Abstract

Abstract

Since 2014, the government has been implementing the JKN BPJS program to meet the basic health needs of the poor. However, there are still disparities in service between BPJS and non-BPJS patients, such as complicated processes, limited facilities, restrictions on hospitalization, and discriminatory treatment by medical personnel. The main focus of this study is on the supervision carried out by the government to ensure equality in medical services. This study is a normative legal analysis based on secondary data obtained from literature reviews, employing a statutory and conceptual approach. The results of the study show that although the government has carried out its supervisory duties, the implementation is still not optimal, and the suboptimal supervision by relevant institutions (BPJS Supervisory Board, DJSN, and BPRS) has caused inequality in medical services. Even new policies such as the Standard Inpatient Class (KRIS), which aims to eliminate disparities, have not been optimally implemented. Based on the study's results, it was concluded that fairness in services is necessary to ensure equal treatment and access for all patients, without discrimination. Therefore, it is recommended that the government and supervisory agencies consistently enhance the effectiveness of supervision and provide training and guidance to medical personnel to ensure fair services are provided without discrimination based on insurance status.

Abstract

Doctors, as one of the main providers of health services to the community, play a very central role because they are directly involved in the provision of health services and the quality of those services. The main foundation for doctors to be able to perform medical procedures on patients is their knowledge, technology, and competence. The decline in public trust in doctors, as well as the increasing number of legal claims filed today, are often associated with failures in the healing efforts undertaken by doctors. These conflicts are triggered by patients' dissatisfaction with doctors in carrying out treatments or practicing their medical profession. In providing care, every doctor must uphold medical ethics, which determine the integrity of this profession. This raises the issue of the legality of using the water birth method in childbirth procedures performed by obstetricians and gynecologists in Indonesia and the role of the Medical Ethics Honorary Council (MKEK) in addressing this issue. The method used in this study is a normative method obtained through library research, supported by data from interviews with the West Jakarta IDI. The research findings indicate that the water birth method is not yet recommended for use in medical practice in Indonesia. Neither the IDI nor the Indonesian Medical College has recognized this method. When an obstetrician-gynecologist uses this method, the doctor in question may be categorized as having violated medical professional discipline and medical ethics. The Medical Ethics Council (MKEK) of the Indonesian Medical Association (IDI) will take action against any doctor found to have violated medical ethics. The enforcement of medical ethics by the MKEK IDI is more of a form of guidance for doctors to better understand and adhere to the code of medical ethics.

Abstract

The transition toward a digital tax administration system in Indonesia through the implementation of Coretax represents a strategic reform aimed at enhancing administrative efficiency, transparency, and taxpayer compliance within a self assessment framework. However, the emergence of intermediary practices commonly referred to as tax jockey services reflects structural and normative deficiencies in regulating third party access and digital accountability. This study employs a normative doctrinal legal method using statute and conceptual approaches to examine the legal construction governing digital taxation and its implications for unauthorized delegation practices. The analysis identifies regulatory gaps within Law Number 7 of 2021 and Law Number 28 of 2007, particularly concerning the absence of explicit limitations on informal representation, as well as insufficient integration with personal data protection principles under Law Number 27 of 2022. Furthermore, the findings reveal that weak authentication mechanisms and limited digital literacy contribute to systemic vulnerabilities that enable misuse of sensitive taxpayer data. This study proposes a normative reconstruction emphasizing stricter legal boundaries on third party involvement, strengthened digital authentication protocols, and integrative regulatory harmonization to ensure legal certainty, data protection, and sustainable taxpayer compliance.
