Abstract

The principle of freedom of contract is a fundamental doctrine in private law that grants parties autonomy to determine agreements. In Indonesian civil law, this principle is reflected in Article 1338 of the Civil Code, which affirms that legally concluded agreements bind the parties. However, its application is more complex in government construction contracts because they involve public resources and public policy. This study analyzes the application and limitations of contractual freedom in government construction agreements under Law No. 2 of 2017 on Construction Services. This research uses a normative juridical approach to examine statutory regulations, legal doctrines, and scholarly perspectives. The findings show that contractual autonomy operates as regulated autonomy rather than absolute freedom. Procurement regulations, administrative authority, technical standards, and public accountability mechanisms significantly influence the structure and implementation of construction agreements. These regulatory constraints produce several legal consequences, including limited negotiability of contractual clauses, potential invalidity of provisions exceeding administrative authority, and stronger requirements for regulatory compliance in determining contractual validity. The study further indicates that these limitations require a more structured approach to drafting government construction contracts, emphasizing standardized clauses, transparent procurement procedures, and clear risk allocation. Strengthening the balance between contractual flexibility and regulatory oversight is therefore essential to improve legal certainty, accountability, and efficiency in public infrastructure development.

Abstract

Ikat weaving is a cultural product with significant symbolic and economic value in the development of a local culture-based creative economy, particularly in East Nusa Tenggara Province, Indonesia. This study aims to examine how social identity, cultural identity, textile diversity, consumer preference, and ikat weaving preference shape ikat weaving consumption patterns. A quantitative research design was employed using a survey of 97 respondents who had experience purchasing or using ikat weaving from East Nusa Tenggara. Data were analyzed using a structural equation modeling approach. The results show that social identity has a significant influence on cultural identity and consumer preference. Cultural identity affects perceptions of textile diversity, which subsequently shape preferences for ikat weaving. Consumer preference is found to have the strongest influence on ikat weaving consumption patterns. Mediation analysis indicates that most relationships operate through direct pathways based on identity and preference rather than complex indirect mechanisms. These findings suggest that ikat weaving consumption is not merely an economic decision but represents a socio-cultural process reflecting collective identity. This study provides empirical insights into cultural product consumption and supports the development of sustainable local creative economy strategies.

Abstract

As the province's capital, Kupang City has adequate communication and internet infrastructure, with an internet penetration rate above 70%. However, not all MSME (Micro, Small, and Medium Enterprise) actors have optimally utilized these facilities to advance their businesses. Lele Bumbu is one such MSME that remains stagnant, even though catfish consumption in Indonesia remains one of the main protein sources with consistently high demand. Due to limited capital and low digital literacy, Lele Bumbu operates as a home-based industry and has not utilized digital marketing effectively. This community service program (PkM) aims to assist and train Lele Bumbu to improve product quality, establish proper management, and adopt digital marketing and financial technology, ultimately creating a strong digital brand. The method employed uses a PRA (Participatory Rural Appraisal) approach through collecting primary and secondary data, focus group discussions (FGD), and implementation via socialization, training, and mentoring for business owners. The PkM activities increased business owners' capacity to master digital marketing, financial recording applications, and business management. Based on the analysis, business management capacity improved by more than 70%, the ability to use marketing and financial applications increased by more than 75%, and product quality improved by 50% regarding the product and its packaging.

Abstract

Construction work contracts are legal instruments that play an important role in regulating the relationship between construction service users and providers. This study aims to analyze the position of construction work contracts from a civil law perspective, the application of contractual principles, and the legal protection of parties involved in construction agreements. This research employs a normative juridical method using statutory and conceptual approaches through literature studies of legal regulations, legal references, and previous studies. The results indicate that construction work contracts function not only as administrative documents but also as the basis of legal relations that establish rights, obligations, and responsibilities among parties. The implementation of contractual principles, including freedom of contract, consensualism, pacta sunt servanda, good faith, and balance between parties, is essential in ensuring legal certainty. Nevertheless, construction contracts still encounter various legal issues, such as breach of contract, project delays, work modifications, and disputes regarding responsibilities. Therefore, clear and balanced contract arrangements are necessary to provide legal protection and support successful infrastructure development.

Abstract

Building failure in government construction projects is a legal issue involving technical, contractual, and liability aspects among parties involved in construction services. This study aims to analyze the position of government construction contracts from a civil law perspective, the contractual responsibilities of construction service users and providers regarding building failure, and efforts to strengthen legal certainty in resolving such issues. This research employs a normative juridical method using statutory and conceptual approaches through literature studies of regulations, legal references, and previous studies. The results indicate that construction contracts serve as the foundation of legal relationships that establish rights, obligations, and responsibilities among the parties. Liability for building failure cannot be automatically imposed on one party but must be determined based on contractual provisions, the causes of failure, and the causal relationship between actions or negligence and resulting losses. Strengthening legal certainty can be achieved through comprehensive contract arrangements, proportional risk allocation, and the implementation of contractual law principles in construction dispute resolution.

Abstract

Mahasiswa semester enam Fakultas Ekonomi Universitas Kristen Artha Wacana masih menghadapi kendala dalam menentukan ide penelitian, menelusuri literatur secara sistematis, mengevaluasi kelayakan topik, dan menyusun pendahuluan skripsi. Kondisi tersebut berpotensi menghambat kesiapan mahasiswa dalam menyusun proposal skripsi pada semester berikutnya. Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan kemampuan mahasiswa dalam merumuskan ide penelitian dan menyusun pendahuluan skripsi melalui pelatihan yang mengintegrasikan penelusuran literatur berbasis Science and Technology Index (SINTA), evaluasi kelayakan ide penelitian, serta praktik penyusunan pendahuluan secara sistematis. Mitra kegiatan terdiri atas 24 mahasiswa semester enam Program Studi Akuntansi, Fakultas Ekonomi, Universitas Kristen Artha Wacana. Metode pelaksanaan menggunakan pendekatan pelatihan partisipatif yang meliputi tahap persiapan, pelaksanaan, praktik, dan evaluasi. Evaluasi dilakukan melalui pre-test dan post-test untuk mengukur perubahan pemahaman serta rubrik penilaian untuk menilai hasil praktik mahasiswa dalam penelusuran literatur, pemilihan ide penelitian, dan penyusunan pendahuluan. Hasil kegiatan menunjukkan adanya peningkatan pemahaman dan kemampuan praktis mahasiswa, terutama dalam melakukan penelusuran literatur dan mengevaluasi kelayakan ide penelitian. Sebagian besar peserta juga mampu mengidentifikasi literatur yang relevan dan menyusun komponen utama pendahuluan secara lebih sistematis. Kegiatan ini menunjukkan bahwa integrasi penelusuran literatur, evaluasi kelayakan penelitian, dan praktik penyusunan pendahuluan dapat menjadi pendekatan yang relevan untuk meningkatkan kesiapan mahasiswa dalam memasuki tahap penyusunan proposal skripsi.
