Abstract

Artikel ini mengkaji sinergi antara hukum tata negara dan manajemen keuangan dalam mendorong pengembangan lembaga keuangan syariah di Indonesia. Kewenangan negara dalam mengatur sektor keuangan syariah tersebar pada tiga aktor utama, yaitu Bank Indonesia, Otoritas Jasa Keuangan (OJK), dan Dewan Syariah Nasional–Majelis Ulama Indonesia (DSN-MUI), yang idealnya bersinergi melalui mekanisme pengawasan berlapis antara pengawasan eksternal oleh OJK dan pengawasan internal oleh Dewan Pengawas Syariah. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, yang menelaah bahan hukum primer berupa peraturan perundang-undangan, peraturan OJK, dan fatwa DSN-MUI, serta bahan hukum sekunder berupa jurnal ilmiah dan hasil penelitian terdahulu. Hasil kajian menunjukkan bahwa meskipun kerangka kelembagaan pengaturan dan pengawasan lembaga keuangan syariah telah terbentuk, sinergi antara hukum tata negara dan manajemen keuangan syariah masih menghadapi tantangan, antara lain belum tegasnya batas kewenangan antarlembaga, keterbatasan independensi Dewan Pengawas Syariah, serta kesenjangan antara regulasi yang bersifat statis dengan dinamika produk keuangan syariah, khususnya pada sektor digital. Penelitian ini merekomendasikan penegasan kewenangan antarlembaga, percepatan penyerapan fatwa DSN-MUI ke dalam peraturan resmi, serta penguatan kapasitas Dewan Pengawas Syariah sebagai langkah strategis untuk memperkuat sinergi dan mendukung pertumbuhan lembaga keuangan syariah di Indonesia secara berkelanjutan.

Abstract

Financial literacy is an essential aspect of improving community welfare, particularly in response to the increasing diversity of financial products and services. Limited understanding of financial management and the principles of Islamic economics remains a challenge for many communities, including those in Koto Baru Village, Koto Baru District, Dharmasraya Regency. This condition may lead to poor financial decision-making, including ineffective income management, inappropriate use of financing facilities, and the selection of financial products that do not align with individual needs and Islamic values. This community service program aimed to enhance the financial literacy of the local community by providing education on smart, sound, and Sharia-compliant financial management. The program employed a participatory approach consisting of coordination with Bank Perkreditan Rakyat (BPR) Koto Baru, financial literacy counseling, household budgeting training, an introduction to Islamic economic principles, interactive discussions, financial management simulations, and evaluation through question-and-answer sessions and participant feedback. The target participants included residents living around BPR Koto Baru, comprising micro-entrepreneurs, homemakers, and members of the general public. The results indicated an improvement in participants' understanding of the importance of financial planning, simple cash flow recording, prudent debt management, emergency fund preparation, as well as the principles of the prohibition of riba (usury), transparent contractual agreements (akad), and profit-sharing mechanisms in Islamic economics. Furthermore, participants demonstrated strong enthusiasm for adopting more disciplined financial behaviors and making more responsible use of formal financial services. The program also strengthened the relationship between the community and the local financial institution as a partner in promoting financial inclusion and financial literacy.

Abstract

In Indonesia, Islamic law contributes significantly to the formation of the national legal system and legislation. However, in Nagari Talang, particularly in Jorong Tabek Pala, the situation shows otherwise. One of the main issues related to Islamic law is the inconsistency between the practice of pawning (gadai) and the provisions of Islamic law. Therefore, the research problems addressed in this study are: (1) How is the practice of rice field pawning conducted in Jorong Tabek Pala, Nagari Talang, Solok Regency? (2) How is the Islamic legal analysis of the implementation of rice field pawning in Jorong Tabek Pala, Nagari Talang, Solok Regency? This research is qualitative and descriptive in nature. The data sources consist of the pawners (rahin) and the recipients (murtahin) of the pawning in Jorong Tabek Pala, Nagari Talang, Gunung Talang District. Data were collected through interviews. Data analysis was conducted using data reduction, data presentation, and data verification. The validity of the data was tested using three techniques: source triangulation, time triangulation, and method triangulation. The findings of this study are: (1) The pawning practice carried out by the community in Jorong Tabek Pala is conducted as follows: the party in need of money offers their rice field to someone who has money and is willing to lend it. After finding someone willing to lend money, they make an agreement, either verbally or in writing. (2) From the perspective of Islamic law, the pawning practice in Jorong Tabek Pala falls under the category of riba (usury).
