Abstract

Mahkamah Konstitusi Republik Indonesia memegang kewenangan yang sangat strategis dan sensitif, yaitu menyelesaikan perselisihan hasil pemilihan umum. Dalam menjalankan peran sentral ini, Mahkamah Konstitusi secara terus-menerus bergulat dengan ketegangan paradigmatik antara dua doktrin besar dalam hukum tata negara, yakni aktivisme peradilan atau “judicial activism” dan pengekangan peradilan atau “judicial restraint”. Artikel ini bertujuan untuk menganalisis secara mendalam dinamika penerapan kedua pendekatan tersebut dalam putusan-putusan sengketa pemilu di Indonesia, dengan memberikan perhatian khusus pada Pemilihan Presiden tahun 2019 dan 2024, serta mengkaji dampak fluktuasi filosofis ini terhadap pengujian undang-undang pemilu dan rekomendasi reformasi kelembagaan. Metode yang digunakan adalah studi kepustakaan dengan pendekatan kualitatif analitis, yang berfokus pada analisis putusan pengadilan, literatur hukum, dan doktrin yang relevan. Temuan utama artikel ini menunjukkan bahwa meskipun Mahkamah Konstitusi secara institusional cenderung menerapkan doktrin pengekangan peradilan yang ketat dalam sengketa hasil pemilu, telah terjadi pergeseran paradigma yang tidak dapat diabaikan. Pergeseran ini paling nyata ditandai oleh lahirnya pendapat berbeda atau “dissenting opinion” dari tiga orang hakim konstitusi pada putusan sengketa Pilpres 2024, sebuah fenomena yang belum pernah terjadi sebelumnya dalam sejarah persidangan sengketa hasil pemilu presiden di Indonesia. Fluktuasi filosofis yang sama juga terlihat dalam putusan-putusan pengujian undang-undang pemilu, seperti kontroversi putusan mengenai batas usia calon presiden dan wakil presiden serta putusan progresif mengenai ambang batas pencalonan presiden. Kesimpulan dari artikel ini menegaskan bahwa dialektika antara aktivisme dan pengekangan peradilan mencerminkan upaya sungguh-sungguh Mahkamah Konstitusi dalam mencari titik keseimbangan yang sulit antara kepastian hukum, stabilitas politik nasional, dan keadilan substantif yang dicitakan oleh konstitusi. Sebagai rekomendasi, reformasi kelembagaan yang serius, khususnya pembentukan pengadilan khusus pemilu yang terintegrasi, dinilai sangat mendesak untuk mengatasi fragmentasi kewenangan yang selama ini melemahkan efektivitas penegakan hukum pemilu di Indonesia.

Abstract

The Constitutional Court of the Republic of Indonesia is vested with an absolute mandate as the final interpreter of the constitution, whose decisions are final and binding erga omnes. In exercising this authority, the Court faces a doctrinal dilemma between judicial activism—which fosters progressive interpretation to realize substantive justice—and judicial restraint, which emphasizes adherence to the literal text and respect for the separation of powers. This article aims to analyze the theoretical foundation of constitutional textual interpretation and to identify the forms and implications of judicial activism within the judgments of the Indonesian Constitutional Court. The research methodology employed is a literature review with a normative qualitative approach, utilizing primary and secondary legal materials analyzed through descriptive-analytical methods. The research findings indicate that the Indonesian Constitutional Court has undergone a dynamic paradigm shift from judicial restraint toward a highly progressive judicial activism, even acting as a positive legislator by creating new, regulatory legal norms. Several landmark judgments, such as Decision Number 90/PUU-XXI/2023 concerning the age limit for presidential and vice-presidential candidates, Decision Number 60/PUU-XXII/2024 concerning the nomination threshold for regional heads, and Decision Number 62/PUU-XXII/2024 concerning the presidential threshold, demonstrate the presence of judicial overreach, jurisprudential inconsistency, and infringement upon the boundaries of open legal policy (open legislative policy). The implications of this judicial activism include structural tensions with the legislature that trigger constitutional non-compliance, the threat of juristocracy or the shifting of mega-political issues to the courtroom. This article recommends the necessity of a simultaneous reconstruction at three levels: namely, the textual level through the formulation of guidelines on the limits of judgments; the institutional level through the strengthening of judicial ethics and an interpretation methodology based on proportionality; and the ecological level through the formalization of inter-institutional constitutional dialogue and the enactment of an independent Bill on the Procedural Law of the Constitutional Court with binding executorial deadlines.

Abstract

Kedudukan hukum atau legal standing merupakan prasyarat mutlak bagi setiap pemohon yang mengajukan permohonan pengujian undang-undang ke Mahkamah Konstitusi. Berdasarkan Pasal 51 ayat 1 Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi, pemohon harus menganggap hak dan kewenangan konstitusionalnya dirugikan oleh berlakunya suatu undang-undang. Artikel ini membahas secara khusus pertanyaan apakah anggota Dewan Perwakilan Rakyat (DPR) memiliki legal standing untuk menjadi pemohon dalam pengujian undang-undang di Mahkamah Konstitusi. Dengan menggunakan metode penelitian hukum normatif yang didasarkan pada studi kepustakaan dan analisis yurisprudensi, artikel ini menemukan bahwa Mahkamah Konstitusi secara konsisten menerapkan doktrin eksklusi pembentuk undang-undang. Doktrin ini menyatakan bahwa anggota DPR pada umumnya tidak memiliki kedudukan hukum karena mereka turut serta dalam proses pembahasan dan pengesahan undang-undang. Mahkamah hanya memberikan pengecualian terbatas dalam dua situasi, yaitu ketika hak konstitusional fungsional legislator dihalangi oleh suatu norma atau ketika anggota DPR bertindak dalam kapasitasnya sebagai warga negara biasa yang mengalami kerugian hak asasi yang bersifat privat dan aktual.

Abstract

The 2024 Indonesian general elections were the largest and most administratively complex democratic exercise in the country’s history, combining presidential, national legislative, and regional legislative contests on a single polling day and holding regional executive elections later in the same year. This article examines the causal relationship between the design of the concurrent election system and the protection of voters’ constitutional rights, and evaluates whether Indonesia’s dispute resolution architecture is capable of delivering electoral justice. Using normative-juridical research supported by secondary empirical data, and combining statutory, conceptual, case, and comparative approaches, the article advances two arguments. First, the “five-ballot” concurrent design satisfies the formal dimension of the right to vote while eroding its substantive dimension: it imposes an extreme administrative and physical burden on polling station officials and a cognitive burden on voters, so that high turnout coexists with attenuated deliberative capacity, particularly in legislative contests displaced by presidential coattails. Second, the fragmentation of electoral adjudication among the Constitutional Court, the Election Supervisory Agency, the Honorary Council of Election Organisers, and the State Administrative Court generates divergent standards of proof, inconsistent characterisation of identical conduct, and gaps in remedial authority that are most consequential precisely where structured, systematic, and massive violations are alleged. Analysis of the 2024 election result disputes indicates a discernible movement toward substantive justice, but one constrained by evidentiary thresholds and procedural limits rather than by judicial willingness. The article contributes an integrated account linking concurrency, voter protection, and forum fragmentation, and argues that reconstructing the electoral calendar and unifying electoral jurisdiction are complementary rather than alternative reforms.
