Abstract

Purwakerti Village, Abang District, Karangasem Regency's Jemeluk Beach is well known for its diverse and abundant underwater natural beauty. Nonetheless, the viability of the undersea ecology is threatened by the quick growth of tourism. Local people have great potential to help preserve these ecosystems through their traditional knowledge and habits, such as sustainable fishing methods. In managing the underwater ecosystem at Jemeluk Beach, this research seeks to integrate the philosophical values of local wisdom and customs. It also optimizes the role of fishing communities in accomplishing the goal of sustainable ecosystem preservation within the framework of tourism development. The research method uses a normative legal approach with literature studies from primary, secondary, and tertiary legal materials. The research results show that the integration of traditional community knowledge with modern science can create an effective and sustainable conservation strategy. Environmental education, active participation of local communities, and implementation of environmentally friendly technologies are some of the strategies proposed to achieve these goals. In conclusion, further education and training, as well as cooperation between local communities, and governmental and non-governmental groups, can help preserve the underwater ecology at Jemeluk Beach. Promoting responsible and sustainable tourism development can enhance the economic well-being of nearby communities in addition to promoting environmental sustainability.

Abstract

Sexual violence against children is a serious human rights violation that continues to increase in Indonesia. This study aims to analyze legal protection for underage victims, evaluate the effectiveness of existing regulations (including the Criminal Code and Child Protection Law), and identify the complex factors that cause this crime. Using a normative juridical method with a literature review approach, the results of the study show that although the formal legal framework is adequate, its effective implementation is still hampered by weak enforcement, limited victim rehabilitation, and a lack of inter-agency coordination. Causal factors include victim vulnerability, family dysfunction, patriarchal culture, and weak law enforcement. The implications of these findings demand a comprehensive approach through strengthening protection, increasing the capacity of law enforcement officials, ensuring rehabilitation, and public education to tackle child sexual violence more effectively.

Abstract

Dengan berbagai banyak kelebihan dari kendaraan bermotor telah membawa masalah dalam perilaku tertib berlalu lintas. Seperti penggunaan kendaraan oleh anak. Perumusan masalah pada riset ini yaitu Bagaimanakah penerapan UU Nomor 22 Tahun 2009 tentang lalu lintas serta angkutan jalan terhadap anak dibawah umur Di kecamatan Kuta Utara Kabupaten Badung? Bagaimanakah kendala penerapan UU Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan Terhadap Remaja Di kecamatan Kuta Utara Kabupaten Badung? Penelitian ini menggunakan tipe penelitian empiris yang berlokasi di Kantor Kepolisian Resor Badung, Sektor Kuta Utara. Hasil dari penelitian ini yaitu, penerapan UU Nomor 22 Tahun 2009 terhadap anak dibawah umur dapat dikatakan belum efektif dan kendala pelaksanaan UU ini terhadap anak dibawah umur di kecamatan Kuta Utara Kabupaten Badung dipengaruhi oleh faktor internal anak yang mencoba mengendarai motor, faktor lingkungan teman yang mempengaruhi dan lingkungan keluarga yang memberikan fasilitas. Penegak hukum diharapkan lebih tegas dalam memberikan sanksi dan sosialisasi kepada anak yang melanggar, dan kepada orang tua diharapkan memberikan pengarahan tentang larangan mengendarai motor kepada anaknya.

Abstract

Upaya untuk meningkatkan penataan tertib impor dengan menyempurnakan kembali ketentuan-ketentuan di bidang impor merupakan langkah penting untuk menjaga kepentingan Pembangunan ekonomi nasional dari pengaruh negatif pasar global, langkah ini juga dapat mendorong terciptanya kondisi perdagangan dan pasar dalam negeri yang sehat dengan iklim usaha yang sangat. Rumusan masalah dalam penelitian ini yaitu: Pengaturan Hukum dalam mengatasi maraknya perdagangan pakaian impor ilegal, Pertanggungjawaban Hukum terhadap pelaku penyelundupan pakaian impor ilegal. Penelitian ini menggunakan penelitian normatif, pengaturan hukum dalam mengatasi perdagangan pakaian impor ilegal yaitu Undang – undang Nomor 7 Tahun 2014 untuk menangani tindakan-tindakan menyelundupkan pakaian bekas yang bisa sekaligus melindungi produk dalam negeri. Undang-undang pun dikeluarkan pemerintah untuk memberi sanksi administratif atau sanksi pidana pada mereka yang menyelundupkan pakaian bekas sebagai contoh importir pakaian bekas. Undang-undang menegaskan bahwa barang yang diimpor harus dalam kondisi baru kecuali situasi-situasi tertentu yang sudah diizinkan oleh Menteri Perdagangan

Abstract

Indonesia is a country based on the rule of law that adheres to Pancasila and the 1945 Constitution, guaranteeing equality before the law for all citizens. However, advances in information technology, particularly in the banking sector, have given rise to serious challenges, including digital crime, particularly the theft of personal data through skimming methods. Skimming is a cybercrime and information technology crime in which a customer's ATM card data is illegally duplicated using specialised tools. Perpetrators then use this stolen data to access and drain customer funds. This banking crime is closely related to the Electronic Information and Transactions Law (EIT Law), specifically Articles 30 and 31, which regulate illegal access and interception of electronic systems. This study adopts a normative juridical method with a literature review approach, examining various legal materials. The focus of the study is on the legal regulations governing criminal skimming technology in the national banking system. The study's results show that, although the ITE Law has become the legal basis for prosecuting skimming, there remain structural weaknesses. These weaknesses stem from a lack of clarity in the definition and scope of the offence, which ultimately creates difficulties in consistently and fairly enforcing the law. The protection of customers' personal data is emphasised in ITE Law, which makes it part of the right to privacy that banks must guarantee. Skimming perpetrators can be prosecuted under the criminal provisions of ITE Law or under Articles 362 and 363 of the Criminal Code (KUHP) on theft.
