Abstract

Abstract The development of digital services in Islamic banking has undergone significant transformation, one of which is through the BSI Mobile application presented by Bank Syariah Indonesia (BSI). This study aims to analyze the alignment of the fund transfer service on the BSI Mobile application with the principles of Maqashid Sharia, which include the protection of religion (hifz ad-din), life (hifz an-nafs), intellect (hifz al-'aql), descendants (hifz an-nasl), and property (hifz al-mal). The research method used was descriptive qualitative, with a library research approach, interviews, and observation. The results indicate that the fund transfer service through BSI Mobile complies with the principles of Maqashid Sharia and aligns with the fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), particularly in terms of transaction security, ease of access, and cost transparency. However, several areas still need improvement to ensure a more comprehensive implementation of Sharia principles. Abstract

This study examines the dynamics of social and formal legitimacy in zakat management at Masjid At-Taqwa Marbau, focusing on local committees operating without formal administrative recognition. The academic problem addressed is how social legitimacy is formed and interacts with fiqh principles and formal regulations, as well as its implications for the sustainability of zakat management. The study employs a qualitative case study approach, involving in-depth interviews, participatory observation, and documentation, with data analyzed using Huberman and Miles’ interactive analysis model. Findings indicate that community-based zakat management operates temporarily and informally, emphasizing efficiency, procedural simplicity, and social harmony. Social legitimacy is established through trust, tradition, social proximity, and informal religious authority, often serving as the primary foundation for the practice’s success. Tensions arise when social legitimacy intersects with formal legal requirements and fiqh principles, particularly regarding accountability, distribution, and the status of amil. This study proposes a hybrid legitimacy model, integrating the strengths of social legitimacy with formal governance principles, allowing zakat management to remain community-based while enhancing accountability and transparency. The findings contribute conceptually to understanding the relationship between social and formal legitimacy in zakat management in Indonesia.

Abstract

This paper examines the views of Muslim and Western philosophers on Islamic philosophy and science, with the aim of understanding the contributions and interactions between the two traditions of thought. Muslim philosophers such as Al-Farabi, Ibn Sina, and Al-Ghazali attempted to integrate religious teachings with rational thought, creating a dialogue between revelation and reason. They emphasized the importance of empirical experience, ethics, and spirituality in the development of science. Western philosophers, on the other hand, provided a different perspective, often emphasizing rationalism, empiricism, and the scientific method. Despite differences in epistemological and methodological approaches, the dialogue between Muslim and Western philosophers shows that the search for truth is a universal endeavor that transcends cultural and religious boundaries. This paper hopes to provide deeper insight into the relationship between philosophy and science in the Islamic context and the significant contributions made by thinkers from both traditions to the development of global science. The findings suggest that despite methodological differences, both Muslim and Western thinkers recognize the organic unity of philosophy and science in the Islamic tradition, as well as its relevance in addressing contemporary epistemological challenges.

Abstract

Penelitian ini bertujuan untuk mengetahui status kontrak akad yang sesungguhnya terjadi pada platform Shopee. Bagaimana Tinjauan Hukum Ekonomi Syariah terhadap bentuk aqad yang terjadi pada platform Shopee bila dikaitkan dengan akad ijarah. Jenis penelitian yang penulis gunakan adalah jenis penelitian lapangan (Field Research), untuk mendapatkan data-data dari permasalahan yang diteliti. Teknik pengumpulan data yang penulis gunakan adalah melalui wawancara dan dokumentasi. Pengolahan data dilakukan secara deskriptif kualitatif, kemudian diuraikan serta melakukan klasifikasi terhadap asfek masalah dan memaparkan melalui kalimat yang efektif. Hasil penelitian menunjukkan bahwa perjanjian kerja sama yang dilakukan antara shopee dan seller, praktek tersebut termasuk pada akad Ijarah hal ini bisa dilihat karena terpenuhinya rukun dan syarat Ijarah. Yaitu Shopee sebagai penyedia platform mu’jir dan seller sebagai penyewa musta’jir. Mengenai ijab dan qabul telah di lakukan ketika pengguna (seller) mendaftar pada platform shopee, mengenai waktu dan ujrah juga telah di jelaskan oleh shopee pada ketentuan layanan shopee. Jika dianalisis menggunakan akad ijarah, praktik perjanjian kerja sama antara shopee dan seller boleh dilakukan karena terdapat kemaslahatan atau kemanfaatan yang dirasakan kedua belah pihak. Hal ini juga menjadi prinsip penting dalam transparansi transaksi Hukum Ekonomi Syariah.

Abstract

This study examines the legal status of zakat on professional income earned by Indonesian migrant workers in South Korea, based on the views of Yusuf al-Qaradawi. It evaluates the applicability of his perspective to the practice of zakat in this context. Using a descriptive-analytical approach, the research is based on field data obtained through observation and structured interviews. The findings show that professional income is subject to zakat if workers meet the legal and religious requirements. The income is classified as al-mal al-mustafad al-amalah, meaning earnings derived from wages or salaries through professional work. Furthermore, the average monthly income of these workers exceeds the nisab threshold when compared to the regional minimum wage, thus fulfilling the obligation for zakat. Yusuf al-Qaradawi’s interpretation remains relevant, as he draws an analogy between zakat on professional income and zakat on monetary assets, underscoring its necessity among migrant workers.
