Abstract

The massive data breach involving BPJS Kesehatan in 2021 revealed the vulnerability of Indonesia’s digital security ecosystem. Millions of citizens’ personal data appeared on online forums, raising concerns regarding privacy protection and institutional accountability. This incident underscored the urgent need for a comprehensive regulatory framework governing personal data protection. Law No. 27 of 2022 establishes clear obligations for data controllers and affirms the rights of data subjects, including individuals whose information is processed by public institutions such as BPJS Kesehatan. This study examines the legal responsibilities of BPJS Kesehatan as a public corporation in managing participants’ personal data, and explores the legal implications arising from negligence that results in data breaches. A normative legal approach is applied through statutory analysis and examination of academic literature. Findings show that BPJS Kesehatan bears substantial obligations as a data controller under the Personal Data Protection Law, including ensuring data security, maintaining transparency, and implementing proper data governance mechanisms. The 2021 breach demonstrated significant gaps in digital security infrastructure that affected public trust and exposed potential legal liabilities. The PDP Law provides administrative, civil, and criminal consequences for violations committed by data controllers. Strengthening of security, compliance, and internal audits is necessary to prevent recurrence of incidents.

Abstract

Dalam penelitian ini, Regional Security Complex Theory (RSCT) digunakan untuk menganalisis kegagalan ASEAN dalam menangani perjudian daring lintas negara. Digitalisasi yang pesat, perbedaan regulasi antarnegara, serta lemahnya koordinasi keamanan siber telah berkontribusi terhadap berkembangnya praktik perjudian daring di Asia Tenggara. Jaringan kriminal memanfaatkan perbedaan yurisdiksi, keterbatasan infrastruktur digital, dan lemahnya penegakan hukum untuk beroperasi secara transnasional. Dari perspektif RSCT, kegagalan tersebut mencerminkan kondisi undersecuritization, yaitu ketika negara-negara anggota ASEAN belum sepenuhnya memandang kejahatan siber dan perjudian daring sebagai ancaman regional bersama. Akibatnya, tidak terbentuk agenda keamanan kolektif yang kuat. Kondisi ini menyebabkan ASEAN belum mampu membangun kerangka regional yang komprehensif dalam hal penegakan hukum, pertukaran intelijen, dan harmonisasi kebijakan digital karena adanya perbedaan regulasi dan kapasitas negara. Situasi tersebut membuka ruang bagi sindikat perjudian daring untuk terus berkembang, yang pada gilirannya melemahkan stabilitas kawasan melalui peningkatan kejahatan digital, menurunnya kepercayaan publik, meningkatnya kerentanan ekonomi, serta potensi munculnya ketegangan antarnegara. Penelitian ini menunjukkan bahwa respons pada tingkat nasional saja tidak memadai untuk menghadapi ancaman siber lintas batas. Oleh karena itu, ASEAN perlu memperkuat kerja sama regional melalui harmonisasi hukum siber, peningkatan mekanisme penegakan hukum lintas negara, penguatan kapasitas kelembagaan digital, serta perluasan koordinasi intelijen regional guna meningkatkan ketahanan dan merespons ancaman siber yang terus berkembang secara efektif.

Abstract

The land conflict on Rempang Island, triggered by the national strategic project development of Rempang Eco-City, has sparked a sharp juridical debate between the aspects of state power (Machtsstaat) through investment policy instruments and the principles of the Rule of Law (Rechtsstaat) which emphasizes individual rights protection. This study aims to analyze the root causes of overlapping juridical claims between the Land Management Rights (HPL) held by BP Batam and the traditional physical land possession of the Rempang indigenous community based on the concept of the State's Right to Control (HMN), as well as to examine the legal standing and protection of uncertified land civil rights of the indigenous community viewed from the pillar of substantive justice in a Rule of Law. The research method applied is normative legal research utilizing a statute approach and a conceptual approach. The secondary data, consisting of primary, secondary and tertiary legal materials, were collected through literature review and analyzed qualitatively. The results indicate that the overlapping claims occurred due to the government's unilateral issuance of HPL over customary lands (tanah ulayat) that had been physically possessed peacefully, openly and generationally by the indigenous peoples (the Malay, Orang Laut and Orang Darat tribes) long before BP Batam or modern regulations were established. Within the perspective of substantive justice under the Rule of Law and the Basic Agrarian Law (UUPA), a land certificate is not the absolute source of rights but merely an administrative proof; thus, long-term physical possession in good faith (bezit/rechtsverwerking) by indigenous peoples constitutes a legally valid civil right that is constitutionally protected under Article 18B Paragraph (2) of the 1945 Constitution. Consequently, the civil legal protection for the Rempang indigenous community must be fulfilled through equal deliberation mechanisms (the right to consent or object to the project), fair compensation (covering both material and immaterial losses), or the granting of Communal Ownership Rights/land-sharing schemes to ensure that the indigenous people are treated as subjects of development rather than objects of land eviction for investor interests.
