Abstract

A good and healthy environment is a human right of every Indonesian citizen as mandated in Article 28H of the 1945 Constitution of the Republic of Indonesia. Indiscriminate environmental management contributes to the deterioration of the quality of the environment, therefore it is necessary to increase environmental protection and management. The protection and sustainable management of the environment is the responsibility of the government and the community. The government's responsibility in protecting and managing the environment is a function of public services, to ensure that all residents have a good and healthy environment. Then the government can be held accountable, both administratively, civilly and criminally when the government neglects to carry out its obligations that are not in accordance with the aspirations of the community. This research is qualified as a normative legal research by applying several types of approaches, namely, a statutory approach, a conceptual approach, a philosophical approach, a historical approach, a comparative approach, a case approach including a cultural approach based on local community wisdom. Therefore, this study aims to find philosophical and theoretical thoughts based on local wisdom about the nature of integrating community aspirations in the enforcement of Environmental Law both in administrative law, civil law and criminal law. The results of the study show that environmental protection and management is an effort to carry out responsibilities, which is very difficult, resulting in a decrease in the quality of the environment. Therefore, law enforcement is to make improvements to the applicable rules through the politics of normative legislation, then followed by administrative law enforcement. However, participatory environmental enforcement by integrating the values ​​that develop in the community in protecting and preserving the environment is an ideal form to protect and manage the environment wisely to realize sustainable regional development. Lingkungan hidup yang baik dan sehat merupakan hak asasi setiap warganegara Indonesia sebagaimana diamanatkan dalam Pasal 28H UUD RI 1945. Pengelolaan lingkungan yang kurang bijaksana turut memperparah penurunan kwalitas lingkungan hidup karena itu perlu dilakukan peningkatan perlindungan dan pengelolaan lingkungan hidup. Perlindungan dan pengelolaan lingkungan yang berkelanjutan merupakan tanggungjawab pemerintah beserta masyarakat. Pertanggungjawaban pemerintah dalam melakukan perlindungan dan pengelolaan lingkungan hidup merupakan fungsi pelayanan public, untuk menjamin seluruh penduduk mendapatkan lingkungan yang baik dan sehat. Maka pemerintah dapat diminta pertanggungjawabannya, baik secara administrative, perdata maupun pidana mana kala pemerintah lalai melaksanakan kewajibannya yang tidak sesuai dengan aspirasi masyarakat. Penelitian ini dikualifikasikan sebagai penelitian hukum normatif dengan menerapkan beberapa jenis pendekatan yaitu, pendekatan perundang-undangan, pendekatan konseptual, pendekatan filsafat, pendekatan sejarah, pendekatan perbandingan, pendekatan kasus termasuk pula pendekatan budaya atas dasar kearifan masyarakat lokal. Oleh karena itu, penelitian ini bertujuan menemukan pemikiran filosofis dan teoritis berbasis kearifan lokal tentang hakikat pengintegrasian aspirasi masyarakat dalam penegakan Hukum Lingkungan baik secara hukum administratif, hukum perdata maupun hukum pidana. Hasil penelitian menunjukan bahwa perlindungan dan pengelolaan lingkungan hidup adalah upaya mengemban tanggungjawab sangat sulit sehingga mengakibatkan terjadinya penurunan kwalitas lingkungan hidup makin nyata. Oleh karenanya maka penegakan hukum adalah melakukan penyempurnaan terhadap aturan yang berlaku melalui politik legislasi penormaan selanjutnya baru diikuti penegakan hukum administrasif. Namun demikian penegakan lingkungan partisipatif dengan mengintegrasikan nilai-nilai yang berkembang di masyarakat dalam menjaga dan melestarikan lingkungan adalah suatu bentuk idial untuk melindungi dan melakukan pengelolaan lingkungan hidup secara bijaksana untuk mewujudkan pembangunan daerah yang berkelanjutan.

Abstract

Indonesia as a state of law is obliged that the law must always be enforced, respected and obeyed by anyone without any reason for exception. In response to this, positive legal policies in Indonesia are required to be able to respond to the phenomena of crimes committed by utilizing this technology. The problems of this study are 1) What is the policy of criminal sanctions against account break-ins through Automated Teller Machines (ATMs)? 2) What is the judge's consideration in deciding the case of account burglary through Automated Teller Machines (ATMs)? The research method used is a normative legal research method, with a literature study of primary and secondary legal materials. The results of the study can be concluded that: 1) The policy of criminal sanctions against account burglary through Automated Teller Machines (ATM) in the Criminal Code, the ITE Law, the Fund Transfer Act, the Money Laundering Eradication Act. 2) The judge's consideration in deciding the case of Account Burglary through Automated Teller Machines (ATM) is that the defendant TEGUH T KHASAN has been legally proven. Aggravating things The defendant's actions can disturb the community and can cause harm to others. The mitigating factors were that the defendant admitted that he had never been convicted, the defendant was polite in court and admitted frankly his actions, the defendant felt guilty and regretful.

Abstract

A good and healthy living environment is the right of every Indonesian citizen as mandated in Article 28H of the 1945 Constitution of the Indonesian Republic. Unwise environmental management will aggravate the degradation of the environment, and therefore, improving the protection and management of the environment becomes necessary. Government accountability in environmental protection and management is a part of their public service function to ensure that people have a good and healthy environment. Thus, the puposes of this research are to examine the administrative accountability in environmental management for tourism development and to find a way to resolve legal consequences the government can face for its decision in environmental management in tourism development. This research is normative and empirical legal research and applied several approaches: statute approach, conceptual approach, philosophical approach, historical approach, comparative approach, case approach, and cultural approach based on local wisdom. The results show that the protection and management of the environment are efforts to take on a difficult responsibility, making environmental degradation more evident. Therefore, administrative law enforcement is the first step for the government to enforce the law immediately for environmental protection. The enforcement of administrative law and the integration of the values that grow in society in protecting and preserving the environment is ideal forms of wise environmental protection and management to realize tourism development. However, if the government fails to protect and manage the environment in developing tourism, the government can be held administratively accountable.

Abstract

Likewise in the event of environmental pollution and damage, the perpetrators can be held responsible both in civil law and criminal law. However, participatory environmental enforcement by integrating values that develop in the community in protecting and preserving the environment is an ideal form of protecting and prudent environmental management to realize sustainable regional development.

Abstract

Culture-based tourism is one of the sustainable tourism assets that contains unique cultural and natural traditions in an area. If we explore it more deeply, each village must have its own charm that contains various objects as noble values that can inspire tourists to village-based destinations, known as sustainable tourism. Bali as a tourism destination, known for its strong culture, pays serious attention to the sustainable tourism. One of the tourist villages in the area is Carangsari Village, which is located in Badung Regency. The village is trying to restore the tourism sector which has become the focus of the village community after it was stopped due to the spread of the corona virus. Motivated by the condition, this study is made to discuss the ideal recovery strategy for a sustainable tourism sector in the Carangsari village, Bali. This study makes use of an empirical legal research method with a statutory approach and an analysis of legal concepts. The results of this study indicate that a simple ideal recovery strategy is to add a schedule of sacred rituals in the tourist calendar in addition to the schedule of festivals existing in Bali.

Abstract

Every citizen has the right to express an opinion in accordance with Law Number 9 of 1998 concerning Freedom of Expressing Opinions in Public. Freedom of opinion is generally carried out by demonstrations. The recent demonstration in Bali is a demonstration against the reclamation of Benoa Bay. This is of particular concern to members of the Bali Police Dalmas as the main party in the handling of this demonstration. In handling it, the Bali Police Dalmas is guided to enforce the law against each of these demonstrations. Based on this background, this research was conducted with the aim of describing how the role of members of the Bali Police Dalmas police in law enforcement against the Benoa Bay protest against the Benoa Bay reclamation and what factors hindered the implementation of handling the Benoa Bay reclamation protest action by members of the Bali Police Dalmas. This study used an empirical legal research method. The results of this study indicated that the role of the Bali Police Dalmas in enforcing the law against the protest against Benoa Bay reclamation was carried out based on pre-emptive, preventive, and repressive actions based on statutory regulations and the police chief regulations regarding the handling of demonstrations. In addition, the factors that hindered the implementation of the protest against the reclamation of Benoa Bay by members of the Bali Police Dalmas include internal and external factors. the internal factor is factor of Dalmas members themselves, both from a mental perspective, professionalism, and knowledge about how to handle protests. Meanwhile, the external factor is generally the mass of protesters who do not understand the provisions that apply to the implementation of a demonstration.

Abstract

Along with technological developments, there are a lot of facilities available in cyberspace. The development of this technology can also provide opportunities for criminals, especially crimes in cyberspace. Cybercrime is a new form or dimension of a crime that is currently receiving a lot of attention from the international community. One type of cybercrime is hacking. Based on this background, this research was conducted with the aim of describing law enforcement against criminal acts of hacking and the efforts to deal with cybercrime. This research was conducted using normative legal research methods and statutory approaches. The results of this study showed that law enforcement against criminal acts of hacking is regulated in Law Number 19 of 2016 amending Law Number 11 of 2008 concerning Electronic Information and Transactions. The perpetrator will be given criminal sanctions in the form of imprisonment and fines for violations in the field of hacking. In addition, efforts to eradicate cybercrime refers to the Law on Information and Electronic Transactions which is carried out with preventive and repressive measures. Therefore, the criminal act of hacking which is included in the realm of cybercrime has been regulated in Article 30 paragraph (1), (2) and (3) of the ITE Law, while the punishment is regulated in Article 46 paragraph (1), (2), and ( 3) of the ITE Law. In this regard, the government has taken various countermeasures in the form of preventive and repressive measures.

Abstract

The crime of trafficking in persons often occurs among women and children. This case is mostly among adult women; this is due to demands (less economic) so that trafficking in persons often occurs. The government must eradicate this case and provide legal protection for victims of trafficking in persons so that women and children are not arbitrarily treated by traffickers. The type of research used is juridical normative; a study the discussion of which is based on laws and legal materials. The results of the analysis show that the criminal sanctions given to the perpetrators must be really sanctions that give a deterrent effect, so that the perpetrators do not repeat their mistakes. In addition, the existence of sanctions can reduce criminal cases of trafficking in persons against women and children, and no one treats women and children arbitrarily, and no longer makes women and children victims of trafficking in persons. So that children and women can become the next generation of the nation to be proud of themselves and others.

Abstract

The main causes of sexual crimes are economic factors and a lack of formal education, which triggers the crime of sexual exploitation of child trafficking with the marriage mode, which usually targets mostly children or women. This study aims to determine the impact of the exploitation of child trafficking by means of marriage as seen from the aspects of the Law on Trafficking in Persons and to find out the sanctions against perpetrators of child trafficking with the mode of marriage that occur in Indonesia. This research uses the normative legal method. The results of the analysis show that the impact that can be had on children and women victims is the impact on physical and psychological, emotional, spiritual, and disturbed health. Then, sanctions against perpetrators are regulated in Article 297 contained in the Criminal Code and in Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons, Law Number 23 of 2002 Concerning Child Protection and also Law Number 13 concerning Manpower.

Abstract

The continuation of the electronic media that is widely discussed today is virtual money, commonly known as cryptocurrency. Cryptocurrency can also be referred to as an unformed commercial object; actually in digital form which can be used in electronic transactions. This study aims to analyze the existence of virtual money (cryptocurrency) in stock trading in Indonesia and to find out the responsibilities of money laundering offenders who use virtual money (cryptocurrency) in stock trading. The research method used is normative legal research. The results show that the existence of virtual money (cryptocurrency) in stock trading in Indonesia when used as currency unification, transact, trade or as a means of payment with businesses in this case, especially stock trading in Indonesia can be said to be invalid in terms of Law Number 7. 2011 concerning Currency. Users of virtual money (cryptocurrency) in Indonesia are quite widely used in business, which can be seen in Indonesia itself that virtual money (cryptocurreny) such as Bitcoin and Centcoin are circulating. Then, the responsibility of the perpetrators of money laundering who use virtual money (Cryptocurrency) in stock trading, where this action has a very negative impact on the Indonesian State, especially in terms of business because people who have committed these crimes take advantage of technological advances unwise so that the perpetrators can be ensnared based on Law No. 8 of 2010 concerning the prevention and eradication of the crime of money laundering.
