Abstract

Daerah Pantai Kedonganan merupakan daerah tujuan wisata di Bali yang juga memiliki hasil laut yang tinggi. Perekonomian masyarakat sekitar didukung oleh hasil laut dan pariwisata tersebut. Pendapatan masyarakat tergantung pada jumlah kunjungan wisatawan. Biasanya, penurunan penjualan terjadi saat low season. Tujuan pengabdian masyarakat ini membantu mitra untuk meningkatkan penjualan khususnya pada low season. Mitra dari program pengabdian masyarakat ini adalah “Kelompok Nelayan Sumber Ayu” yang terletak di Desa Kedonganan, Kabupaten Badung. Kelompok nelayan ini menjual hasil olahan ikan. Permasalahan yang dihadapi kelompok nelayan ini adalah: 1) Penurunan penjualan saat low season. 2) Teknik pemasaran yang masih manual. 3) Adanya perselisihan dengan konsumen. Metode yang digunakan adalah pembinaan dan pendampingan sistem digital marketing dalam memasarkan olahan ikan serta tata cara penyelesaian preventif dan represif terhadap perselisihan yang terjadi dengan konsumen. Hasil dari pengabdian ini adalah pembinaan mengenai risiko yang mungkin dihadapi saat terjadinya penurunan penjualan. Pemaparan tentang strategi digital marketing dan pembentukan website yang diharapkan akan mampu menunjang pemasaran produk kelompok nelayan tersebut. Terakhir, pembinaan tata cara preventif dan represif dalam menghadapi konsumen. Pendampingan ini diharapkan mampu membantu penjualan nelayan tetap stabil khususnya saat low season.

Abstract

Koperasi ini timbul dari adanya keinginan untuk mengembangkan dan membantu perekonomian para anggota bahkan masyarakat di Kabupaten Badung. Pengabdian ini bertujuan untuk mengembangkan koperasi dan UMKM di Bali di masa pandemic covid-19 secara baik dan benar agar kedepannya dapat memenuhi pasar baik dalam negeri maupun luar negeri. Mengupayakan agar koperasi di Bali terus tumbuh sehingga dapat memberi kesejahteraan dan kebermanfaatan bagi anggotanya.   Lokasi Pengabdian adalah Koperasi Simpan Pinjam Mas Sedana Merta  Sempidi   Kelurahan Sempidi   Kecamatan  Mengwi Kabupaten Badung. isu permasalahan yang ada di koperasi tersebut  yaitu: (1) administrasi manajemen koperasi yang masih belum baik ;(2)  permasalahan kredit macet yang disebabkan adanya kondisi covid – 19 ,dan  (3) masih lemahnya perjanjian simpan pinjam serta keinginan dari pihak anggota untuk melaksanakan hak dan kewajibannya. Dari data yang diperoleh maka diperlukan suatu penataan yang baik bagi Koperasi Mas Sedana Merta Sempidi melalui pendekatan pembinaan , pendampingan, dan penyuluhan ,dengan hasil akhir berupa sistem manajemen administrasi berbasis TI dari KSP yang baru, serta adanya model perjanjian simpan pinjam dan pola penyelesaian masalah kredit  yang lebih tepat agar tidak ada lagi permasalahan kredit bermasalah.

Abstract

Pengabdian Kemitraan Masyarakat Universitas Warmadewa  dimasa Pandemi Covid -19 ini bertujuan untuk mengembangkan koperasi di Bali di mana sekarang ini sangat  penuh dengan tangtangan.   Mengupayakan agar koperasi di Bali terus tumbuh sehingga dapat memberi kesejahteraan dan kebermanfaatan bagi anggotanya. Koperasi ini timbul dari adanya keinginan untuk mengembangkan dan membantu perekonomian para anggota bahkan masyarakat di Kabupaten Gianyar   Lokasi Pengabdian adalah Koperasi Simpan Pinjam Shanti Prapta  Sedana,      Kelurahan Beng, Kecamatan  Gianyar, Kabupaten Gianyar . menunjukkan beberapa isu permasalahan yang perlu mendapatkan perhatian yaitu: (1) administrasi manajemen koperasi yang masih manual ;(2) ada permasalahan kredit yang disebabkan adanya kondisi covid – 19 ,dan format  perjanjian koperasi simpan pinjam yang disesuaikan,  serta keinginan dari pihak anggota untuk melaksanakan hak dan kewajibannya. Dari data yang diperoleh maka diperlukan suatu penataan administrasi berbasis online  bagi Koperasi Shanti Prapta  Sedana melalui pendekatan pembinaan , pendampingan ,dan sosialisasi, Dengan hasil akhir berupa sistem manajemen administrasi berbasis TI dari KSP yang baru, serta adanya Format perjanjian simpan pinjam dan pola penyelesaian masalah kredit  yang lebih tepat agar tidak ada lagi permasalahan kredit bermasalah.

Abstract

This research is an empirical legal research because of the gap between the provisions and theories that exist with the legal facts that occur in society, about transactions of goods that cross the boundaries of a country has been regulated nationally by each country through certain procedures through the laws of the country -that. Against illegal business in the border area of the Republic of Indonesia with the Democratic Republic of East Timor, law enforcement must be carried out by law enforcement as an effort to harmonize concrete actualization with the applicable legal rules, with the national legal aspects of each country and agreed aspects of international law. The barriers and solutions to law enforcement against illegal business can be resolved through social and cultural, economic, political and security, while the solution that is used as an alternative is development in the border region specifically directed to accelerate the handling of the 3 fundamental problems faced by the border area, namely the delimitation aspect and Delineation of Boundaries, the aspect of affirming the national boundaries of the watershed area of the Republic of Indonesia with the State of Timor Leste, the aspect of the development gap is the fulfillment of economic infrastructure needs to foster opportunities for border areas to participate and compete in global markets and regional markets.

Abstract

Competition encourages companies to provide attractive offers such as promo ticket prices to giving free seats. However, many airline companies, who only want to achieve their profit targets, are willing to put aside their responsibilities and consumer rights; one of which is the delay of a flight ticket refund due to the cancellation of the flight by the airline unilaterally. This study aims to determine the form of legal protection for consumers who experience delays in paying Refund funds by airlines and to find out the forms of airline responsibility for Refund funds and settlement efforts in case of disputes. This type of research is normative juridical with a statutory approach presented in the form of legal interpretation. The results showed that the cancellation of flight schedules by airlines was not regulated in Law No. 1 of 2009 concerning Aviation, but the provisions can be seen in the Minister of Transportation Regulation Number 77 of 2011 Article 12 paragraphs 1 and 2. Permenhub Number 185 of 2015 also regulates the period of ticket refunds. Refunds can also be added with other compensation as well as Article 1453 of the Civil Code. The time period for the refund process by airlines is generally in accordance with the Regulation of the Minister of Transportation Number 185 of 2015. Settlement of consumer disputes can be done by 1) Direct compensation for losses; 2) Through BPSK by means of mediation, conciliation and arbitration; 3) Settlement of consumer disputes through litigation.

Abstract

Credit agreements are usually accompanied by a collateral agreement and an insurance agreement. This insurance agreement is a means of transferring risk for the bank, especially life insurance in the event of a debtor's death, besides credit can also fall to the heirs if the debtor dies before paying off the remaining credit. This study aims to analyze the legal consequences of the Bank's Credit Agreement in the event that the Debtor dies and to find out the responsibility of the Insurance Party for the Bank's Credit Agreement in the event the Debtor dies. This study uses a normative research method with a statutory approach and a conceptual approach. The results show that the legal consequence of the credit agreement in the event that the debtor dies, there are two possibilities, namely that the credit goes to the heirs as regulated in article 833 of the Civil Code (Burgerlijk Wetboek) or the guarantee is executed by the bank, and the second possibility is that the credit is written off due to a life insurance clause or a life insurance agreement with a banker's clause, which means that the insurance company must be responsible for paying off the remaining debts of the debtor who died according to the terms and conditions of the policy, otherwise the interested party can file a summons to sue the insurance company. From this, the conclusion is that the parties must fully understand the contents of the credit agreement made, so that later if this risk occurs, there will be clarity on the payment of the debtor's remaining debt.

Abstract

In this era, the growth of the goods and services industry has had a positive impact. One of the positive impacts is providing sufficient quantity and higher quality demand, as well as there are a lot of alternative choices for consumers to meet their needs. On the other hand, there are also negative impacts, namely the use of technology and the impact of business behavior due to increased competition which has an impact on the consumer community. This study aims to determine whether business actors are responsible for consumer losses related to goods that are not produced in accordance with the label, and to find out what legal sanctions have been imposed on business actors for violations due to inappropriate labels and manufactured goods. This type of research is normative legal research. The results show that the responsibility of commercial actors is related to the mismatch between the label and the goods produced, namely compensation for damage, pollution, and consumption of goods or services. Then, legal sanctions can be imposed for violations of business actors, including imprisonment for a maximum of 5 (five) years or a maximum fine of Rp. 2 billion. Thus, it can be concluded that business actors can be held accountable for the incompatibility of labels with goods that have been produced, and if the violation is too detrimental to consumers, they can be prosecuted in accordance with applicable laws and regulations.

Abstract

In this era of globalization, insurance has been considered as a basic need which is a human need for security. Insurance is a form of risk management that is formed with the aim of avoiding the possibility of an uncertain risk of loss. This study aims to examine the legal position of policyholders as creditors in insurance companies and to reveal the legal protection of policyholders in insurance companies that are declared bankrupt. This study uses a normative research method because there is still a conflict of norms, with the approach to legislation. The data is sourced from the opinions of legal scholars and data law. The data sources are primary and secondary data obtained through recording and documentation, then the data is processed using interpretation and descriptive. Based on the Bankruptcy Law and PKPU Article 1 number 2, creditors are parties who have receivables due to agreements or laws that can be collected in advance of services. In the context of the legal protection of the policyholder, the Insurance Act has regulated the existence of a policy guarantor institution in which the purpose of the establishment of a policy guarantee program is to guarantee the return of part or all of the rights of the policyholder. In the bankruptcy and liquidation of an Insurance Company, it is expected that the curator will pay attention to the right of the Policy Holder to obtain compensation from the bankruptcy assets of the Insurance Company.

Abstract

Humans as social beings who live side by side and have various needs that must be met in order to survive. In meeting these needs. Indonesia often makes payments with a credit system. Credit is a breakthrough that really helps the community. However, with the Covid-19 Pandemic) hitting various businesses and credit financing customers due to lack of income. This study aims to examine the legal arrangements for credit delays for customers affected by COVID-19 in Indonesia and explain legal protection for customers affected by COVID-19 in Indonesia. The type of research applied in this research is normative legal research, with a statutory approach and a concept approach. In general, the regulation of credit delays for customers affected by COVID-19 is regulated in POJ K Number II POJK.03 2020 regarding the national economic stimulus as a counter-helical policy for the impact of the 2019 coronavirus disease. There are two legal protections, namely preventive legal protection by issuing PERPU Number I of 2020 concerning state financial policies and stability for handling the coronavirus disease 19 pandemic, and repressive legal protection based on Bank Indonesia Circular Letter No. 26/4/BPPP which in principle regulates the rescue of non-performing loans through rescheduling, reconditioning, restructuring

Abstract

Online loans that are developing in today's society will certainly be very helpful, the problem is when people are involved in illegal online loan transactions which often use unjustified methods of collecting. The purpose of this research is to analyze the regulation of online loan transactions in Indonesia and to discuss forms of legal protection for consumers in illegal online loan transactions. The research method used is a normative research type by examining library materials as primary data and secondary data from books and legal journals. The data collection technique of this research is to record and document. And the data analysis technique is by reviewing books, literature and electronic media related to this research. The results of this research indicate that currently legal protection for people involved in illegal online loan transactions is still lacking, because people find it difficult to distinguish between legal online loan financing institutions and which online loan financing institutions are illegal. In this case, an active role from the OJK is needed to oversee the growth of illegal online loans in the community as regulated in the Financial Services Authority Regulation No. 77 of 2016 concerning the implementation of online-based loan transactions, besides that the protection of people involved in online loan transactions is regulated in Law no. 8 of 2019 concerning consumer protection to prevent arbitrariness by online loans to the public.
