Abstract

The ease of access to digital financial services, such as digital wallets, has strengthened the effectiveness of cyber influence techniques as a tool for criminals. Digital wallets offer convenience in financial transactions without requiring physical presence or strict identification, increasing the risk of misuse. In the context of child sexual exploitation, social engineering techniques leveraging digital wallets can have devastating impacts. Perpetrators may deceive child victims, their families, or financial service providers to gain financial resources for committing crimes. This research addresses two key questions: how perpetrators use influence techniques and digital wallets to commit child sexual exploitation, and how Indonesian law addresses their criminal liability. The study employs prescriptive legal research to analyze coherence between legal norms and behavior, utilizing a conceptual and statutory approach to identify the legal basis for criminal liability. Perpetrators often manipulate victims gradually, employing persuasion, pretexting, phishing, or threats. The accessibility of digital wallets enables these actions, facilitating payments while evading stricter identification processes. Although perpetrators are held liable under laws such as the Child Protection Law, the Pornography Law, and the Criminal Code, enforcement challenges persist. Strengthening legal frameworks, enhancing law enforcement, and raising public awareness are essential measures to safeguard children from such crimes.

Abstract

Sengketa lahan sawit di Kecamatan Telawang, Kabupaten Kotawaringin Timur, kerap memicu konflik yang mengancam stabilitas sosial dan ekonomi. Untuk mengatasi permasalahan ini, Polsek Telawang menerapkan pendekatan mediasi penal sebagai solusi alternatif di luar jalur peradilan. Pendekatan ini menekankan musyawarah dan kesepakatan bersama guna mencapai penyelesaian yang adil, cepat, dan hemat biaya. Keberhasilan mediasi penal dipengaruhi oleh kejelasan regulasi, profesionalisme aparat kepolisian sebagai mediator, ketersediaan fasilitas pendukung, serta peran norma adat dan budaya lokal. Faktor-faktor tersebut saling berkaitan dan memengaruhi efektivitas mediasi dalam meredam konflik lahan sawit. Penelitian ini menggunakan metode hukum empiris untuk menganalisis implementasi dan faktor-faktor yang memengaruhi efektivitas pendekatan mediasi penal. Hasil penelitian menunjukkan bahwa optimalisasi regulasi, peningkatan kompetensi aparat, penyediaan sarana memadai, dan pelibatan kearifan lokal mampu meningkatkan efektivitas mediasi. Dengan memaksimalkan faktor-faktor ini, mediasi penal menjadi solusi yang lebih efisien dan berkeadilan, membantu mengurangi eskalasi konflik, serta menciptakan kepastian hukum bagi masyarakat. Pendekatan ini berpotensi menjadi model penyelesaian sengketa lahan yang berkelanjutan di daerah dengan karakteristik sosial budaya serupa.

Abstract

Urgensi kerjasama antara Satgas PPKS Universitas Palangka Raya dan institusi eksternal menjadi semakin penting dalam menghadapi kasus kekerasan seksual yang kompleks. Latar belakang masalah ini mencakup tantangan yang dihadapi oleh Satgas PPKS dalam menangani kasus secara mandiri, yang seringkali memerlukan sumber daya dan keahlian dari luar kampus, serta didasari oleh kebutuhan akan sinergi yang kuat dengan institusi eksternal, seperti lembaga hukum, organisasi non-pemerintah, dan pihak kepolisian, guna memberikan dukungan yang komprehensif kepada korban dan memastikan keadilan dapat ditegakkan. Tujuan dari penelitian ini adalah untuk mengeksplorasi pentingnya kolaborasi tersebut dan bagaimana sinergi antara berbagai institusi dapat meningkatkan efektivitas penanganan kasus kekerasan seksual. Argumen utama penelitian ini adalah bahwa kolaborasi lintas institusi akan memberikan dukungan yang lebih komprehensif dan berkelanjutan bagi korban, serta memperkuat upaya pencegahan di lingkungan kampus Universitas Palangka Raya. Metodologi penelitian menggunakan pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara, dan analisis dokumen terkait kerjasama antar institusi/lembaga. Hasil penelitian diharapkan dapat memberikan rekomendasi praktis untuk meningkatkan kerjasama antara kampus dan institusi eksternal, serta menunjukkan pentingnya pendekatan multidisiplin dalam menangani kekerasan seksual di lingkungan akademik.

Abstract

The purpose of this research is to study and analyze The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency East Barito Regency which has not yet acquired recognition and protection and Analyzing The Legal Recognition and Protection of the Ma’anyan Dayak Indigenous Law Society when there is an event of legal actions occurs. This Research is Empirical Research which obtained through legal identification (Oral) in form of habits that are still valid in the Ma’ayan Dayak Indigenous Society unit in Awang Sub Regency East Barito Regency which is then analyzed using an objective and relevant theory about The Traditional Rights Indigenous Law Society, therefore accurate results can be discovered about types of rights analyze The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency East Barito Regency which must be given recognition and protection. This Research concludes that The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency have not been protected since the regional government of east barito regency until now has not implemented and follow up The Minister of Affairs Regulation Number 52 of 2014 and from the Decree the Governor of Central Kalimantan Number 188.44/360/2020 about establishment the Central Kalimantan Province. Legally, there has been legal recognition of the indigenous law society and traditional rights attached to The Traditional Rights of the Ma’anyan Dayak Indigenous Society in Awang Sub Regency, which is Article 18 B paragraph (1) of the 1945 Constitution, however, there has not been further regulated in form of legislation and the desired legal recognition is not just de jure, limited to limited verbal legal recognition which coming first from the indigenous society itself and the surrounding society, but demand on embodiment in the true sense. Therefore when there is an event of legal actions occurring over The Traditional Rights of the Ma’anyan Dayak Indigenous Society prefers to resolve legal actions outside the court with their mechanism to resolve legal actions that occur in their territory according to the customary law through deliberation and consensus. Therefore, the Regional Government of East Barito Regency is expected to form a regional regulation as legal protection for protecting the rights of indigenous society in the various development process, the rights of indigenous society are not ignored.

Abstract

Customary law is a law that was born even before Indonesia proclaimed its independence in 1945. Customary law is part of original law and has grown and developed in Indonesia so that it also influences the implementation of the Indonesian legal system. The development and renewal of Indonesian law should not forget the important parts of the building blocks of the Indonesian legal system, including Customary Law. In short, this writing using a qualitative descriptive method provides an overview of the important role of customary law which should always be part of the renewal of the legal system in Indonesia. Historically, the formation of the Indonesian legal system also departs from the concept of customary law that lives in Indonesian society which was ultimately influenced by the Dutch legal system when the Dutch colonized Indonesia. The concordance process of the Dutch legal system colored the formation of the Indonesian legal system which in fact could not be denied that it still left a residue in several parts of the Indonesian legal system such as the old version of the Criminal Code and the civil code. The development and renewal of the National Legal System according to the author should not leave material legal sources as the basis for the formation of a legal system that reflects the spirit of Indonesia. Material legal sources that are reflected in Pancasila, the ideals of Indonesian society, values, norms, kinship, deliberation, mutual cooperation, tolerance, and so on that characterize Indonesian society must be a priority scale in structuring the Indonesian legal system in the future, including part of cultural heritage in the context of customary law.

Abstract

Praktik politik uang merupakan salah satu bentuk kejahatan elektoral yang mengancam integritas demokrasi dan kedaulatan rakyat. Dalam konteks pemilihan kepala daerah, politik uang tidak lagi dilakukan secara individual dan sporadis, melainkan berkembang menjadi perbuatan yang bersifat terstruktur, sistematis, dan masif (TSM). Penelitian ini bertujuan untuk menganalisis politik uang sebagai pelanggaran TSM melalui pendekatan yuridis dan kriminologis, dengan menelaah konstruksi hukum, pola kejahatan, serta dampaknya terhadap proses demokrasi. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan analisis putusan sebagai bahan pendukung. Hasil penelitian menunjukkan bahwa politik uang sebagai pelanggaran TSM memenuhi karakteristik kejahatan terorganisir yang melibatkan jaringan aktor, perencanaan yang matang, serta pengulangan tindakan secara luas. Dari perspektif kriminologi, praktik ini didorong oleh faktor kekuasaan, ekonomi, dan lemahnya kesadaran hukum masyarakat. Penelitian ini menyimpulkan bahwa penanggulangan politik uang TSM tidak cukup hanya melalui pendekatan represif hukum pidana, tetapi juga memerlukan strategi pencegahan berbasis kriminologi untuk memutus mata rantai kejahatan elektoral secara sistemik.

Abstract

The rapid development of Artificial Intelligence (AI) has brought significant changes to the criminal justice system, particularly in criminal investigations and evidentiary processes, while simultaneously raising complex legal and ethical challenges. Objective: This study aims to analyze the legal implications of the use of AI in criminal investigations, focusing on its benefits, risks, and challenges related to the admissibility of AI-based evidence, as well as the need for regulatory frameworks that ensure fairness, transparency, and accountability. Methods: This research employs a normative qualitative approach through the analysis of legal regulations, a review of legal and technological literature, and a comparative approach across jurisdictions, complemented by case studies of AI applications in law enforcement practices. Results: The findings indicate that AI enhances investigative efficiency through data analysis, crime prediction, and digital forensics; however, it also poses risks such as algorithmic bias, human rights violations, and issues concerning the reliability and transparency of evidence. Furthermore, differences across legal systems result in the absence of uniform standards for the admissibility of AI-based evidence. Therefore, adaptive regulatory frameworks grounded in the principles of fairness, transparency, and accountability are required, along with strengthened human oversight to ensure that the use of AI aligns with the principles of justice and human rights protection.
