Abstract

This study aims to investigate three main aspects of the reform: (1) the need to renew legal education in Indonesia to remain relevant and efficient, (2) the framework of a flexible and responsive model of legal education in addressing contemporary challenges, and (3) approaches to functionally link legal education with the complex social, legal, and economic conditions in Indonesia. The study employs a qualitative approach that integrates juridical-normative, socio-legal, and comparative methods. This approach is chosen because the theme of legal education is not only connected to regulatory aspects but also closely related to social dynamics, historical contexts, and the need for integration within a global framework. The findings reveal that traditional legal pedagogy, dominated by doctrinal formalism and a lack of practical experience, is inadequate in addressing the complexities of modern legal practice. The call for reform arises from the growing gap between the competencies of law graduates and the actual demands of the legal profession, judicial system, and society at large. ABSTRAK Studi ini bertujuan untuk menyelidiki tiga aspek utama dari reformasi tersebut: (1) kebutuhan untuk memperbaharui pendidikan hukum di Indonesia agar tetap relevan dan efisien, (2) gambaran model pendidikan hukum yang fleksibel dan responsif terhadap tantangan kontemporer, dan (3) pendekatan untuk menghubungkan pendidikan hukum secara fungsional dengan kondisi sosial, hukum, dan ekonomi yang kompleks di Indonesia. Studi ini mengambil pendekatan kualitatif dengan menggabungkan yuridis-normatif, socio-legal, dan komparatif. Metode ini dipilih karena tema pendidikan hukum tidak hanya terhubung dengan aspek regulasi, tetapi juga sangat terkait dengan dinamika sosial, sejarah, dan kebutuhan integrasi dalam konteks global. Hasilnya menunjukkan bahwa pedagogi hukum tradisional yang dikuasai oleh formalisme doktrinal dan minimnya pengalaman praktis ternyata tidak memadai untuk menghadapi kompleksitas praktik hukum modern. Desakan untuk reformasi muncul dari perbedaan yang semakin besar antara kemampuan lulusan hukum dan kebutuhan aktual dalam profesi hukum, sistem peradilan, serta masyarakat secara umum.

Abstract

This study aims to analyze law enforcement against social media–based fraud in Indonesia through a normative and empirical juridical approach. The focus is directed at the application of Article 378 of the Criminal Code and Article 28 paragraph (1) in conjunction with Article 45A paragraph (1) of the ITE Law, which often create challenges in practice, particularly in proving the elements of fraud and the dissemination of misleading information. The results indicate overlapping regulations, difficulties in digital evidence and inconsistencies in enforcement by law officers. Empirically, these issues contribute to the low effectiveness in handling such cases. Therefore, clearer legal norms, technical guidelines for digital evidence and strengthening the capacity of law enforcement agencies are necessary.
