Abstract

The constitutional dual judicial review of the Constitutional Court and the regulation in the Supreme Court has created legal uncertainty in the legal system of Indonesia. The application of graded judicial review has a negative impact on the guarantee of the constitutional rights of the community. The hierarchical model of the prevailing law-enforcement regulation is the abandonment of the legal norms of the constitution in every level of legal product downward. Disconnection of constitutional norms only up to the level of the Act will be a denial of the rights of the people of Indonesia at all levels of statutory legislation under the law. As a rule of law, legal products have a value of truth and justice that refers to the source of the main legal order, namely the Constitution, so that Indonesia's constitutionalism can be tiered up and down down. Thus, there is no differentiation of the "legal certainty" between the 1945 Constitution and the KMPR, as well as the Act as an implementation product with various derivatives such as the Perpu, PP, Perpres, Provincial Regulations and Regency / City Regulations. The general nature of the constitutional arrangements becomes the standard of truth so that every act of government can be controlled and evaluated by the constitution. This situation is different from what is happening now, where the justice of regulation embodied by the Supreme Court is often biased toward the interests of "securing" the contents of the regulation rather than granting legal justice rights, not to mention the long waiting periods of unclear ends. MA finally failed to bring about legal justice for the community. This is where judicial review or judicial constitutional should be placed on the shoulders of the Constitutional Court so that the conception of the Indonesian legal state not only applies only at the national level, but also becomes a backbone for the community in each region through the granting of the right of the people to obtain justice through the examination of legal products that harm the constitutional rights community.

Abstract

Introduction to The Problem: The term interpretation of Pancasila seems rarely used to measure the substance of the Pancasila as the Indonesian nation’s weltanschauung. The term interpretation refers to the concept of constitutional and cultural meaning so that the order of civic life is in the same direction and under the paradigm of God, humanity, unity, society, and social justice. After the amendment of the 1945 Constitution, the Indonesian constitution has faced many changes. The changes that occurred are to creating a democratic governmental order. Even though the democratic rule of the government has surfaced, one thing for sure is that Pancasila is strengthening the form of Indonesia’s foundation. Because philosophy, enthusiasm, ideas, and thoughts of the nation’s life are determined by the underlying weltanschauung.Purpose/Objective Study: This study is trying to find the authentic interpretation of Pancasila based on its dynamic interpretation throughout Indonesian history.Design/Methodology/Approach: To answer these problems, the method used in this study is normative research with a conceptual approach so that interpretation is obtained by the paradigm built by the nation’s founders.Findings: By referring to library materials, the conclusion that can be drawn from this research is Pancasila, which is misinterpreted rigidly and is state-oriented to castrate the meaning of Pancasila as a public view of life. Then with the strong tendency of legal-formal interpretation so that it eliminates its substantive nature as weltanschauung or national outlook on life so that Pancasila loses its vital in the present state of life in Indonesia.

Abstract

Penelitian ini bertujuan untuk memahami bagaimana penggolongan SK PNS sebagai jaminan kredit perbankan dalam hukum jaminan serta upaya penyelesaian kredit bermasalah yang timbul dari perjanjian berupa pinjaman dengan jaminan SK PNS. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan sumber data sekunder seperti perjanjian pinjaman, peraturan perundang-undangan, literatur, dan didukung oleh data primer di lapangan. Hasil penelitian : Surat Keputusan Pengangkatan Pegawai Negeri Sipil tidak termasuk kualifikasi sebagai jaminan kredit perbankan menurut hukum jaminan di Indonesia karena tidak memenuhi hakikat jaminan sebagai pelunasan kredit, tidak memenuhi unsur-unsur benda, dan bukan merupakan surat berharga yang dapat dialihkan kepemilikannya, SK PNS tidak termasuk dalam jaminan kebendaan maupun jaminan perorangan, tetapi termasuk sebagai hak istimewa (prevelege). Bahwa pemberian pinjaman dengan jaminan SK PNS didasarkan atas dasar keyakinan oleh bank yang telah memiliki perjanjian terkait kredit dengan instansi yang bersagkutan, serta prinsip kepercayaan dan kehati-hatian terhadap debitor yang mampu melunasi hutangnya. Upaya Penyelesaian terhadap kredit dari perjanjian dengan jaminan SK PNS ialah sah karena telah memenuhi syarat sah suatu perjanjian sesuai yang diatur dalam Pasal 1320 KUH Perdata. Namun, perjanjian tersebut tidak memberikan kepastian hukum dalam pelaksanaan eksekusi aset jaminan karena SK PNS tidak memenuhi salah satu syarat aset jaminan yaitu dapat dinilai dengan uang dan mudah dijual untuk melunasi utang pinjaman.

Abstract

Belajar merupakan proses pemberian ilmu dari seorang yang memiliki ilmu pengetahuan yaitu guru kepada siswa (peneria ilmu). Dalam proses belajar banyak sekali ditemukan siswa yang malas dalam belajar, sehingga hasil yang didapat juga tidak sesuai dengan yang diharapkan. Sebagaimana yang terjadi di SMAS Pebangunan Bukittinggi ditemukan siswa yang memiliki minat belajar yang rendah, rendahnya minat belajar siswa tersebut terlihat pada saat proses belajar mengajar berlangsung, seperti siswa tidak bersemangat atau tidak bergairah dalam belajar, tidak mau mengerjakan tugas yang diberikan guru, sering minta izin dengan guru mata pelajaran untuk keluar kelas, tidak fokus dalam proses pembelajaran, ketiduran di kelas, selain itu terkadang siswa tersebut juga sibuk sendiri bermain HP disaat jam pelajaran berlangsung. Melihat permasalah yang terjadi itu maka tujuan penelitian ini agar dapat mengetahui penyebab siswa tidak aktif dalam belajar, kemudian bagaimana solusi guru dalamm menghadapi permasalahan tersebut. Penelitian menggunakan pendekatan deskriptif kualitatif, dengan Teknik pengumpulan data melalui observasi dan wawancara, adapun Teknik analisis data dilakukan secara mendalam. Lokasi penelitian yaitu di SMAS Pembangunan Bukittinggi.

Abstract

Background. Customary law ('urf) plays a crucial role in shaping Islamic legal thought, particularly in traditional regions where local traditions intersect with Sharia principles. Historically, Islamic jurists have recognized the relevance of customary law in legal deliberations, particularly when it does not conflict with the fundamental texts of the Qur'an and Sunnah. Purpose. This study aims to analyze the integration of customary law within the Islamic legal framework, emphasizing its role in the formulation of legal decisions across time periods and schools of jurisprudence. Methods. This study uses a qualitative research design with a case study approach to explore the role of Islamic social movements in shaping Indonesian democracy, particularly in the areas of activism, welfare, and education. Results. The findings indicate that customary law not only serves as a complementary legal source but also contributes significantly to the contextualization and adaptability of Islamic legal norms across various communities. Furthermore, jurists from the Maliki, Hanafi, and Shafi'i schools have demonstrated varying degrees of acceptance of 'urf, reflecting a dynamic and pluralistic legal tradition. Conclusion. In conclusion, the incorporation of customary law into Islamic jurisprudence underscores the flexibility and responsiveness of Islamic legal theory to local realities.

Abstract

Background. The development of Islamic law in Indonesia reflects ongoing efforts to reconcile normative fiqh with social realities within a plural legal system. The concept of social fiqh has emerged as a dynamic approach that emphasizes public interest, contextual reasoning, and responsiveness to societal change, particularly in the domains of criminal and civil law. Purpose. This study aims to analyze comparatively how social fiqh informs the formulation and implementation of Islamic criminal law and civil law regulations in Indonesia, and to assess its contribution to legal reform. Method. The research employs a qualitative comparative legal approach, combining normative analysis of statutes, court decisions, and fiqh literature with contextual analysis of socio-legal dynamics. Data are analyzed through doctrinal interpretation and comparative frameworks. Results. The findings indicate that, regardless of proficiency level, L1, FLCA, or FLE level, learners prefer more explicit OCF techniques, such as metalinguistics feedback and explicit correction. However, Korean undergraduates scored lower in the majority of OCF strategies (i.e., ignoring, elicitation, recast, explanation, and public feedback) compared to the other participants. Conclusion. The findings indicate that social fiqh plays a more explicit and flexible role in civil law regulations, facilitating adaptation to social needs, legal pluralism, and state law. In contrast, its influence on criminal law remains limited and cautious, constrained by positivist legal principles, human rights considerations, and political sensitivity.
