Abstract

Kenyataan praktik dilapangan memperlihatkan bahwa kegiatan pasar modal (bursa efek) sangat rawan terhadap berbagai bentuk kejahatan yang mempunyai akibat sangat luas terhadap perekonomian dan stabilitas nasional. Hal ini terlihat dengan semakin berkembangnya pasar modal yang disertai pula dengan kemajuan teknologi dan informasi di era globalisasi ini ternyata tidak hanya kemudahan saja yang dapatkan akan tetapi juga terdapat akibat lain, baik langsung maupun tidak langsung, dapat mengancam stabilitas perekonomian terutama dalam menciptakan suatu sistam pasar modal yang wajar dan tertib. Kenyataan yang terjadi, disetiap negara yang menjual efek melalui pasar modal senantiasa mendapat ancaman dari berbagai tindakan yang dapat merusak mekanisme yang wajar, sehingga bisa merugikan pihak – pihak yang beritikad baik. Atas hal tersebut hukum sebagai keseluruhan asas dan kaidah yang mengatur kehidupan dalam masyarakat harus dapat menjadi suatu instrumen pendukung kegiatan pasar modal yang menyediakan solusi untuk menghadapi tindakan – tindakan yang merugikan atau kejahatan – kejahatan dalam bidang pasar modal yang dapat menghambat terciptanya pasar modal yang wajar dan tertib.

Abstract

Kredit dalam kegiatan perbankan merupakan salah satu usaha yang utama, karena pendapatan terbesar dari usaha bank berasal dari pendapatan kegiatan usaha kredit, yaitu berupa bunga dan provisi. Ruang lingkup dari kredit sebagai kegiatan perbankan, tidaklah semata-mata berupa kegiatan peminjaman kepada nasabah saja, melainkan sangatlah komplek karena menyangkut unsur-unsur yang cukup banyak didalamnya meliputi : Sumber-sumber dana kredit, Alokasi dana, Organisasi dan menajemen perkreditan, Kebijakan perkreditan, Dokumentasi dan administrasi kredit, Pengawasan kredit serta penyelesaian kredit bermasalah, Mengingat begitu luasnya ruang lingkup dan unsur-unsur yang melingkupi kegiatan perkreditan ini, maka penanganannya pun harus dilakukan secara sangat hati-hati dengan di dukung profesionalisme serta integritas moral yang harus melekat pada sumber daya manusia dan pejabat perkreditan.

Abstract

Terkait lembaga kredit ini, ada satu varian dari lembaga tersebut yaitu apa yang dinamakan kredit sindikasi. Permasalahan kredit sindikasi pada prinsipnya sama dengan permasalahan lembaga kredit pada umumnya, hanya saja variable kredit sindikasi lebih komprehensif dan kompleks dibandingkan dengan kredit pada umumnya. Dari kekomplekan variabel kredit sindikasi tersebut, kiranya akan muncul masalah-masalah krusial dikemudian hari jika hal itu tidak di-cover dengan lembaga hukum yang tangguh. Setidak-tidaknya ada tiga alasan yang bisa digunakan sebagai justifikasi dari proporsi yang terakhir. Pertama, kredit sindikasi akan melibatkan jumlah kredit dalam skala yang tidak sedikit.Kedua, kredit sindikasi sering dipakai dalam pola hubungan long-term. Ketiga, akan menyangkut subyek hukum yang tidak sedikit yang terlibat didalamnya.

Abstract

Undang-undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan Atas Tanah beserta benda-benda yang berkaitan dengan tanah, yang telah diundangkan tanggal 9 April 1996 dalam Lembaran Negara Republik Indonesia Tahun 1996 No.42 Tambahan Lembaran Negara Republik Indonesia No.3632 dan mulai berlaku efektif sejak diundangkan pada tanggal 9 April 1996. Undang-undang ini merupakan amanat dari Pasal 51 UUPA, merupakan suatu reformasi dibidang hukum pertanahan di Indonesia khususnya menyangkut hukum jaminan atas tanah, yang diharapkan dapat menunjang serta sekaligus sebagai alat pengaman kegiatan perkreditan dalam upaya memenuhi kebutuhan tersedianya dana melalui Lembaga Perbankan untuk menunjang Pembangunan Nasional. Melalui Undang-undang ini maka tuntaslah Unifikasi Hukum Pertanahan Nasional, khususnya hukum jaminan atas tanah yang merupakan salah satu tujuan Undang-Undang Pokok Agraria, sehingga Hak Tanggungan menjadi satu-satunya Lembaga Jaminan Atas Tanah.

Abstract

Coastal development projects, such as Pantai Indah Kapuk 2 (PIK 2), have createdsignificant legal and social challenges for long-established coastal communities.This study aims to analyze the legal protection of coastal communities' rights in thedevelopment of PIK 2 from the perspective of agrarian law. Using a normativejuridical method and qualitative analysis, the study reveals a gap between existingregulations and the implementation of coastal community rights protection. Landconflicts emerge as a major issue due to unclear land ownership status and weakcompensation mechanisms implemented by developers. Furthermore, the lack ofcommunity participation in planning processes exacerbates the socio-economicimpacts they experience. Compensation mechanisms tend to focus solely oneconomic value without considering the social and cultural aspects inherent incoastal communities. This study highlights the need for policy reforms in protectingcoastal community rights, including strengthening regulations, ensuringtransparency in compensation mechanisms, and increasing community involvementin decision-making processes. More equitable and sustainable policyimplementations are expected to create a balance between development interests andthe protection of coastal community rights

Abstract

Village asset land has a vital role as a supporter of development and a source of village income, but there are often issues of legal certainty over its ownership and management status, especially when utilized as a school building. Therefore, a clear regulation and settlement mechanism in accordance with laws and regulations are needed so that village assets remain protected and can be optimally utilized for the public interest. This research aims to analyze the legal certainty of land ownership of village assets used as school buildings based on the Regulation of the Minister of Home Affairs Number 3 of 2024. The method used is normative juridical with a descriptive-analytical approach through the review of legislation, legal doctrine, and relevant secondary data. The results show that village land used for schools remains legally classified as village assets and must be managed in accordance with the principles of transparency, accountability, and legal certainty. The land exchange mechanism—as regulated in Articles 25 and 48A of Minister of Home Affairs Regulation No. 3 of 2024—requires replacement with land of equal or higher value, and proper certification under the village government's name. However, its implementation faces challenges, including uncertified land ownership, limited legal capacity of village officials, and bureaucratic hurdles in administrative approval, all of which hinder effective and lawful asset management and the preservation of the land’s social function. Keywords: Village assets; legal certainty; school; certification; swap

Abstract

Land is an important resource that often causes conflicts, one of which is overlapping ownership certificates. This conflict leads to legal uncertainty and hinders land utilization. The government, through the National Land Agency (BPN), resolves this issue through peaceful mediation. This study examines how the Bandung City Land Office conducts mediation to resolve disputes arising from overlapping certificates. The research method used is descriptive with a normative juridical approach, collecting data through interviews, observations, and literature review. Qualitative analysis is conducted to understand the mediation process, the cancellation of problematic certificates, and the stages of dispute resolution in accordance with applicable regulations. The results of this study can serve as a reference for developing land mediation systems and assist in formulating policies that ensure legal certainty and protect land rights.

Abstract

Implementing SIMRS towards an integrated Hospital Management Information System (SIMRS) is important for improving operating effectiveness and moving healthcare services closer to being fully digital. Some parts of SIMRS are still not fully implemented across all service units at Bhayangkara Hospital Kupang. For example, patient registration, billing, and electronic medical records are already in use, but they are not fully linked across all service units yet. Service flow, teamwork between departments, and decision-making based on facts are all less effective because of this. Through in-depth interviews, field observations, and document readings, the study used a qualitative descriptive case study method.Findings show that there are several major problems with creating an integrated SIMRS. These include inadequate IT infrastructure, staff members who aren’t good with computers, the lack of standard operating procedures (SOPs) across departments, and the continuation of a culture of doing things by hand. These problems lead to more work for the staff, duplicate data, delays in service and reporting, and unhappy patients. To make sure that SIMRS is used consistently and effectively, the hospital’s management needs to come up with a full system development plan that includes strengthening internal policies, training staff, improving infrastructure, and putting together a cross-unit coordination team. Improving user skills and getting the technology infrastructure ready should be at the center of system development so that SIMRS can be used to its fullest potential. A fully integrated SIMRS should help with work speed, service data clarity, real-time management decision-making, and, in the end, better patient care at Bhayangkara Hospital Kupang

Abstract

The legal protection of midwives in providing emergency care, as regulated in Indonesia’s Health Law Number 17 of 2023, is essential for ensuring legal certainty and safety in medical practice. This study aims to analyze the scope of legal liability related to first aid provided by midwives to patients in emergency situations. Using a normative juridical approach and descriptive-analytical method, this research is based on literature reviews and secondary data from relevant laws and professional guidelines. The findings indicate that midwives are legally protected as long as their actions follow professional standards, codes of ethics, and standard operating procedures. Legal protection includes the right not to be criminally or civilly prosecuted when giving life-saving aid in emergencies within their competence, even if done beyond their normal authority—as long as it is based on scientific judgment and good faith. However, legal sanctions may apply if midwives act negligently, without proper competency or authority, or if harm is caused due to failure to follow procedures, such as not making timely referrals or conducting improper medical treatment. Illustrative cases show that midwives can face criminal charges (e.g., under Article 359 of the Criminal Code) or civil lawsuits when there is proven malpractice or patient death due to unprofessional conduct. This study emphasizes the need for clear legal frameworks supported by preventive mechanisms (such as continuous professional education), repressive actions (like disciplinary or criminal measures), and non-litigation efforts (such as mediation or institutional protection through professional associations) to ensure justice, safety, and legal clarity for midwives practicing in emergency contexts..Keywords: midwife; emergency care; legal protection; professional standards; regulation
