Abstract

Perundungan (bullying) di lingkungan pendidikan masih menjadi isu krusial yang menimbulkan dampak negatif terhadap perkembangan psikologis, emosional, dan prestasi akademik siswa. Penelitian ini bertujuan menganalisis kerangka hukum nasional terkait pencegahan bullying, meliputi Undang-Undang Perlindungan Anak, Permendikbud tentang Pencegahan dan Penanganan Kekerasan di Satuan Pendidikan, serta regulasi daerah yang relevan. Selain itu, kajian ini menelaah implementasi kebijakan di sekolah serta faktor-faktor penyebab terjadinya bullying. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan konseptual dan perundang-undangan, sehingga fokus analisis diarahkan pada norma hukum dan penerapannya dalam praktik pendidikan. Hasil penelitian menunjukkan bahwa kerangka hukum yang tersedia sebenarnya cukup memadai untuk mendukung upaya pencegahan, namun pelaksanaannya masih menghadapi kendala berupa kurangnya sosialisasi regulasi, lemahnya budaya sekolah dalam penegakan disiplin, serta minimnya keterlibatan orang tua dalam pengawasan. Temuan ini menegaskan perlunya strategi komprehensif yang tidak hanya berorientasi pada regulasi, tetapi juga pada penguatan pendidikan karakter, optimalisasi peran satuan tugas anti-kekerasan, serta pengembangan mekanisme pelaporan yang lebih efektif dan mudah diakses. Artikel ini merekomendasikan sinergi antara pemerintah, sekolah, dan masyarakat untuk menciptakan lingkungan pendidikan yang aman, inklusif, dan bebas dari praktik perundungan.

Abstract

Since 2014, the government has been implementing the JKN BPJS program to meet the basic health needs of the poor. However, there are still disparities in service between BPJS and non-BPJS patients, such as complicated processes, limited facilities, restrictions on hospitalization, and discriminatory treatment by medical personnel. The main focus of this study is on the supervision carried out by the government to ensure equality in medical services. This study is a normative legal analysis based on secondary data obtained from literature reviews, employing a statutory and conceptual approach. The results of the study show that although the government has carried out its supervisory duties, the implementation is still not optimal, and the suboptimal supervision by relevant institutions (BPJS Supervisory Board, DJSN, and BPRS) has caused inequality in medical services. Even new policies such as the Standard Inpatient Class (KRIS), which aims to eliminate disparities, have not been optimally implemented. Based on the study's results, it was concluded that fairness in services is necessary to ensure equal treatment and access for all patients, without discrimination. Therefore, it is recommended that the government and supervisory agencies consistently enhance the effectiveness of supervision and provide training and guidance to medical personnel to ensure fair services are provided without discrimination based on insurance status.

Abstract

Doctors, as one of the main providers of health services to the community, play a very central role because they are directly involved in the provision of health services and the quality of those services. The main foundation for doctors to be able to perform medical procedures on patients is their knowledge, technology, and competence. The decline in public trust in doctors, as well as the increasing number of legal claims filed today, are often associated with failures in the healing efforts undertaken by doctors. These conflicts are triggered by patients' dissatisfaction with doctors in carrying out treatments or practicing their medical profession. In providing care, every doctor must uphold medical ethics, which determine the integrity of this profession. This raises the issue of the legality of using the water birth method in childbirth procedures performed by obstetricians and gynecologists in Indonesia and the role of the Medical Ethics Honorary Council (MKEK) in addressing this issue. The method used in this study is a normative method obtained through library research, supported by data from interviews with the West Jakarta IDI. The research findings indicate that the water birth method is not yet recommended for use in medical practice in Indonesia. Neither the IDI nor the Indonesian Medical College has recognized this method. When an obstetrician-gynecologist uses this method, the doctor in question may be categorized as having violated medical professional discipline and medical ethics. The Medical Ethics Council (MKEK) of the Indonesian Medical Association (IDI) will take action against any doctor found to have violated medical ethics. The enforcement of medical ethics by the MKEK IDI is more of a form of guidance for doctors to better understand and adhere to the code of medical ethics.

Abstract

This study examines the normative tension between state sovereignty and investor legal certainty within the framework of international investment arbitration. Employing a doctrinal legal approach, the research analyzes statutory regulations, international legal instruments, and arbitral jurisprudence to assess how legal norms structure the relationship between regulatory authority and investment protection. The findings indicate that arbitration does not eliminate state sovereignty but reconfigures it through legality, proportionality, and good faith standards. Legal certainty for investors is contingent upon compliance with domestic law, while states retain authority to regulate in pursuit of public interests. The study further demonstrates that inconsistencies in regulatory design and institutional capacity intensify disputes and undermine normative balance. Accordingly, a coherent legal framework integrating national legislation, contractual design, and international commitments is required to ensure equilibrium. The research contributes to doctrinal development by proposing a prescriptive model that aligns sovereignty with investor protection in a dynamic legal order while emphasizing the necessity of interpretative coherence, judicial consistency, and regulatory clarity in contemporary investment governance systems globally today.
