Abstract

The object of administrative law is government power (bestuur; Verwaltung). State Administrative Law in the implementation of public services, the government often uses authority not by what is regulated in the law it violates human rights. Therefore, on the other hand, the function of state administrative law in creating good and authoritative governance is needed, including normative functions, instrumental functions, and legal guarantee functions, all three of which are part of the implementation to create a clean government, by the principles of state law. About the concept of good governance, state administrative law functions to protect human rights. The government carries out activities by applicable regulations or based on the principle of legality so that it will not lead to inappropriate service behavior which is an administrative mall act that is detrimental to people who want to obtain public services. This paper wants to analyze the correlation between state administrative law and human rights, aiming to see how the function of public services to implement good governance is good governance and forms of violations of public administration which are forms of human rights violations in the implementation of public services. The research method uses a normative juridical approach. This study concludes that efforts to implement good governance will be carried out if good governance can be implemented properly as well. Good governance will be born from a clean government, transparency, and accountability and it is undeniable that there are still various human rights violations in the implementation of public administration. Abstract

Norms that protect children as perpetrators or victims, especially narcotics, are basically complete, namely the application of Law No. 35 Of 2009 On Narcotics Against Children Involved In Narcotics Crimes After The Birth Of Law No. 11 of 2012 on Child Protection. Seeing the verdict against the child offender who should be given protection, on the other hand the child protection rules strongly emphasize that children should not be reduced let alone deprived of their independence. The research method uses empirical juridical approach, the data used is secondary data and primary data. The interviewees in this study consisted of interviews with judges, investigators, child lawyers, social workers from Child Protection institutions. The data analysis used is qualitative. The provisions stipulated in law No. 35 of 2009 this of course applies in general but if involved in narcotics crime is a child then it is mandatory to use the Child Act. Before the birth of Law No. 11 of 2012 on the juvenile criminal justice system, the law used in the event law is law No. 3 year 1997 namundalam practice when the procedural law is regulated in the Narcotics Crime Act then used by investigators is the Narcotics Act while the Act No. 3 of 1997 on Juvenile Court impressed only as a companion to the law.

Abstract

The crime of corruption is an extraordinary crime that has a broad impact on various aspects of life, including economic, social, and government. The principle of “Lex Specialis Derogat Legi Generalis” is the main basis in handling legal conflicts between general and specific provisions, especially in the context of law enforcement against corruption in Indonesia. Through Law Number 31 Year 1999 jo. Law Number 20 of 2001, this adage provides a more specific legal framework, enabling the application of more severe and effective sanctions against perpetrators of corruption.This research aims to analyze the application of the lex specialis principle in the eradication of corruption, including challenges such as overlapping norms, differences in interpretation, and systemic barriers. This research uses a normative juridical method with the approach of analyzing related legal documents. The results show that the application of the lex specialis principle provides clarity and efficiency in the law enforcement process, although it requires regulatory improvements and capacity building of legal apparatus. In conclusion, the application of this adage must continue to be refined through inter-agency collaboration, public education, and regulatory harmonization in order to create a fairer and more transparent legal system.

Abstract

Desa Kolam dapat dikategorikan termasuk Desa yang masih tertinggal dari aspek pendidikan, kekurangan informasi dari ajaran-ajaran Islam menyebabkan mereka minim pengetahuan khususnya tentang makan halal yang mereka konsumsi disisi lain mendeteksi apakah makanan tersebut sudah berkategori halal, mulai dari cara mendapatkannya, cara mengelolanya dan materinya adalah hal yang sangat urgen juga untuk disosialisasikan, bagi sebagahagian masyarakat di Desa Kolam bahwa makanan dikategorikan halal hanya jika materi nya halal, sarat lain tidak menjadi persoalan. Oleh karena itu sangatlah menjadi hal yang penting untuk melakukan kegiatan pengabdian kepada masyarakat dalam memberikan kontribusi dalam bentuk edukasi dan sosialisasi tentang produk makanan hala dan regulasi yang berkaitan dengan itu khususnya tentang kewajiban memperhatikan labelisasi halal pada setiap kemasan produk makanan. Tujuan dilakukannya kegiatan ini adalah bagaimana mengenalkan dan mendidik anggota keluarga terhadap pentingnya memilih produk makanan halal, karena dalam sistem pendidkan Islam, Keluarga merupakan lingkungan pendidikan pertama dan utama bagi generasi muslim, karena disanalah anak mulai mengenal segala sesuatunya hingga mereka menjadi tahu dan mengerti. Konsep Halal berarti diperbolehkan atau diijinkan dalam agama Islam (Alquran Surat Albaqarah 168-169). kegiatan ini dilakukan dengan metode cerama, diskusi dan pemberian quisioner. Maka hasil yang didapat dari kegiatan pengabdian kepada masyarakat tentang edukasi produk makanan halal bagi orang tua melalui pendekatan komunikasi interaktif adalah bahwa sangatlah penting bagi orang tua untuk memberikan arahan, nasehat atau bimbingan  kepada anak-anak tentang makanan yang halal khususnya bagi umat muslim melalui komunikasi intraktif dengan menggunakan tiga pendekatan, yang pertama memberikan informasi produk halal, yang kedua dengan cara persuasif yaitu keterampilan mengolah pesan yang menarik baik verbal atau non verbal sehingga anak senang berkomunikasi dengan orang tua, dan yang ketiga adalah dengan koarsif atau tindakan yang tegas

Abstract

Penelitian ini menganalisis kedudukan hukum tindak pidana perdagangan orang (TPPO) dalam memberikan perlindungan terhadap korban di Indonesia, dengan fokus pada studi Putusan Nomor 1656/Pid.Sus/2023/PN MDN. Perdagangan orang merupakan kejahatan serius yang melanggar hak asasi manusia dan seringkali melibatkan pekerja migran sebagai target rentan. Meskipun telah ada berbagai regulasi dan upaya penegakan hukum, implementasi perlindungan korban masih menghadapi tantangan. Penelitian ini bertujuan untuk mengkaji bagaimana kerangka hukum di Indonesia, khususnya dalam putusan pengadilan yang spesifik, berkontribusi pada perlindungan korban TPPO. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kasus terhadap putusan pengadilan. Hasil penelitian diharapkan dapat memberikan gambaran komprehensif tentang efektivitas hukum dalam melindungi korban TPPO serta mengidentifikasi celah dan rekomendasi untuk peningkatan kebijakan dan praktik penegakan hukum di masa mendatang.

Abstract

Community service with the issue of early marriage is very important in order to encourage and empower the community, especially youth and village officials to be aware, know, have the capacity and participate in preventing and rejecting early marriage. Through this program socialization/campaign through KIE will be carried out in the Village of Pool, Percut Sei Tuan District, Deli Serdang Regency and training of peer educators and paralegals from the community in an effort to prevent early marriage. Through this program it is also hoped that there will be youth participation in the formation of a youth community and village apparatus formed through a Village Decree on Rejecting Early Marriage in the Village of Pond, Percut Sei Tuan District.

Abstract

This study aims to analyze the legal protection of victims of sexual violence in the application of diversion based on restorative justice within Indonesia’s juvenile justice system. The research is grounded in the gap between the ideal concept of restorative justice, which upholds restorative values, and its practical implementation that often neglects the rights of victims, particularly children who experience sexual violence. This situation creates a dilemma between the principle of protecting juvenile offenders and ensuring substantive justice for victims. The study employs a normative juridical method with statutory, conceptual, and analytical approaches through a literature review of primary, secondary, and tertiary legal materials. The findings reveal that the implementation of restorative justice in cases of child sexual violence faces several obstacles, including the ambiguity of diversion limits, the absence of specific standard operating procedures, and the lack of involvement of psychologists and social workers representing victims’ interests. Theoretically, this study contributes to strengthening the victim-oriented perspective within Indonesia’s restorative justice framework, which has been predominantly offender-centered. Practically, it recommends the formulation of more assertive and comprehensive legal policies to ensure a balance between the rehabilitation of offenders and the restoration of victims’ rights, including the establishment of specific SOPs and monitoring mechanisms for diversion implementation. Thus, this research addresses the existing gap in the practice of restorative justice by asserting that true justice can only be achieved when the juvenile justice system equally prioritizes the protection and recovery of victims.

Abstract

AbstractAll children are entitled to live, to grow, to thrive and to be protected from violence and discrimination. In reality, though, the number of children with legal problems increases significantly over the years. The treatment of children in trouble with the law suggests that they are often treated as "miniatures" of criminal adults. The study aims to assess the capacity of law enforcement officials, including police, prosecutors, judges, government, and related agencies. Recognizing the needs of these institutions, we implemented an alternating diversion of restorative justice approach. The government has projected the rupiah's exchange rate at rp9,100 per dollar in the Jakarta interbank spot market on Monday as investors bought the local unit on Wednesday. The study USES a descriptive qualitative study method with a prescriptive quality of research with an empirical approach and USES primary and secondary data. The data gathered is analyzed by organizing the data into categories, detailing them in units, and drawing conclusions that are easily understood. The results of this study have concluded that understanding with law enforcement officers especially at the police level is better because the completion of children's cases outside the law can be resolved at the investigative level. Abstract

The circulation and abuse of drugs in society must be prevented and tackled. This prevention effort must be carried out in accordance with the issuance of the Drug Law so that this drug problem does not continue to grow in society as a bad epidemic for the development of the country. The research methods used are normative and empirical juridical research. The nature of the research used in this study is descriptive analysis.Sources of data used in this study are primary and secondary data. The obstacles faced by the Batangkuis Police Drug Unit are 2, namely non-penal policy barriers and penal policy barriers. Based on the results of the study, the conclusion in this study is the legal regulation of narcotics based on Law No. 35 of 2009 on narcotics prioritizes rehabilitation of drug addicts and users, but very high criminal sanctions against narcotics dealers and precursors. The spirit and purpose of the promulgation of the Narcotics Act is to prevent and eradicate illicit trafficking of narcotics in Indonesia. The obstacles faced by the Batang Kuis Police Drug Unit there are two namely non-penal policy barriers and penal policy barriers.Preventive barriers related to raids carried out at night entertainment venues in Batang Kuis, often hampered by the problem of leaking information about entertainment venues to be conducted raids. The penal policy barriers faced by the Batangkuis Police Drug Unit, consists of two barriers, namely internal and external barriers.
