Abstract

Jalan Raya Singkawang-Bengkayang merupakan jalan kelas IIIB dengan jumlah kecelakaan 278 kasus. Tujuan penelitian ini adalah meninjau geometrik jalan, apatelah sesuai standar perencanaan menurut Tata Cara Perencanaan Geometrik JalanAntar Kota No.38 Tahun 1997 Direktorat Bina Marga. Survei penelitian iniyaituberupapencatatanmarking dan tracking, kondisi jalan beserta kelengkapannya,sehingga didapat 12 tikungan yang kemudian dipilih 6 yang selanjutnya dilakukan pengukuran. Analisa geometrik terhadap 6 tikungan diperoleh kondisi eksisting jalan<5m sedangkan menurut standar Direktorat Bina Marga yaitulebarjalan 6 m,sehingga beberapa tikungan belum memenuhi standar dan beberapa tikungan perlu adanya perbaikan sesuai kebutuhan masing-masing. Perbaikan geometrik pada 6 tikungan yakni lebar jalan, kecepatan, superelevasi, pelebaran pada tikungan, jarak pandang henti dan kebebasan samping sesuai perencanaan masing masing tikungan juga perbaikan alinyemen vertikal yaitu perbaikan kelandaian pada tikungan yakni pada tikungan 9,dan 16.Kata Kunci : Tikungan, Gometrikjalan, Jalan Raya Singkawang-Bengkayang,

Abstract

Tujuan dari penelitian ini adalah untuk meningkatkan hasil belajar siswa kelas VII di MTs Roudlotut Tholibin dalam mata pelajaran matematika melalui penggunaan model pembelajaran Quantum Teaching. Metode penelitian yang digunakan adalah penelitian tindakan kelas (PTK) yang meliputi empat langkah, yaitu perencanaan, tindakan, observasi, dan refleksi, serta terdiri dari dua siklus. Subjek penelitian adalah siswa kelas VII MTs Roudlotut Tholibin pada tahun pelajaran 2022/2023. Data dikumpulkan melalui teknik tes, observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa penggunaan Quantum Teaching dapat meningkatkan hasil belajar siswa. Terdapat peningkatan yang signifikan dalam pencapaian akademik siswa dalam mata pelajaran matematika dari siklus I ke siklus II, dan nilai rata-rata tes matematika meningkat pada setiap siklus. Pada siklus I, nilai rata-rata kelas adalah P= 61,84 dengan tingkat kelulusan siswa sebesar 31,57%. Pada siklus II, nilai rata-rata kelas adalah P= 84,87 dengan tingkat kelulusan siswa sebesar 89,47%. Berdasarkan hasil penelitian, dapat disimpulkan bahwa penggunaan model pembelajar Quantum Teaching dapat meningkatkan hasil belajar siswa

Abstract

This research aims to identify the effectiveness of democratic and authoritarian systems of government in the context of newly independent states, using Maqashid Shariah theory as an analytical framework. Through a desk study and qualitative research, this research explores how the two systems support or hinder the process of national development, political stability, and the achievement of social and economic progress. The results show that democracy offers freedom, active participation of the people, and social justice that are in line with the principles of Maqashid Sharia. However, it also requires solid institutions and mature political awareness. On the other hand, authoritarian systems offer stability and security, but often at the expense of individual freedom and social justice in the long run. This research suggests that transitioning to democracy or integrating elements of both systems in a hybrid model can be a strategy to achieve a balance between stability and freedom, as well as inclusive and sustainable economic growth. In conclusion, in choosing and implementing a system of government, newly independent countries should pay attention to how the system can support the achievement of Maqashid Shariah's objectives, including the balance between government power and individual freedom, as well as promoting sustainable economic growth and social stability.

Abstract

Panaik money is money given by the groom to the bride's familyas financing for the wedding ceremony, and one of the things that must begiven apart from the dowry. The determination of the panaik money inNusantara Jaya Village is carried out by deliberation between the groom'sfamily and the bride's family, and in terms of the amount of the gift it is seenfrom several aspects such as beauty, noble family, social strata, the higher thelevel of education the higher the amount of panaik money must be given. Thisarticle will discuss the Islamic view regarding determining and giving Panaikmoney in marriage. The type of research that the authors use is field research.While the approach used in this research is qualitative. The results of thisstudy indicate that giving Panaik money has become an ingrained habit amongthe Bugis community, especially in Nusantara Jaya Village. Some of the ways ofgiving are done in cash, some are done in installments according to theagreement of both parties. Meanwhile, for the determination of Panaik moneyby means of deliberation from both parties, the benchmark for Panaik moneycan be seen from education, beauty, respectable family, and others. There isnothing in the Qur'an and Hadith that discusses the existence of Panaik money,but Islamic law addresses this with the theory of the Al-'Adah Muhakkamahfiqh rules so that useful habits can continue to be carried out. If you look at theperpetrators, they are included in the category of 'urf hash, if you look at theirwork, they are 'urf fi'li.

Abstract

A husband should not neglect his obligations, especially in regards to marital relations. If a husband neglects these obligations, it can have an impact on his wife and can lead to disputes between the two parties, even resulting in the dissolution of the marriage. The dissolution of a marriage can occur for various reasons, one of which is fasakh. The type of research used by the author is library research, using a qualitative approach. The primary sources in this study are the book of Imam al-Nawawi's Majmu' Syrh al-Muhaddab and the book of Ibn Hazm's al-Muhalla, while the secondary sources are obtained from literature related to the research problem. The data collection technique is done through documentation, while the data analysis uses content analysis which will then be compared to the opinions of the two imams. The results of this study are that according to Imam al-Nawawi, if a woman marries an impotent man, the wife is allowed to file for fasakh to the judge and the judge will give a one-year period. If within one year her husband can recover, then the wife remains a valid wife. However, after one year, if the husband does not recover, the wife is given the choice by the judge to either continue the marriage or dissolve it. If the wife is willing to accept her husband's condition, then she remains a valid wife, but if she is not willing to accept it, the judge will dissolve the marriage. Meanwhile, according to Ibn Hazm, in a marital relationship, if a defect is found in either the husband or wife, such as impotence, the marriage cannot be dissolved by fasakh due to the absence of valid evidence or nash, whether from the Qur'an, hadith, ijma', or al-dalil. The only way out if the husband is impotent is by talak pronounced by the husband. The result of the comparison of the opinions of the two imams is that impotence as a reason for fasakh according to Imam al-Nawawi is permissible based on the hadith narrated by Said bin Musayyab and the hadith narrated by Zaid bin Ka'ab. Meanwhile, Ibn Hazm argues that it is not permissible because he rejects the hadith narrated by Said bin Musayyab and the hadith narrated by Zaid bin Ka'ab.

Abstract

The dowry (mahr) is a consequence of the marriage contract, traditionally given in various forms, such as property, teaching Qur'an, or other valuable contributions. However, societal dynamics have introduced new forms, including shares as dowry. This study explores the legality and minimum value of shares as dowry according to Imam Shafi'i and Imam Quduri. The research employs a qualitative library study with primary sources including al-Umm by Imam Shafi'i and al-Quduri by Imam Quduri, and secondary sources such as Bidayatul Mujtahid and Roudhatut Thalibin. Data is collected through documentation and analyzed using content analysis. Imam Quduri considers shares valid as dowry, setting a minimum value of ten dirhams (approximately Rp. 42,494.29). If the shares are below this amount, the dowry is invalid and must be replaced with a mahr mithil (customary dowry). He emphasizes preserving the dignity of the bride. Imam Shafi'i, referencing Surah al-Baqarah (2:237) and relevant hadiths, adopts a more flexible stance, allowing shares as dowry without specifying a minimum value. Both scholars base their views on the Qur'an and Hadith but differ in interpretation, reflecting a textualist approach. This study highlights the evolving understanding of dowry in Islamic jurisprudence.

Abstract

This study responds to the discourse on the possibility of a waiting period (‘iddah) for men, positioning it as a reflection of ongoing legal development within Islamic law. Although not recognized in classical Islamic jurisprudence, this concept has gained attention following the issuance of Circular Letter No. P 005/DJ.III/Hk.00.7/10/2021 by the Directorate General of Islamic Community Guidance, which recommends a period of restraint for exhusbands before remarrying. While Islamic legal sources provide no textual or scholarly basis for a formal ‘iddah for men, the circular proposes a syibhul ‘iddah (quasi-‘iddah), grounded in the ethical rationale of preventing covert polygamy and protecting the sanctity of the former wife's waiting period. Legally, the circular serves only as a recommendation and carries no binding legal sanction. However, from the perspective of legal benefit (maslahah), it represents a progressive effort to adapt Islamic legal norms to contemporary social realities.Thus, syibhul ‘iddah may be viewed as part of modern Islamic legal discourse promoting justice and social welfare.

Abstract

The writing of the Qur’anic manuscript has developed through two primary systems: Rasm Uthmani and Rasm Imla’i. In Indonesia, the dynamics between these two systems are evident in the processes of transmission, reception, and standardization of the Qur’anic script, influenced by historical developments and official policies, particularly from the Lajnah Pentashihan Mushaf al-Qur’an. This study aims to examine the transformation and adaptation of Qur’anic writing systems over time, as well as to analyze the impact of standardization policies on community practices. Using a historical-philosophical approach and a library research method, this study analyzes various manuscripts and printed mushafs. The findings indicate that Rasm Imla’i was more dominant during the early development of local mushafs due to limited access to the principles of Rasm Uthmani. However, since the implementation of standardization by religious authorities, Rasm Uthmani has become the official form in mushaf publication, although the Imla’i form continues to be used in educational contexts for pedagogical reasons. These findings reveal a tension between religious authority and local tradition and suggest the need for an epistemic re-evaluation of mushaf standardization policies within the context of contemporary Indonesia.
