Abstract

Abstract   War of opinions about the victims of Bali blast in public media was observed in two national newspaper, Republika and Kompas. Although the both newspapers are of national level, but in fact the request to be objective in informing opinions toward all community class and groups is some-thing difficult to achieve. This is based in the idea that every communication action contains any interrest—the more in mass media. In the side of Republika the execution of Amrozi seen as universal humanity problem, meanwhile for Kompas it only seen as local case that is related to the persons involved in the incident. Republika provides enough room for developing the discourse on jihad and terorism in order to build a counter opinion on the news that oftenly offense Amrozi meanwhil Kompas convines it self for not to involve in the discourse of theology.   *** Perang opini tentang korban ledakan Bali di media massa diamati di dua surat kabar nasional, yaitu Republika dan Kompas. Walaupun kedua surat kabar tersebut berskala nasional, namun dalam kenyataannya tuntutan untuk obyektif dalam menyampaikan opini kepada masyarakat merupakan hal yang sulit. Ini didasarkan pada gagasan bahwa setiap tindakan komunikasi mengandung kepentingan. Di pihak Republika ekskusi Amrozi dipandang sebagai masalah kemanusiaan universal, sementara bagi Kompas ekskusi tersebut hanya dipandang sebagai kasus lokal yang terkait dengan pribadi yang terlibat dalam kejadian tersebut. Republika memberikan ruang yang cukup bagi pengembangan diskursus mengenai jihad dan terorisme dalam rangka untuk membangun opini imbangan terhadap berita-berita yang seringkali menentang Amrozi sementara Kompas membatasi diri untuk tidak masuk ke dalam diskursus teologi.   Keywords: Republika, Kompas, bom Bali, Amrozi, counter pendapat

Abstract

The doctrine of the Qur’an teaches that human beings are created in diversities and tribes in order to know one another. Essencially, it means that the basic attitude of Islam exclaims all the humans have the same ideas for a unity of humanity without discriminating races, colour, ethnic, culture and religion. Nevertheless, when the idea of the Qur’an is interpreted in the form of fiqh, historically the fiqh was often confronted with the truth claims being supported by the followers of each madzhab. So, between the truth claims of a fiqh formula being local particular and the doctrine of the Qur’an itself being universal substantial is a paradox. The emergence of the truth claims can have the potential to lead to the conflicts and anarchy among the followers because of differing interpreting of the fiqh. Therefore, a formula of jurisprudence needs to be developed according to multiculturalism that recognizes the diversities and places them in the equality. In the field of jurisprudence, the view of multiculturalism should be methodically built by way of developing paradigm of Islamic social interpretation prioritizing the dynamic, progressive and tolerant interpretations. The discussion in this article concludes that multiculturalist fiqh must be built on the principle of mashlahah using the maqashid al-shari'ah approach. Consequently, universal Qur'anic values are seen as substantive values rather than local-particular values. Therefore, with the maqashid al-shari'ah approach, the values of justice, benefit, equality, wisdom and love are the most important values that will be the source and inspiration when the Qur'an explains the provisions of a legal-specific case.

Abstract

Land is an important source of life for farmers. Society?s effort maintain and obtain recognition for landoften lead to conflict. Include land conflict in Surokonto Wetan Village, Pageruyung District, Kendal Regency. This study aims to knowing history and conflict dynamics in Surokonto Wetan village, analyzing communication strategic that using by society to settlement of land conflict. The result showing that: firstly, land conflict in Surokonto Wetan is asyimmetric conflict between society and Perhutani. Secondly, communication strategic that using by society in Waisbord framework about problem definition, goal selection affecting strategic choosing, tactics and continuity movement  relating with people?s motivation to better change. The basis of various actions is to free land to be owned by societys and free two detained societys, this goal underlies every manifestation of community action through demonstrations, negotiations, appeals until the goal is reached. ****Tanah merupakan sumber kehidupanyang penting bagi masyarakat petani. Usaha mempertahankan dan memperoleh pengakuan atas tanah tak jarang menimbulkan konflik. Termasuk konflik tanah yang terjadi di Desa Surokonto Wetan Kecamatan Pageruyung Kabupaten Kendal. Penelitian ini bertujuan mengetahui bagaimana sejarah dan dinamika konflik tanah di Desa Surokonto Wetan, menganalisis strategi komunikasi yamg digunakan  masyarakat untuk penyelesaian konflik. Hasil penelitian memperlihatkan, pertama, konflik tanah di Surokonto Wetan merupakan jenis konflik asimetris yang melibatkan masyarakat dengan Perum Perhutani.Kedua, Strategi komunikasi yang digunakan masyarakat dalam kerangka Waisbord terkait definisi permasalahan, tujuan yang ingin dicapai yang mempengaruhi pemilihan strategi, taktik dan kontinuitas gerakan terkait motivasi orang terhadap perubahan yang lebih baik. Dasar berbagai aksi adalah untuk membebaskan tanah agar dimiliki warga dan membebaskan dua warga yang ditahan, tujuan ini mendasari setiap aksi masyarakat yang terwujud melalui demonstrasi, negosiasi, kasasi yang dilakukan hingga tercapai tujuan.

Abstract

The Covid-19 pandemic has changed the behavior of people in the world, both in social, political, cultural and religious practices. The practice of strict health protocols has changed religious practices, both in Islam, Christianity, Hinduism, Buddhism and other faiths. In Islamic countries or countries where the population is predominantly Muslim, the ulama play an important role in legitimizing these changes in religious practice. In Indonesia, there is the Indonesian Ulema Council (MUI) which plays a role in providing fatwas related to changes in religious practices, such as prayer, zakat, Hajj and burying people who died due to being infected with Covid-19. These fatwas raise the issue of the epistemological construction that underlies the fatwas. Through a philosophical approach and content analysis of the MUI fatwas products, it was found that MUI fatwas were based more on empirical-scientific arguments (burhani) as well as ethical principles of Islamic teachings contained in the principles of maslahah (general good) and syadz al-zari'ah (avoiding danger). This article shows that the legal reasoning built by MUI shows the tendency of epistemology with a realism style based on scientific facts so that religion plays a role in providing legitimacy in the ethical and moral realm in the form of sharia objectives (maqāshid al-syarī’ah).

Abstract

Konsep hermeneutika Rahman lahir untuk mengkritisi formulasi epistemologi hukum Islam klasik-skolastik yang dirumuskan al-Syafii. Dalam teori analogi (qiy?s) al-Syafii, ashl adalah sesuatu yang harus selalu dirujuk dalam memeriksa keabsahan setiap fenomena yang baru dan ashl telah mengungkung ijtih?d dalam batasan teks wahyu. Akibatnya, dialektika antara dunia teks (world of the text), dunia pengarang (world of the author) dan dunia pembaca (world of the reader) menjadi terputus. Dengan hermeneutika, Rahman bermaksud menangkap hukum ideal (ideal law) yang mengandung prinsipprinsip etika al-Quran dan harus dibedakan dari aturan-aturan khusus (legal spesific). Secara epistemologis, ada beberapa poin yang bisa ditangkap dari pemikiran hermeneutika Rahman. Pertama, dalam memahami al-Quran, hermeneutika Rahman lebih mendahulukan prinsip moral al-Quran ketimbang dimensi lahiriah teks, meskipun ia tidak meninggalkan teks sama sekali. Memahami totalitas al-Quran dapat dilakukan dengan memahami latar belakang historis penurunan al-Quran tersebut dan kemudian menyusun prinsip-prinsip moral al-Quran tersebut secara sistematis. Kedua, sumber informasi pengetahuan dalam konsep hereneutika Rahman bukan hanya teks, melainkan mencakup tiga horizon sekaligus; dunia teks (world of the text), dunia pengarang (world of the author) dan dunia pembaca (world of the reader). Ketiga, hermeneutika Rahman lebih mengembangkan konsep validitas pengetahuan yang bersifat intersubjektif. Hermeneutika tidak mengenal model penafsiran yang bersifat tunggal dan menjadi hak monopoli kelompok tertentu. Keempat, intersubjektivitas yang diusung hermeneutika ini tidak akan sampai melahirkan relativisme, sebab fleksibilitas rumusan hukum Islam Islam tersebut akan selalu dapat dikembalikan kepada prinsip-prinsip moral (ideal moral).

Abstract

Academic investigations in this paper wants to elaborate the two concept of theistic existentialism and Sufism on human perfection (Insān kāmil) of Seyyed Hossein Nasr perspective. According to Nasr’s thought human is not dealing with the concept of any other creation of god like animal, thress or miniral. For human developing in the world, human being is ceated deferrently of any aspects of things. By using the comparison method analysis of ideas contained in the literature this article aims to direct the human will for actions in their life and with the method of interpreting of the hermeneutics ways of these ideas the researcher entrenched searching for sources relevant to the topic of this study. From the results of this study it was concluded that humans do not merely exist based on their material form or physical form, but humans who exist consciously of their existence are human nature according to the flows of existentialism. The human existence surely determinated by god wills and god almighty. It is different with humans who are conceived by modern sciences as experiencing disparities in understanding of humanism. So humans are often seen from a certain aspect. And this is according to the conclusion that found is caused the crisis of modernity. For this reason, measuring humanity as a creature is expected to have a large role in alleviating various crises that arise in the modern world. Humanism consciousness or human consciousness becomes an important mode of transufquration in concepting humans in the existentialism dimension.
