and maqasid al-syari'ah.

Abstract

Back to read the historical reality of how Islam is derived in the midst of a people known as 'Ignorance' by most people but not for some people who belong to the wise. As figure Khalil Abdul Karim did not want to mention Arabs as the Pre-Islamic Ignorance is the opposite because they are among the civilized and knowledgeable human height. As evidence God has provided a challenge to them so they could create works that are able to match the verses are referred to as the revelation of God in the Qur'an, if not able to do more, it is enough to make comparable with that mentioned in al-Qur 'an as mu'zizat of God bestowed on the Qur'an and entrusted to the Prophet Muhammad. This theory was used by Khalil Abdul Karim in order to answer any conflict between Islamic law that developed in the era of the contemporary world, have no concept of dialogue between Islamic law and local tradition that the two must keep going along in rhythm and in the theory and practice of life community wherever and whenever.

Abstract

Fiqh paradigm shift in modern legal system necessitates acceptance of Jurisprudence of the diversity and plurality of the multiperspective such as democracy, human rights, the constitution, guarantee basic rights, and the realities of modern social life. As a product of legislation, modern Islamic law will be loaded with the demands, orientation, interests and voices of various parties to solve the various problems that arise. This paper is going to examine how the role of the scholars of Islamic law in modern legislation. This is related to the change in the legal paradigm of classical Islamic law based on individual ijtihad be based national parliament legislation which necessitates relevance ruling political authorities / parliament as the embodiment of a new meaning ijtihad definitively.

Abstract

Konsep hermeneutika Rahman lahir untuk mengkritisi formulasi epistemologi hukum Islam klasik-skolastik yang dirumuskan al-Syafii. Dalam teori analogi (qiy?s) al-Syafii, ashl adalah sesuatu yang harus selalu dirujuk dalam memeriksa keabsahan setiap fenomena yang baru dan ashl telah mengungkung ijtih?d dalam batasan teks wahyu. Akibatnya, dialektika antara dunia teks (world of the text), dunia pengarang (world of the author) dan dunia pembaca (world of the reader) menjadi terputus. Dengan hermeneutika, Rahman bermaksud menangkap hukum ideal (ideal law) yang mengandung prinsipprinsip etika al-Quran dan harus dibedakan dari aturan-aturan khusus (legal spesific). Secara epistemologis, ada beberapa poin yang bisa ditangkap dari pemikiran hermeneutika Rahman. Pertama, dalam memahami al-Quran, hermeneutika Rahman lebih mendahulukan prinsip moral al-Quran ketimbang dimensi lahiriah teks, meskipun ia tidak meninggalkan teks sama sekali. Memahami totalitas al-Quran dapat dilakukan dengan memahami latar belakang historis penurunan al-Quran tersebut dan kemudian menyusun prinsip-prinsip moral al-Quran tersebut secara sistematis. Kedua, sumber informasi pengetahuan dalam konsep hereneutika Rahman bukan hanya teks, melainkan mencakup tiga horizon sekaligus; dunia teks (world of the text), dunia pengarang (world of the author) dan dunia pembaca (world of the reader). Ketiga, hermeneutika Rahman lebih mengembangkan konsep validitas pengetahuan yang bersifat intersubjektif. Hermeneutika tidak mengenal model penafsiran yang bersifat tunggal dan menjadi hak monopoli kelompok tertentu. Keempat, intersubjektivitas yang diusung hermeneutika ini tidak akan sampai melahirkan relativisme, sebab fleksibilitas rumusan hukum Islam Islam tersebut akan selalu dapat dikembalikan kepada prinsip-prinsip moral (ideal moral).
