Abstract

The growing problem of marine debris indicates that technical and regulatory approaches alone have been insufficient to address the escalating ecological crisis. This condition suggests that the root of the problem lies not only in inadequate environmental governance but also in an anthropocentric paradigm that regards nature merely as an object of exploitation. This article aims to reconstruct environmental fiqh based on an ecotheocentric paradigm as an Islamic legal framework for addressing marine debris. This study employs a library research design with a normative-philosophical approach. Data were analyzed using descriptive-analytical methods by integrating the Qur’an, Hadith, maq??id al-shar??ah, classical fiqh, and contemporary environmental thought. The findings reveal that reconstructing environmental fiqh from an ecotheocentric perspective shifts the orientation of Islamic law from human-centered protection toward safeguarding marine ecosystems as a divine trust (am?nah). This reconstruction is reflected in the expansion of the legal object of protection to include marine ecosystems, the extension of ecological responsibility to individuals, communities, industries, and the state, and the formulation of Jar?mah Bi’iyyah Ba?riyyah as a normative category for marine pollution subject to ta?z?r sanctions oriented toward ecological restoration. These findings contribute to the development of contemporary environmental fiqh while offering a more responsive Islamic legal paradigm for addressing ecological crises and promoting ecological justice.

Abstract

Krisis ekologis pada era Antroposen menunjukkan bahwa kerusakan lingkungan tidak hanya dipicu oleh eksploitasi sumber daya alam, tetapi juga oleh cara pandang antroposentris yang menempatkan manusia sebagai penguasa absolut atas alam. Penelitian ini bertujuan mereposisi pemaknaan khalifah menuju paradigma amanah ekologis berbasis ekoteologi Qur'ani sebagai respons terhadap krisis ekologis era Antroposen. Penelitian ini menggunakan metode kualitatif dengan pendekatan library research. Data dianalisis menggunakan pendekatan hermeneutik Qur'ani melalui interpretasi dan kontekstualisasi ayat-ayat yang berkaitan dengan relasi manusia dan lingkungan serta didukung oleh berbagai literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa krisis ekologis pada era Antroposen juga mencerminkan krisis dalam pemaknaan khalifah, sehingga konsep tersebut perlu dipahami sebagai amanah ekologis yang menempatkan manusia sebagai subjek etis dalam menjaga keseimbangan ekosistem, bukan sebagai legitimasi dominasi atas alam. Reposisi ini dibangun melalui prinsip tauhid, amanah, mīzān, larangan berbuat kerusakan (lā tufsidū fī al-arḍ), dan fiqh al-bī'ah sebagai landasan normatif etika ekologis Islam. Dengan demikian, reposisi khalifah berbasis ekoteologi Qur'ani menawarkan paradigma etik yang lebih kontekstual dalam merespons krisis ekologis pada era Antroposen.

Abstract

This article aims to analyze the concepts of manṭūq and mafhūm from the perspective of Islamic legal theorists and to examine their implications for Islamic legal reasoning. This study employs a library research method with a descriptive-analytical approach, drawing upon classical and contemporary works on Islamic legal theory. The findings reveal that manṭūq and mafhūm function not only as linguistic tools for understanding legal texts but also as epistemological instruments that shape legal interpretation and reasoning. The analysis of scholarly perspectives indicates a consensus regarding the authoritative status of manṭūq, while discussions on mafhūm have generated diverse approaches in its application and development. These differences have implications for methods of legal inference and contribute to the diversity of juristic opinions. This study demonstrates that the discourse on manṭūq and mafhūm occupies a significant position in bridging the relationship between text, methodology, and the formulation of Islamic law.

Abstract

The determination of the evidentiary value of witness testimony depends not only on the facts presented before the court but also on the legal paradigm through which juridical truth is constructed. This study examines the evidentiary value of witness testimony from the perspectives of fuqaha and civil law to explain the epistemological foundations underlying their different approaches. Employing normative legal research with conceptual, statutory, and comparative approaches, this study finds that although both legal traditions recognize witness testimony as an essential means of proof, they adopt different standards for assessing its probative value. Islamic jurisprudence emphasizes the witness's moral credibility (ʿadālah) and legal qualifications, whereas civil law primarily relies on procedural legality and judicial evaluation. These differences demonstrate that the evidentiary value of witness testimony is fundamentally shaped by distinct epistemological conceptions of juridical truth. Accordingly, this study advances an epistemological perspective that enriches comparative scholarship on the law of evidence.
