Abstract

The determination of nasab for children born outside of marriage is a multifaceted legal and social issue, especially within the context of family law in Indonesia. This study delves into the critical role and decisions of Religious Courts in Indonesia concerning the nasab of such children, exploring how these courts balance national legal frameworks with the principles of Islamic law. Through a comprehensive analysis, the study highlights the legal factors, justifications, and ratio decidendi that underpin the decisions of the Religious Courts. It is imperative to understand the methodologies these courts employ in interpreting legal precedents, applying Islamic jurisprudence, and considering the broader social implications of their rulings. The investigation also looks into the procedural aspects of these cases, including the presentation of evidence, the involvement of legal and religious experts, and the impact of societal norms and pressures on judicial outcomes. It explores how the rulings influence public perceptions of legitimacy, inheritance rights, and social status, as well as their impact on the lives of children born outside of marriage and their families. The findings of this study underscore the dynamic interplay between religious norms and legal requirements in Indonesia, highlighting the challenges and opportunities in harmonizing these two systems. The study concludes by emphasizing the necessity for ongoing research to evaluate the long-term effects of these rulings on children's rights, social cohesion, and the development of a more inclusive and just legal framework.

Abstract

This study delves into the examination of Islamic law within the framework of lethal injection for terminally ill patients in Indonesia. The research focuses on the ethical and legal dimensions surrounding the use of lethal injection as a method of administering end-of-life care for individuals facing terminal illnesses. Employing a comprehensive analysis of Islamic legal literature and scrutiny of Indonesia's legal provisions pertaining to the termination of patients, the study seeks to ascertain the compatibility of lethal injection with Islamic principles. The research adopts a comparative legal analysis approach, comparing the tenets of Islamic law with Indonesia's existing legal framework concerning end-of-life decisions. By exploring the perspectives of prominent Islamic scholars and jurists, the study aims to provide insights into the multifaceted nature of the debate surrounding lethal injection within the context of Islamic law. The findings of this analysis will contribute to the ongoing discourse on ethical considerations and religious perspectives regarding end-of-life care, with implications for Indonesia's healthcare policies and legal regulations in the realm of terminal patient care.

Abstract

This study aims to investigate the deep historical connections between Minangkabau and Negeri Sembilan, two regions with rich cultural heritage in the archipelago. We explore the traces of this heritage to uncover the historical significance of Minangkabau in the formation and development of Negeri Sembilan's culture. The research method involved in-depth historical analyses as well as a careful literature review, which helped us understand the influence that Minangkabau culture has had on the social structure, customary system, values and traditions of the people of Negeri Sembilan. Our results show that this historical footprint reflects not only cultural adoption, but also the complex interaction between Minangkabau and Negeri Sembilan, which has shaped a rich and unique cultural identity in the history of the archipelago. Research findings reveal the deep-rooted nature of this cultural relationship, starting from the early arrival of Minangkabau people in Negeri Sembilan during the 15th and 16th centuries, to diplomatic relations with Raja Mahmud of Pagaruyung in 1773. The historical significance of Minangkabau in Negeri Sembilan culture has important relevance in understanding the cultural dynamics of the region.

Abstract

This research focuses on discrimination against religious minorities in Indonesia, Malaysia and Brunei Darussalam, three countries with strong religious traditions and legal systems. As a result of this diversity, different religious backgrounds often raise significant legal and social issues when they want to register their marriages, resulting in unpredictable events and difficulties when settling serious matters. This research utilises a qualitative methodology to examine legal texts, court judgements, court decisions, and data from case studies and interviews, which illustrate the complex interaction between religious and sectarian law. Through a comparative analysis of laws in Indonesia, Malaysia and Brunei Darussalam, this study explains how religious and sectarian norms in the legal system impact discriminatory practices. The research findings of legal and administrative challenges faced by interfaith couples, such as denial of marriage registration and the risk of social stigma, suggest a broader tension between religious authorities and state governance. With comprehensive legal reforms that not only address religious issues but also protect the rights of all individuals, and provide valuable insights and recommendations that can be implemented globally by those responsible for the practice of law, particularly in Indonesia, Malaysia and Brunei Darussalam

Abstract

Secondary education in the United States is undergoing significant changes in response to the technological and economic developments of the Industrial Revolution 5.0. In facing these challenges, the role of hidden curriculum becomes crucial in preparing students for the increasingly interconnected and automated workforce. Hidden curriculum, which includes values, attitudes, and social skills that are not explicitly taught, has a significant impact on shaping students' character and interpersonal skills. This study aims to examine how hidden curriculum in U.S. secondary education plays a role in preparing the younger generation for the challenges of the industry, particularly in the development of social skills, creativity, work ethics, and adaptability. The research method used is a qualitative approach, through literature analysis and interviews with teachers and students, to explore the implementation and impact of hidden curriculum in the context of secondary education. The findings indicate that while formal curricula often focus on technical skills, hidden curriculum plays an equally important role in developing the skills necessary for success in the Industrial Revolution 5.0. This study suggests that more attention should be given to the integration of social values and interpersonal skills into the secondary education curriculum, as well as the importance of teacher training to optimize the role of hidden curriculum in preparing students for the ever-evolving global challenges.

Abstract

Purpose – This study aims to develop and evaluate an entrepreneurship-based curriculum aligned with the Freedom to Learn (Merdeka Belajar) initiative at State Madrasah Aliyah in Bukittinggi, Indonesia. Recognizing the necessity of equipping students with entrepreneurial skills, creativity, and self-reliance, this research addresses the critical gap between traditional Islamic education and modern labor market demands Design/methods/approach – A qualitative case-study approach, complemented by quantitative analysis, was utilized. Data collection involved purposive sampling, participatory observation, semi-structured interviews, document analysis, and closed-ended questionnaires. Participants included school leaders, teachers, students, alumni, and parents. Qualitative data were analyzed thematically, while quantitative data provided descriptive statistics to strengthen findings. Findings – The integration of experiential learning and project-based entrepreneurship significantly enhanced students’ practical business skills, creativity, problem-solving ability, and interpersonal competencies. The curriculum explicitly incorporates principles of student autonomy and flexible learning, central to Indonesia’s Freedom to Learn (Merdeka Belajar) initiative. However, substantial challenges were identified, including inadequate infrastructure, limited funding, a shortage of qualified teachers, and societal resistance rooted in traditional perceptions of madrasahs as purely religious institutions. Student questionnaire results indicated positive perceptions of the curriculum’s effectiveness (mean score > 4.2 out of 5). Research implications – Findings provide actionable insights for policymakers, educators, and administrators seeking to implement effective entrepreneurship curricula. Strategic interventions such as enhanced teacher training, structured mentoring, and robust industry collaboration are recommended to address implementation barriers, preparing students for real-world economic challenges and ultimately fostering socio-economic growth and community development.

Abstract

This study aims to examine how radical ideologies shape the construction of women’s identities and influence their perceptions of social roles in Indonesia. Using a qualitative descriptive approach, the research combines in-depth interviews with women involved in extremist networks and literature analysis to capture the social and psychological dimensions of their experiences. The findings reveal that radical ideologies provide alternative identity frameworks that differ from traditional narratives portraying women as passive or subordinate. Instead, these ideologies offer a sense of empowerment, belonging, and purpose, attracting women who feel marginalised or dissatisfied with their societal positions. The study also finds that women’s involvement in radical groups can simultaneously challenge patriarchal norms while reinforcing ideological control under extremist structures. This duality illustrates how radical movements reconstruct gender roles and redefine women’s participation in sociopolitical life. The research concludes that dissatisfaction with social inequality and the search for meaning are key drivers of women’s radicalisation. Therefore, understanding the identity dynamics within this process is crucial for developing effective gender-sensitive strategies to prevent extremism. The article contributes to the broader field of gender and radicalisation studies by providing empirical insights into how women negotiate power, identity, and ideology in the context of Indonesian society. This study aims to determine the position of women as witnesses in Islam. Islam as a religion has legal principles that define women's roles and responsibilities in various areas of life, including as witnesses in Islamic law. This study examines the Islamic view of women as witnesses, evaluates the legal norms governing women's participation in testimony, and analyzes the application of these principles in Islamic jurisprudence. The research method analyzes classical Islamic texts such as the Quran and Hadith to understand the legal basis of women's testimonial role. In addition, the research also examines the various interpretations that have emerged on this topic in the Islamic tradition. The results of this study can provide a deeper understanding of whether the status of women as Islamic witnesses is in accordance with the principles of gender justice and equality and how the concept is implemented in contemporary Islamic jurisprudence. This research is expected to contribute to the literature on the role of women in the Islamic legal system, provide a balanced view on gender issues in the context of testimony and provide a discussion on the importance of Islamic values in the legal system of Islamic values in modern society.
